A concurrent resolution to amend and reenact section 25 of article XI of the Constitution of 
North Dakota, relating to authorizing sports betting.
STATEMENT OF INTENT
This measure would allow the legislative assembly to authorize sports betting to be conducted 
in the state and be licensed and regulated by the state.
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF NORTH DAKOTA, THE 
SENATE CONCURRING THEREIN:
That the following proposed amendment to section 25 of article XI of the Constitution of 
North Dakota is agreed to and must be submitted to the qualified electors of North Dakota at the 
general election to be held in 2026, in accordance with section 16 of article IV of the 
Constitution of North Dakota.
SECTION 1. AMENDMENT. Section 25 of article XI of the Constitution of North Dakota is 
amended and reenacted as follows:
Section 25. The legislative assembly shallmay not authorize any game of chance, lottery, 
or gift enterprises, under any pretense, or for any purpose whatever. However, except the 
legislative assembly shall:
1.Shall authorize the state of North Dakota to join a multi-state lottery for the benefit of 
the state of North Dakota, and, the legislative assembly may.
2.May authorize by law bona fide nonprofit veterans', charitable, educational, religious, 
or fraternal organizations, civic and service clubs, or such other public-spirited 
organizations as it may recognize, to conduct games of chance when the entire net 
proceeds of such games of chance are to be devoted to educational, charitable, 
patriotic, fraternal, religious, or other public-spirited uses.
3.May authorize sports betting on professional and college sports to be conducted in the 
state and licensed and regulated by the state. All tax revenue received from sports

betting must be appropriated for the benefit of kindergarten through grade twelve 
public schools.
