1214 A JOINT RESOLUTION APPLYING TO CONGRESS FOR AN ARTICLE V CONVENTION 1
1315 OF THE STATES WITH THE PURPOSE OF PROPOSING AMENDMENTS TO THE 2
1416 UNITED STATES CONSTITUTION. 3
1517 Whereas, the founders of the United States Constitution empowered state legislators 4
1618 to be guardians against actual or potential abuses of power by the federal government; and 5
1719 Whereas, the federal government has increasingly usurped legitimate roles of the 6
1820 states; and 7
1921 Whereas, the federal government has created a crushing national debt through 8
2022 unsustainable budgeting and spending; and 9
2123 Whereas, it is the solemn duty of the states to protect freedom and opportunity for our 10
2224 citizens, including the generations to come; and 11
2325 Whereas, Article V of the Constitution of the United States authorizes a process to 12
2426 propose amendments to the United States Constitution through a convention of the states to place 13
2527 clear restraints on these and related abuses of power; Now, therefore, 14
2628 Be it resolved by the House of Representatives, the Senate concurring: 15
2729 SECTION 1. The legislature of the State of North Carolina hereby applies to 16
2830 Congress, under the provisions of Article V of the Constitution of the United States, for the 17
2931 calling of a convention of the states limited to proposing amendments to the United States 18
3032 Constitution that impose fiscal restraints on the federal government, limit the power and 19
3133 jurisdiction of the federal government, and limit the terms of office for its officials and for 20
3234 members of Congress. 21
3335 SECTION 2. This application constitutes a continuing application in accordance 22
3436 with Article V of the Constitution of the United States until the legislatures of at least two-thirds 23
3537 of the several states have made applications on the same subject. 24
3638 SECTION 3. The Secretary of State shall transmit copies of this application to the 25
3739 President of the United States, the Secretary of the United States Senate, the Speaker and Clerk 26
3840 of the United States House of Representatives, the members of North Carolina's congressional 27
3941 delegation, and the presiding officers of all state legislatures in the several states requesting their 28
4042 cooperation. 29
4143 SECTION 4. This resolution is effective upon ratification. 30
