LB 311 changes the definiti on of “Internet-protocol-enabled service” or “IP-enabled service” to include broadband Internet access
service as defined in 47 C.F.R 8.1.
Regulation of broadband Internet access service shall be vested with the Federal Communications Commission. No state agency,
board, or commission or political subdivision shall enact, adopt, or enforce any law, rule, regulation, or ordinance that would impose any
regulation barred under section 86 -124 (1)(d). The provisions of this section shall not affect or modify any authority delegated to the
Public Service Commission or any state agency, including, but not limited to, the Nebraska Broadband Office, to admini ster a federal or
state broadband grant program under a federal or state statut e, rule, or order.
