21 | 21 | | (a) Surveying Information Required. – The Department of Transportation shall include 9 |
---|
22 | 22 | | in any plan prepared for the purpose of acquiring right-of-way, a permanent easement, or both, 10 |
---|
23 | 23 | | that depicts property lines, right-of-way lines, or permanent easements, a set of drawings that 11 |
---|
24 | 24 | | clearly identify design alignments, baseline control points, found property-related corner 12 |
---|
25 | 25 | | markers, and new right-of-way and permanent easement corner markers. Plans subject to the 13 |
---|
26 | 26 | | requirements of this section shall document the localized coordinates for each major control point 14 |
---|
27 | 27 | | along the design alignments. The coordinates and associated localization metadata shall be based 15 |
---|
28 | 28 | | upon, and tied to, the North Carolina State Plane Coordinate system and shall be clearly identified 16 |
---|
29 | 29 | | within the plans. All property corner markers found found, identified, and surveyed shall be 17 |
---|
30 | 30 | | clearly identified within the plans in accordance with general surveying standards and 18 |
---|
31 | 31 | | procedures. Each property corner marker shall be accurately tied to the design alignment or the 19 |
---|
32 | 32 | | North Carolina State Plane Coordinate system, by either a system of bearings and distances or 20 |
---|
33 | 33 | | by station and offset. For the purposes of this section, the phrase "new right-of-way and 21 |
---|
34 | 34 | | permanent easement corner markers" must include all property boundary intersections along 22 |
---|
35 | 35 | | right-of-way or permanent easements acquired by the Department. 23 |
---|
36 | 36 | | (b) Installation of New Right-of-Way and Permanent Easement Corner Markers. – The 24 |
---|
37 | 37 | | Department of Transportation shall survey and install new right-of-way and permanent easement 25 |
---|
38 | 38 | | corner markers utilizing metal stakes, or materials of comparable permanence, along 26 |
---|
39 | 39 | | right-of-way or permanent easements acquired by the Department, as described in subsection (a) 27 |
---|
40 | 40 | | of this section, in accordance with general surveying standards and procedures after the 28 |
---|
41 | 41 | | completion of a project for which right-of-way or permanent easements were acquired." 29 |

42 | 42 | | SECTION 2. This act is effective when it becomes law and applies to Department 30 |
---|
43 | 43 | | of Transportation projects initiated on or after that date that require right-of-way or permanent 31 |
---|
44 | 44 | | easement acquisition. 32 |
