49	49	RELATING TO CRIME; CREATING THE CRIME OF UNLAWFUL POSSESSION OF
50	50	A WEAPON CONVERSION DEVICE; PROVIDING A PENALTY.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. A new section of Chapter 30, Article 7 NMSA
53	53	1978 is enacted to read:
54	54	"[NEW MATERIAL] UNLAWFUL POSSESSION OF A WEAPON CONVERSION
55	55	DEVICE--PENALTY.--
56	56	A. Unlawful possession of a weapon conversion
57	57	device consists of a person knowingly having in that person's
58	58	possession a weapon conversion device or knowingly transporting
59	59	a weapon conversion device.
60	60	B. Each weapon conversion device found in violation
61	61	of this section constitutes a separate offense.
62	62	C. A person who commits unlawful possession of a

90	90	weapon conversion device is guilty of a third degree felony.
91	91	D. As used in this section:
92	92	(1) "fully automatic weapon" means a weapon
93	93	that shoots, is designed to shoot or can be readily restored to
94	94	shoot more than one shot, without manual reloading, by a single
95	95	and continuous held pull of the trigger;
96	96	(2) "semiautomatic weapon" means a repeating
97	97	rifle, shotgun or pistol, regardless of barrel or overall
98	98	length, that uses a portion of the energy of a firing cartridge
99	99	or shell to extract the fired cartridge case or spent shell and
100	100	chamber the next round and that requires a separate pull of the
101	101	trigger to fire each cartridge or shell; and
102	102	(3) "weapon conversion device" means a part or
103	103	combination of parts designed and intended to convert a
104	104	semiautomatic weapon into a fully automatic weapon."
