12+A BILL for an Act to amend and reenact section 12-44.1-24 of the North Dakota Century Code,
13+relating to correctional facility standards and the duties of the department of corrections and
14+rehabilitation.for an Act to provide for a legislative management study relating to health care
15+services in local correctional facilities.
16+BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
17+ SECTION 1. AMENDMENT. Section 12-44.1-24 of the North Dakota Century Code is
18+amended and reenacted as follows:
19+ 12-44.1-24. Correctional facility standards - Inspections.
20+ The department of corrections and rehabilitation shall:
21+ 1. Prescribe rules establishing minimum standards for the construction, operation, and
22+maintenance of public or private correctional facilities.
23+ 2. Prescribe rules for the care and treatment of inmates.
24+ 3. Provide instruction to public and private correctional facilities on the correct
25+assessment and billing of medical care costs for medical care and treatment provided
26+to inmates.
27+ 4. Cause rules and regulations to be made available to inmates or be posted in at least
28+one conspicuous place in each correctional facility.
29+ 4.5.Appoint a correctional facility inspector qualified by special experience, education,
30+or training to inspect each correctional facility at least once each year to determine if
31+the rules and regulations have been complied with. Inspection must include health and

8-BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
9-SECTION 1. LEGISLATIVE MANAGEMENT STUDY - HEALTH CARE SERVICES IN LOCAL
10-CORRECTIONAL FACILITIES .
11-1.During the 2025-26 interim, the legislative management shall consider studying health care
12-services in local correctional facilities. The study must include:
13-a.A review of current state and federal requirements of local correctional facilities regarding
14-health care services;

58+SECTION 1. LEGISLATIVE MANAGEMENT STUDY - HEALTH CARE SERVICES IN

60+1.During the 2025-26 interim, the legislative management shall consider studying health

1564 b.A review of health care services funding patterns for local correctional facilities;
16-c.A consideration of the challenges of local health care facilities and providers in serving
17-incarcerated individuals in local correctional facilities;
65+c.A consideration of the challenges of local health care facilities and providers in
66+serving incarcerated individuals in local correctional facilities;
1867 d.An analysis of models of best practices for health care services for incarcerated
1968 individuals in local correctional facilities; and
20-e.A consideration of methods to expand local, state, and federal funding for health care
21-services in local correctional facilities.
22-2.The legislative management shall report its findings and recommendations together with any
