3333 PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO BY ADDING A
3434 NEW SECTION OF ARTICLE 2 THAT PROVIDES THE PEOPLE OF THE STATE
3535 WITH ENVIRONMENTAL RIGHTS, INCLUDING THE RIGHT TO CLEAN AND
3636 HEALTHY AIR, WATER, SOIL AND ENVIRONMENTS, HEALTHY NATIVE
3737 FLORA, FAUNA AND ECOSYSTEMS, A SAFE CLIMATE AND THE
3838 PRESERVATION OF THE NATURAL, CULTURAL, SCENIC AND HEALTHFUL
3939 QUALITIES OF THE ENVIRONMENT, AND DIRECTS THE STATE, COUNTIES
4040 AND MUNICIPALITIES TO SERVE AS TRUSTEES OF THE NATURAL
4141 RESOURCES OF NEW MEXICO FOR THE BENEFIT OF ALL THE PEOPLE.
4242 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4343 SECTION 1. It is proposed to amend Article 2 of the
4444 constitution of New Mexico by adding a new section to read:
4545 "A. The people of the state shall have a right to
4646 clean and healthy air, water, soil and environments; healthy

7474 native flora, fauna and ecosystems; a safe climate; and the
7575 preservation of the natural, cultural, scenic and healthful
7676 qualities of the environment. The state shall protect these
7777 rights equitably for all people regardless of race, ethnicity,
7878 tribal affiliation, gender, socioeconomics or geography.
7979 B. The state, counties and municipalities shall
8080 serve as trustees of the natural resources of New Mexico and
8181 shall conserve, protect and maintain these resources for the
8282 benefit of all the people, including present and future
8383 generations.
8484 C. The provisions of this section are self-
8585 executing. Monetary damages shall not be awarded for a
8686 violation of this section. This section is enforceable against
8787 the state, counties and municipalities."
8888 SECTION 2. The amendment proposed by this resolution
8989 shall be submitted to the people for their approval or
9090 rejection at the next general election or at any special
9191 election prior to that date that may be called for that
9292 purpose.
