4949 RELATING TO THE ENVIRONMENT; REPEALING PROVISIONS OF LAW

5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. Section 74-1-3 NMSA 1978 (being Laws 1971,
5656 Chapter 277, Section 3, as amended) is amended to read:
5757 "74-1-3. DEFINITIONS.--As used in the Environmental
5858 Improvement Act:
5959 A. "board" means the environmental improvement
6060 board;
6161 [B. "carbon intensity" means the quantity of fuel
6262 lifecycle greenhouse gas emissions per unit of fuel energy,

9393 [D. "fuel lifecycle" means an assessment of the
9494 aggregate greenhouse gas emissions based on science-based
9595 models or protocols, including direct emissions and significant
9696 indirect emissions from indirect land use change, all stages of
9797 fuel and feedstock production and distribution, feedstock
9898 generation or extraction through the distribution, delivery and
9999 use of the finished fuel by the consumer, including
100100 consideration of storage, transportation and combustion;
101101 E.] C. "on-site liquid waste system" means a liquid
102102 waste system, or part thereof, serving a dwelling,
103103 establishment or group, and using a liquid waste treatment unit
104104 designed to receive liquid waste followed by either a soil
105105 treatment or other type of disposal system. "On-site liquid
106106 waste system" includes holding tanks and privies but does not
107107 include systems or facilities designed to receive or treat mine
108108 or mill tailings or wastes;
109109 [F.] D. "person" means the state or any agency,
110110 institution or political subdivision thereof, any public or
111111 private corporation, individual, partnership, association or
112112 other entity and includes any officer or governing or managing
113113 body of any political subdivision or public or private
114114 corporation;

144144 means an on-site liquid waste system serving up to four
145145 dwelling units; and
146146 [H.] F. "secretary" means the secretary of
147147 environment [and
148148 I. "transportation fuel" means electricity or a
149149 liquid, gaseous or blended fuel, including gasoline, diesel,
150150 liquefied petroleum gas, natural gas and hydrogen, sold,
151151 supplied, used or offered for sale to power vehicles or
152152 equipment for the purposes of transportation ]."
153153 SECTION 2. Section 74-1-7 NMSA 1978 (being Laws 1971,
154154 Chapter 277, Section 10, as amended) is amended to read:
155155 "74-1-7. DEPARTMENT--DUTIES.--
156156 A. The department is responsible for environmental
157157 management and consumer protection programs. In that respect,
158158 the department shall maintain, develop and enforce rules and
159159 standards in the following areas:
160160 (1) food protection;
161161 (2) water supply, including implementing a
162162 capacity development program to assist water systems in
163163 acquiring and maintaining technical, managerial and financial
164164 capacity in accordance with Section 1420 of the federal Safe
165165 Drinking Water Act of 1974 and establishing administrative
166166 penalties for enforcement;
167167 (3) liquid waste, including exclusive

203203 (5) radiation control and collection of
204204 license, registration and other related fees as provided in the
205205 Radiation Protection Act;
206206 (6) noise control;
207207 (7) nuisance abatement;
208208 (8) vector control;
209209 (9) occupational health and safety as provided
210210 in the Occupational Health and Safety Act;
211211 (10) sanitation of public swimming pools and
212212 public baths;
213213 (11) plumbing, drainage, ventilation and
214214 sanitation of public buildings in the interest of public
215215 health;
216216 (12) medical radiation, health and safety
217217 certification and standards for radiologic technologists as
218218 provided in the Medical Imaging and Radiation Therapy Health
219219 and Safety Act;
220220 (13) hazardous wastes and underground storage

255255 B. Nothing in Subsection A of this section imposes
256256 requirements for the approval of subdivision plats in addition
257257 to those required elsewhere by law. Nothing in Subsection A of
258258 this section preempts the authority of any political
259259 subdivision to approve subdivision plats."
260260 SECTION 3. Section 74-1-8 NMSA 1978 (being Laws 1971,
261261 Chapter 277, Section 11, as amended) is amended to read:

318318 in the Occupational Health and Safety Act;

362362 B. Nothing in Subsection A of this section imposes
363363 requirements for the approval of subdivision plats in addition
364364 to those required elsewhere by law. Nothing in Subsection A of
365365 this section preempts the authority of any political
366366 subdivision to approve subdivision plats.
367367 C. Administrative penalties collected pursuant to
368368 Paragraph (2) of Subsection A of this section shall be
369369 deposited in the water conservation fund.
370370 D. On-site liquid waste system fees shall be
371371 deposited in the environmental health fund.
372372 E. Radiation license and registration and other
373373 related fees shall be deposited in the radiation protection
374374 fund."
375375 SECTION 4. A new section of the Environmental Improvement
376376 Act is enacted to read:
377377 "[NEW MATERIAL] RULES FOR CLEAN TRANSPORTATION FUEL
378378 STANDARD PROHIBITED.--The board shall not adopt or continue in
379379 effect a rule providing for a clean transportation fuel
