| 19 | 20 | | "§ 122C-256. Capacity restoration pilot programs. 8 |

| 20 | 21 | | (a) Community-Based Capacity Restoration Program. – The Department of Health and 9 |

| 21 | 22 | | Human Services (Department) may contract for three or more community-based capacity 10 |
|---|
| 22 | 23 | | restoration programs (CBCRP). CBCRPs may be county-based or regionally-based. If 11 |
|---|
| 23 | 24 | | regionally-based, a CBCRP shall align with the State-operated psychiatric hospital within closest 12 |
|---|
| 24 | 25 | | proximity. The Department may consult with one or more local management entities/managed 13 |
|---|
| 25 | 26 | | care organizations for the purposes of contracting for CBCRPs under this subsection. 14 |
|---|
| 26 | 27 | | (b) Detention Center Capacity Restoration Program. – The Department, in consultation 15 |
|---|
| 27 | 28 | | and with the consent of relevant sheriffs, may contract for up to three Detention Center Capacity 16 |
|---|
| 28 | 29 | | Restoration Programs (DCCRP). DCCRPs may be county-based or regionally-based, provided 17 |
|---|
| 29 | 30 | | however, that no DCCRP may be regionally-based without the express consent of the sheriff of 18 |
|---|
| 30 | 31 | | every county comprising that prospective DCCRP. A regionally-based DCCRP shall align with 19 |
|---|
| 31 | 32 | | the State-operated psychiatric hospital within closest proximity. The Department may consult 20 |
|---|
| 32 | 33 | | with one or more local management entities/managed care organizations for the purposes of 21 |
|---|
| 33 | 34 | | contracting for DCCRPs under this subsection. 22 |

| 34 | 35 | | (c) Judicial Discretion. – A court may order capacity restoration to be completed at a 23 |
|---|
| 35 | 36 | | CBCRP or DCCRP as an alternative to a State-operated psychiatric hospital for individuals 24 |
|---|
| 36 | 37 | | recommended for participation in CBCRP or DCCRP by a forensic evaluator." 25 |
