9090 A. The legislature finds that:
9191 (1) isolated people, the elderly, the young
9292 and victims of crime are often at risk and without help;
9393 (2) children, elderly persons and victims of
9494 crime are frequently unable to explain directions to the
9595 location of an emergency situation;
9696 (3) life-threatening accidents, fires, crimes
9797 and natural disasters occur in the state each year;
9898 (4) [an enhanced] a 911 telephone emergency
9999 system provides:
100100 (a) expansion of the benefits of the
101101 basic 911 emergency telephone number;
102102 (b) faster response time, which
103103 minimizes the loss of life and property;
104104 (c) automatic routing to the appropriate
105105 emergency response unit;
106106 (d) immediate visual display of the
107107 location and telephone number of the caller; [and ]
108108 (e) curtailment of abuses of the
109109 emergency system by documenting callers; and
110110 (f) enhanced capabilities through next
111111 generation 911, including: 1) the ability to process emergency
112112 communications through voice, text, video and data, increasing
113113 accessibility for all residents; 2) improved accuracy and
114114 efficiency in emergency response due to advanced geographic

149149 B. It is the purpose of the [Enhanced ] 911 Act to
150150 further the public interest and protect the safety, health and
151151 welfare of the people of New Mexico by enabling the
152152 development, installation and operation of [enhanced ] 911
153153 emergency reporting systems, including next generation 911 and
154154 advancing 911 technologies , to be operated under shared state
155155 and local governmental management and control."
156156 SECTION 3. Section 63-9D-3 NMSA 1978 (being Laws 1989,

158158 "63-9D-3. DEFINITIONS.--As used in the [Enhanced ] 911

160160 A. "911 call" means any real-time communication,
161161 message, signal or transmission between a person needing

208208 D. "911 surcharge" means the monthly charge and
209209 prepaid wireless surcharge assessed on each access line in the
210210 state, on each active number for a commercial mobile radio
211211 service subscriber and on the number of voice-over-internet
212212 protocol lines for which the voice-over-internet protocol
213213 service provider enables the capacity for simultaneous calls,
214214 regardless of actual usage, to be connected to the public
215215 switched telephone network during the period for which the
216216 fixed charge is imposed for a voice-over-internet protocol
217217 service subscriber in New Mexico and the charge assessed on any
218218 other consumer purchase of communication service provided by a
219219 communications service provider that enables communication
220220 between a person needing assistance and a public safety

252252 E. "911 system" means an integrated system or
253253 database that manages emergency calls and dispatches resources,

255255 receiving, processing and responding to 911 calls and
256256 coordinating field responders;
257257 [C.] F. "access line" means a telecommunications
258258 company's line that has the capability to reach local public
259259 safety agencies by dialing 911, but does not include a line
260260 used for the provision of interexchange services or commercial
261261 mobile radio service;
262262 [D.] G. "commercial mobile radio service" means
263263 service provided by a wireless real-time two-way voice
264264 communication device, including:
265265 (1) radio-telephone communications used in
266266 cellular telephone service;
267267 (2) the functional or competitive equivalent
268268 of radio-telephone communications used in cellular telephone
269269 service;
270270 (3) a personal communications service; or
271271 (4) a network radio access line;
272272 [E.] H. "commercial mobile radio service provider"
273273 means a person who provides commercial mobile radio services,

306306 [G.] J. "communication service" means [any ] a

310310 system by directly dialing, initializing or otherwise
311311 activating the [enhanced ] 911 system regardless of the
312312 transmission medium or technology employed; and
313313 (2) provides or enables real-time or
314314 interactive communication;
315315 [H.] K. "communications service provider" means any
316316 entity that provides communication services;
317317 [I.] L. "database" means information that is
318318 collected, formatted and disseminated and that is necessary for
319319 the functioning of the [enhanced ] 911 system, including
320320 geographic information system [(GIS) ] addressing and digital
321321 mapping information;
322322 [J.] M. "department" means the taxation and revenue
323323 department;
324324 [K.] N. "division" means the local government
325325 division of the department of finance and administration;
326326 [L. "enhanced 911 surcharge" means the monthly

366366 dialing 9-1-1 or its equivalent; provided that an enhanced 911
367367 surcharge shall not be assessed on the provision of broadband
368368 internet access service;
369369 M. "enhanced 911 system" means regardless of the
370370 technology used, a landline, wireless, NG-911 or ESInet system
371371 consisting of network switching equipment, database, mapping
372372 and on-premises equipment, or the functional equivalent
373373 thereof, that uses the single three-digit number 911 for
374374 reporting police, fire, medical or other emergency situations,
375375 thereby enabling a caller to reach a public safety answering
376376 point to report emergencies by dialing 911, and includes the
377377 capability to:
378378 (1) selectively route incoming 911 calls to
379379 the appropriate public safety answering point operating in a

