5050 RELATING TO MOTOR VEHICLES; AUTHORIZING LOCAL AND COUNTY
5151 ELECTED AUTHORITIES TO ALLOW OFF-HIGHWAY MOTOR VEHICLES TO
5252 OPERATE ON PAVED STREETS AND HIGHWAYS WITHIN THE POLITICAL
5353 BOUNDARIES OF THE AUTHORIZING ENTITY.
5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. Section 66-3-1011 NMSA 1978 (being Laws 1975,
5656 Chapter 240, Section 11, as amended) is amended to read:
5757 "66-3-1011. OPERATION ON STREETS OR HIGHWAYS--PROHIBITED
5858 AREAS.--
5959 A. A person shall not operate an off-highway motor
6060 vehicle on any:
6161 (1) limited access highway or freeway at any
6262 time; or
6363 (2) paved street or highway except as provided

9292 B. Off-highway motor vehicles may cross streets or
9393 highways, except limited access highways or freeways, if the
9494 crossings are made after coming to a complete stop prior to
9595 entering the roadway. Off-highway motor vehicles shall yield
9696 the right of way to oncoming traffic and shall begin a crossing
9797 only when it can be executed safely and then cross in the most
9898 direct manner as close to a perpendicular angle as possible.
9999 C. If authorized by ordinance or resolution of a
100100 local or county elected authority, [or the state transportation
101101 commission] a recreational off-highway vehicle or an all-
102102 terrain vehicle may be operated on a paved street or highway
103103 [owned and controlled by ] within the political boundaries of
104104 the authorizing entity if:
105105 (1) the vehicle has one or more headlights and
106106 one or more taillights that comply with the Off-Highway Motor
107107 Vehicle Act;
108108 (2) the vehicle has brakes, mirrors and
109109 mufflers;
110110 (3) the operator has valid driver's licenses
111111 or permits as required under the Motor Vehicle Code and off-
112112 highway motor vehicle safety permits as required under the Off-
113113 Highway Motor Vehicle Act;
114114 (4) the operator is insured in compliance with
115115 the provisions of the Mandatory Financial Responsibility Act;

144144 (5) the operator of the vehicle is using eye
145145 protection that complies with the Off-Highway Motor Vehicle
146146 Act; and
147147 (6) if the operator is under eighteen years of
148148 age, the operator is wearing a safety helmet that complies with
149149 the Off-Highway Motor Vehicle Act.
150150 D. Except for sections of the Motor Vehicle Code
151151 that are in conflict with the licensing and equipment
152152 requirements of the Off-Highway Motor Vehicle Act, any operator
153153 using an off-highway motor vehicle on a paved street or highway
154154 shall be subject to the requirements and penalties for
155155 operators of moving and parked vehicles under the Motor Vehicle
156156 Code.
157157 E. By ordinance or resolution, a local [authority
158158 or state transportation commission ] or county elected authority
159159 may establish separate speed limits and operating restrictions
160160 for off-highway vehicles where they are authorized to operate
161161 on paved streets or highways pursuant to Subsection C of this
162162 section.
163163 F. A person shall not operate an off-highway motor
164164 vehicle on state game commission-owned, -controlled or
165165 -administered land except as specifically allowed pursuant to
166166 Chapter 17, Article 6 NMSA 1978.
167167 G. A person shall not operate an off-highway motor
168168 vehicle on land owned, controlled or administered by the state

201201 H. Unless authorized, a person shall not:
202202 (1) remove, deface or destroy any official
203203 sign installed by a state, federal, local or private land
204204 management agency; or
205205 (2) install any off-highway motor vehicle-
