1514 AN ACT PROHIBITING COUNTIES AND CITIES FROM ADOPTING OR ENFORCING 2
1615 GUARANTEED INCOME PROGRAMS. 3
1716 The General Assembly of North Carolina enacts: 4
1817 SECTION 1. Article 6 of Chapter 153A of the General Statutes is amended by 5
1918 adding a new section to read: 6
2019 "§ 153A-145.13. Guaranteed income programs prohibited. 7
2120 Unless expressly authorized by general or local law, a county shall not adopt or enforce any 8
2221 ordinance, resolution, or policy that has the purpose or effect of making a payment to an 9
2322 individual under a guaranteed income program. For purposes of this section, the term "guaranteed 10
2423 income program" means a program under which an individual is issued an unconditional cash 11
2524 payment on a regular basis to be used for any purpose by the individual. The term does not 12
2625 include a program under which an individual is required to seek reemployment, perform work, 13
2726 or attend training as a condition of a cash payment." 14
2827 SECTION 2. Article 8 of Chapter 160A of the General Statutes is amended by 15
2928 adding a new section to read: 16
3029 "§ 160A-205.8. Guaranteed income programs prohibited. 17
3130 Unless expressly authorized by general or local law, a city shall not adopt or enforce any 18
3231 ordinance, resolution, or policy that has the purpose or effect of making a payment to an 19
3332 individual under a guaranteed income program. For purposes of this section, the term "guaranteed 20
3433 income program" means a program under which an individual is issued an unconditional cash 21
3534 payment on a regular basis to be used for any purpose by the individual. The term does not 22
3635 include a program under which an individual is required to seek reemployment, perform work, 23
3736 or attend training as a condition of a cash payment." 24
3837 SECTION 3. This act is effective when it becomes law. 25