423423 (5) manage or administer the functions listed
424424 in Paragraphs (1) through (4) of this subsection;
425425 N. "enhanced 911 equipment" means the public safety
426426 answering point equipment directly related to the operation of
427427 an enhanced 911 system, including automatic number
428428 identification or automatic location identification controllers
429429 and display units, printers, logging recorders and software
430430 associated with call detail recording, call center work
431431 stations, training, latitude and longitude base station or cell
432432 site location data, and GIS equipment necessary to obtain and

471471 [P. "ESInet" means "emergency services internet
472472 protocol network", an internet-protocol-based, multipurpose
473473 inter-network supporting local, regional, state and national
474474 public safety communications services in addition to 911; ]
475475 Q. "fiscal agent" means the local governing body
476476 that administers grants from the fund for a given locality or
477477 region by agreement;
478478 R. "fund" means the [enhanced ] 911 emergency
479479 service fund;
480480 S. "local governing body" means the board of county
481481 commissioners of a county or the governing body of a
482482 municipality [as defined in the Municipal Code ];
483483 T. ["NG-911"] "next generation 911" means a ["next
484484 generation 911"] system consisting of network, hardware,

537537 four-hour local communications facility that receives 911

577577 communication services at retail from a communications service
578578 provider that are capable of originating a 911 communication;
579579 [X.] Y. "surcharge" means the 911 emergency
580580 surcharge;
581581 [Y.] Z. "surcharge collected" means the amount of
582582 enhanced 911 surcharge billed or received or deemed to have
583583 been received by the seller or provider, consistent with the
584584 seller's or provider's method of accounting, including accrual
585585 or cash;
586586 [Z.] AA. "telecommunications company" means a
587587 person [who] that provides [wire] telecommunications services
588588 that are capable of originating a 911 communication;
589589 [AA.] BB. "vendor" means a person that provides 911
590590 equipment, service or network support;

634634 that provides interconnected voice-over-internet protocol
635635 service to end users."
636636 SECTION 4. Section 63-9D-4 NMSA 1978 (being Laws 1989,
637637 Chapter 25, Section 4, as amended) is amended to read:
638638 "63-9D-4. PROVISION FOR [ENHANCED ] 911 SERVICES BY LOCAL
639639 GOVERNING BODIES--[ENHANCED ] 911 SYSTEM COSTS--PAYMENT OF
640640 COSTS--JOINT POWERS AGREEMENTS--AID OUTSIDE JURISDICTIONAL
641641 BOUNDARIES.--
642642 A. A local governing body, [or ] a consortium of
643643 local governing bodies or a primary or secondary public safety
644644 answering point may incur costs for the purchase, lease,

674674 training necessary for the establishment of [an enhanced ] a 911

676676 fund; provided that the local governing body, primary or
677677 secondary public safety answering point has employed properly
678678 trained staff in its public safety answering point pursuant to
679679 the Public Safety Telecommunicator Training Act.
680680 B. If the [enhanced] 911 system is to be provided
681681 for territory that is included in whole or in part in the
682682 jurisdiction of the local governing bodies of two or more
683683 public agencies that are the primary providers of emergency
684684 firefighting, law enforcement, ambulance, emergency medical or
685685 other emergency services, the agreement for the procurement of
686686 the [enhanced] 911 system shall be entered into by the fiscal
687687 agent designated by the local governing bodies. A local
688688 governing body may expressly exclude itself from the agreement.
689689 Nothing in this subsection shall be construed to prevent two or
690690 more local governing bodies from entering into a joint powers
691691 agreement pursuant to the Joint Powers Agreements Act to
692692 establish a separate legal entity that can enter into an
693693 agreement as the [enhanced ] 911 system customer.
694694 C. A public agency in [an enhanced ] a 911 emergency
695695 service area shall provide that once an emergency unit is
696696 dispatched in response to a request for aid through the
697697 [enhanced] 911 system, the emergency unit shall render services

733733 SECTION 5. Section 63-9D-5 NMSA 1978 (being Laws 1989,
734734 Chapter 25, Section 5, as amended) is amended to read:
735735 "63-9D-5. IMPOSITION OF SURCHARGE.--
736736 A. [There is imposed ] A 911 emergency surcharge is
737737 imposed in the amount of [fifty-one cents ($.51) ] one dollar
738738 fifty cents ($1.50) to be billed to each subscriber access line
739739 by a communications service provider, on each active number for
740740 a commercial mobile radio service subscriber and on the number
741741 of [VoIP] voice-over-internet protocol lines for which the
742742 [VoIP] voice-over-internet protocol service provider enables
743743 the capacity for simultaneous calls, regardless of actual
744744 usage, to be connected to the public switched telephone network
745745 during the period for which the fixed charge is imposed. The
746746 surcharge is imposed on all subscribers whose place of primary
747747 use, as defined in the federal Mobile Telecommunications
748748 Sourcing Act, is in New Mexico; provided, however, that the
749749 surcharge shall not be imposed upon subscribers receiving
750750 reduced rates pursuant to the Low Income Telephone Service

