3555 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3656 SECTION 1. Section 9-15C-1 NMSA 1978 (being Laws 2005,
3757 Chapter 219, Section 1, as amended) is recompiled as Section
3858 12-16-1 NMSA 1978 and is amended to read:
39-"12-16-1. SHORT TITLE.--Chapter 12, Article 16 NMSA
40-1978 may be cited as the "Intertribal Indian Ceremonial
41-Act"."
59+"12-16-1. SHORT TITLE.--[Chapter 9, Article 15C ] Chapter
60+12, Article 16 NMSA 1978 may be cited as the "Intertribal
61+Ceremonial Act"."
4262 SECTION 2. Section 9-15C-2 NMSA 1978 (being Laws 2005,
43-Chapter 219, Section 2, as amended) is recompiled as Section
44-12-16-2 NMSA 1978 and is amended to read:
45-"12-16-2. DEFINITIONS.--As used in the Intertribal
46-Indian Ceremonial Act:
47-A. "association" means the intertribal Indian
48-ceremonial association;

91-B. The county shall appoint a director, who shall

93-and terminate other necessary employees, who shall be subject
94-to the provisions of the Personnel Act.

192-FUND CREATED--ADMINISTRATION.--The "intertribal Indian
193-ceremonial association fund" is created in the state
194-treasury. Money appropriated to the fund or accruing to it
195-through sales, gifts, grants, fees, penalties, bequests or
196-any other source shall be delivered to the state treasurer
197-and deposited in the fund. Money in the fund is

235-SECTION 5. TEMPORARY PROVISION--INTERTRIBAL INDIAN
236-CEREMONIAL ASSOCIATION BOARD MEMBERS.--The terms of office of
237-the members serving on the intertribal Indian ceremonial
238-association board on the effective date of this act shall end
239-on July 1, 2023, and new members shall be appointed for a
240-term of office that shall begin on July 2, 2023 according to
241-the provisions of Section 12-16-3 NMSA 1978.

250+"12-16-4. INTERTRIBAL CEREMONIAL FUND CREATED--
251+ADMINISTRATION.--The "intertribal ceremonial fund" is created
252+in the state treasury. Money appropriated to the fund or
253+accruing to it through sales, gifts, grants, fees, penalties,
254+bequests or any other source shall be delivered to the state
255+treasurer and deposited in the fund. Money in the fund is
256+appropriated to the [office ] local government division of the

265+SECTION 5. TEMPORARY PROVISION--INTERTRIBAL CEREMONIAL

267+the intertribal ceremonial board on the effective date of this
268+act shall end on July 1, 2023, and new members shall be
269+appointed for a term of office that shall begin on July 1, 2023
270+according to the provisions of Section 12-16-3 NMSA 1978.
242271 SECTION 6. TEMPORARY PROVISION--TRANSFER OF FUNCTIONS,
243272 PERSONNEL, MONEY, APPROPRIATIONS, PROPERTY, CONTRACTUAL
244273 OBLIGATIONS AND STATUTORY REFERENCES.--
245-A. On the effective date of this act, all
246-functions, personnel, money, appropriations, records,
247-furniture, equipment, supplies and other property of the
248-intertribal ceremonial office of the tourism department are
249-transferred to the local government division of the
250-department of finance and administration.
251-B. On the effective date of this act, all
252-contractual obligations of the intertribal ceremonial office
253-of the tourism department are binding on the local government
254-division of the department of finance and administration.
255-C. On the effective date of this act, all
256-references in law to the intertribal ceremonial office of the
257-tourism department shall be deemed to be references to the HB 161/a
