33	33	PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO BY ADDING A
34	34	NEW SECTION OF ARTICLE 2 THAT PROVIDES THE PEOPLE OF THE STATE
35	35	WITH ENVIRONMENTAL RIGHTS, INCLUDING THE RIGHT TO CLEAN AND
36	36	HEALTHY AIR, WATER, SOIL AND ENVIRONMENTS, HEALTHY NATIVE
37	37	FLORA, FAUNA AND ECOSYSTEMS, A SAFE CLIMATE AND THE
38	38	PRESERVATION OF THE NATURAL, CULTURAL, SCENIC AND HEALTHFUL
39	39	QUALITIES OF THE ENVIRONMENT, AND DIRECTS THE STATE, COUNTIES
40	40	AND MUNICIPALITIES TO SERVE AS TRUSTEES OF THE NATURAL
41	41	RESOURCES OF NEW MEXICO FOR THE BENEFIT OF ALL THE PEOPLE.
42	42	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
43	43	SECTION 1. It is proposed to amend Article 2 of the
44	44	constitution of New Mexico by adding a new section to read:
45	45	"A. The people of the state shall have a right to
46	46	clean and healthy air, water, soil and environments; healthy

74	74	native flora, fauna and ecosystems; a safe climate; and the
75	75	preservation of the natural, cultural, scenic and healthful
76	76	qualities of the environment. The state shall protect these
77	77	rights equitably for all people regardless of race, ethnicity,
78	78	tribal affiliation, gender, socioeconomics or geography.
79	79	B. The state, counties and municipalities shall
80	80	serve as trustees of the natural resources of New Mexico and
81	81	shall conserve, protect and maintain these resources for the
82	82	benefit of all the people, including present and future
83	83	generations.
84	84	C. The provisions of this section are self-
85	85	executing. Monetary damages shall not be awarded for a
86	86	violation of this section. This section is enforceable against
87	87	the state, counties and municipalities."
88	88	SECTION 2. The amendment proposed by this resolution
89	89	shall be submitted to the people for their approval or
90	90	rejection at the next general election or at any special
91	91	election prior to that date that may be called for that
92	92	purpose.
