PROGRAM AND THE DETE NTION CENTER CAPACIT Y RESTORATION PILOT 3 
PROGRAM. 4 
The General Assembly of North Carolina enacts: 5 
SECTION 1.  Part 6 of Article 5 of Chapter 122C of the General Statutes is amended 6 
by adding a new section to read: 7 
"ยง 122C-256.  Capacity restoration pilot programs. 8 
(a) Community-Based Capacity Restoration Program. โ€“ The Department of Health and 9 
Human Services (Department) may contract for three or more community-based capacity 10 
restoration programs (CBCRP). CBCRPs may be county-based or regionally-based. If 11 
regionally-based, a CBCRP shall align with the State-operated psychiatric hospital within closest 12 
proximity. The Department may consult with one or more local management entities/managed 13 
care organizations for the purposes of contracting for CBCRPs under this subsection. 14 
(b) Detention Center Capacity Restoration Program. โ€“ The Department, in consultation 15 
and with the consent of relevant sheriffs, may contract for up to three Detention Center Capacity 16 
Restoration Programs (DCCRP). DCCRPs may be county-based or regionally-based, provided 17 
however, that no DCCRP may be regionally-based without the express consent of the sheriff of 18 
every county comprising that prospective DCCRP. A regionally-based DCCRP shall align with 19 
the State-operated psychiatric hospital within closest proximity. The Department may consult 20 
with one or more local management entities/managed care organizations for the purposes of 21 
contracting for DCCRPs under this subsection. 22 
(c) Judicial Discretion. โ€“ A court may order capacity restoration to be completed at a 23 
CBCRP or DCCRP as an alternative to a State-operated psychiatric hospital for individuals 24 
recommended for participation in CBCRP or DCCRP by a forensic evaluator." 25 
SECTION 2.  This act is effective when it becomes law. 26
