Referred to: Commerce and Economic Development, if favorable, State and Local Government, if favorable, Rules, Calendar, and Operations of the House April 10, 2025 *H859 -v-1* A BILL TO BE ENTITLED 1 AN ACT PROHIBITING COUNTIES AND CITIES FROM ADOPTING OR ENFO RCING 2 GUARANTEED INCOME PR OGRAMS. 3 The General Assembly of North Carolina enacts: 4 SECTION 1. Article 6 of Chapter 153A of the General Statutes is amended by 5 adding a new section to read: 6 "§ 153A-145.13. Guaranteed income programs prohibited. 7 Unless expressly authorized by general or local law, a county shall not adopt or enforce any 8 ordinance, resolution, or policy that has the purpose or effect of making a payment to an 9 individual under a guaranteed income program. For purposes of this section, the term "guaranteed 10 income program" means a program under which an individual is issued an unconditional cash 11 payment on a regular basis to be used for any purpose by the individual. The term does not 12 include a program under which an individual is required to seek reemployment, perform work, 13 or attend training as a condition of a cash payment." 14 SECTION 2. Article 8 of Chapter 160A of the General Statutes is amended by 15 adding a new section to read: 16 "§ 160A-205.8. Guaranteed income programs prohibited. 17 Unless expressly authorized by general or local law, a city shall not adopt or enforce any 18 ordinance, resolution, or policy that has the purpose or effect of making a payment to an 19 individual under a guaranteed income program. For purposes of this section, the term "guaranteed 20 income program" means a program under which an individual is issued an unconditional cash 21 payment on a regular basis to be used for any purpose by the individual. The term does not 22 include a program under which an individual is required to seek reemployment, perform work, 23 or attend training as a condition of a cash payment." 24 SECTION 3. This act is effective when it becomes law. 25
