FIRST REGULAR SESSION SENATE JOINT RESOLUTION NO. 26 103RD GENERAL ASSEMBLY INTRODUCED BY SENATOR COLEMAN. 0084S.01I KRISTINA MARTIN, Secretary JOINT RESOLUTION Submitting to the qualified voters of Missouri, an amendment to article III of the Constitution of Missouri, by adding thereto three new sections relating to offenses involving federal law. Be it resolved by the Senate, the House of Representatives concurring therein: That at the next general election to be held in the 1 state of Missouri, on Tuesday next following the first Monday 2 in November, 2026, or at a special election to be called by 3 the governor for that purp ose, there is hereby submitted to 4 the qualified voters of this state, for adoption or 5 rejection, the following amendment to article III of the 6 Constitution of the state of Missouri:7 Section A. Article III, Constitution of Missouri, is 1 amended by adding thereto three new sections, to be known as 2 sections 38(e), 38(f), and 38(g), to read as follows:3 Section 38(e). Nothing in this constitution or the 1 laws of this state may be construed to establish a right to 2 possess or distribute child pornography in violation of 3 federal law or engage in any criminal racketeering activity 4 as defined by federal law, notwithstanding any other 5 provision in this constitution or the laws of this state. 6 Section 38(f). The General Assembly and all local and 1 municipal governments in this state shall have the power to 2 outlaw and punish the possession and distribution of child 3 pornography and any criminal racketeering activity as 4 SJR 26 2 defined by federal law, notwithstanding any other provisio n 5 in this constitution or the laws of this state. 6 Section 38(g). Any person has standing to bring suit 1 against any individual who violates federal law relating to 2 child pornography or any criminal racketeering activity as 3 defined by federal law and courts shall award injunctive 4 relief and reasonable attorney's fees to any prevailing 5 plaintiff in such suit. 6
