SCHOMER 3 4 A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF 5 MONTANA REQUESTING AN INTERIM STUDY OF THE MONTANA STATE FUND'S PLAN 3 WORKERS' 6 COMPENSATION INSURANCE; AND REQUIRING THAT THE FINAL RESULTS OF THE STUDY BE 7 REPORTED TO THE 70TH LEGISLATURE. 8 9 WHEREAS, the Montana State Fund, as an independent public corporation, is subject to oversight from 10 the Legislature, the Office of the State Auditor, the Department of Revenue, and the Board of Investments ; and 11 WHEREAS, the Montana State Fund has been subject to numerous lawsuits concerning impropriety 12 and conflicts of interest ; and 13 WHEREAS, the Montana State Fund has been accused of mishandling policyholders' funds and 14 imposing unnecessary fees. 15 16 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF 17 THE STATE OF MONTANA: 18 That the Legislative Council be requested to designate an appropriate interim committee or statutory 19 committee, pursuant to section 5-5-217, MCA, to examine the Montana State Fund's Plan 3 workers' 20 compensation insurance for state employees. 21 BE IT FURTHER RESOLVED, that the study investigate: 22 (1) class codes; 23 (2) rates; 24 (3) tiers; 25 (4) discounts; 26 (5) dividends; and 27 (6) whether Montana State Fund agents are monetarily incentivized for acquiring state employee 28 workers' compensation policies. 69th Legislature HJ0068.2 - 2 - Authorized Print Version – HJ 68 1 BE IT FURTHER RESOLVED, that the interim committee work with stakeholders, including business 2 owners and representatives of the Montana State Fund. 3 BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review 4 requirements, be concluded prior to September 15, 2026. 5 BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions, 6 comments, or recommendations of the appropriate committee, be reported to the 70th Legislature. 7 - END -