780780 not apply to prepaid wireless communication service; and
781781 provided further that a 911 emergency surcharge shall not be
782782 assessed on the provision of broadband internet access service.
783783 B. [All] A communications service [providers ]
784784 provider shall [be required to ] bill and collect the surcharge
785785 from [their] subscribers whose places of primary use, as
786786 defined in the federal Mobile Telecommunications Sourcing Act,
787787 are in New Mexico. The surcharge required to be collected by
788788 the communications service provider shall be added to and
789789 stated clearly and separately in the billings to the
790790 subscriber. The surcharge collected by the communications
791791 service provider shall not be considered revenue of the
792792 communications service provider.
793793 C. A billed subscriber is liable for payment of the
794794 911 emergency surcharge until it has been paid to the
795795 communications service provider.
796796 D. A communications service provider has no
797797 obligation to take legal action to enforce the collection of
798798 the surcharge; an action may be brought by or on behalf of the
799799 department. A communications service provider, upon request
800800 and not more than once a year, shall provide to the department
801801 a list of the surcharge amounts uncollected, along with the
802802 names and addresses of subscribers who carry a balance that can
803803 be determined by the communications service provider to be

835835 SECTION 6. Section 63-9D-5.1 NMSA 1978 (being Laws 2017,
836836 Chapter 122, Section 10) is amended to read:

838838 COLLECTION AND ADMINISTRATION OF SURCHARGE--LIABILITY OF
839839 SELLERS--EXCLUSIVITY OF SURCHARGE.--
840840 A. As used in this section:
841841 (1) "consumer" means a person who purchases
842842 prepaid wireless communication service in a retail transaction;
843843 (2) "prepaid wireless communication service"
844844 means a wireless communication service that allows [a caller ]
845845 the user to [dial] make 911 [to access the 911 system ] calls;
846846 [which service must be ] is paid for in advance; [and ] is sold
847847 in predetermined units of time or dollars [of which the number
848848 declines with use in a known amount ] that decline with use in a
849849 known amount or provides unlimited use of the service for a
850850 fixed amount of time; and allows a user to access 911 emergency
851851 service;
852852 (3) "prepaid wireless [enhanced ] 911
853853 surcharge" means the charge that is required to be collected by
854854 a seller from a consumer in the amount established [under ]
855855 pursuant to Subsection B of this section;
856856 (4) "provider" means a person that provides

886886 issued by the federal communications commission;
887887 (5) "retail transaction" means the purchase of
888888 prepaid wireless communication service from a seller for any
889889 purpose other than resale;
890890 (6) "seller" means a person who sells prepaid
891891 wireless communication service to another person; and
892892 (7) "wireless communication service" means
893893 [commercial mobile radio service as defined by Section 20.3 of
894894 Title 47 of the Code of Federal Regulations, as amended ] a
895895 mobile service that is:
896896 (a) provided with the intent of
897897 receiving compensation or monetary gain;
898898 (b) an interconnected service; and
899899 (c) available to the public .
900900 B. A prepaid wireless [enhanced ] 911 surcharge of
901901 one and thirty-eight hundredths percent is imposed on the gross
902902 value of each retail transaction. The prepaid wireless
903903 [enhanced] 911 surcharge shall be collected by the seller from
904904 the consumer with respect to each retail transaction occurring
905905 in [this] the state. The amount of the prepaid wireless
906906 [enhanced] 911 surcharge shall be either separately stated on
907907 an invoice, receipt or other similar document that is provided
908908 to the consumer by the seller, or otherwise disclosed to the
909909 consumer.

938938 C. For purposes of Subsection B of this section, a
939939 retail transaction that is effected in person by a consumer at
940940 a business location of the seller shall be treated as occurring
941941 in this state if that business location is in this state, and
942942 any other retail transaction shall be treated as occurring in
943943 this state if the retail transaction is treated as occurring in
944944 this state for purposes of the Gross Receipts and Compensating
945945 Tax Act.
946946 D. The prepaid wireless [enhanced ] 911 surcharge is
947947 the liability of the consumer and not of the seller or of any
948948 provider, except that the seller shall be liable to remit all
949949 prepaid wireless [enhanced ] 911 surcharges that the seller
950950 collects from consumers as provided in this section, including
951951 all such surcharges that the seller is deemed to collect where
952952 the amount of the surcharge has not been separately stated on
953953 an invoice, receipt or other similar document provided to the
954954 consumer by the seller.
955955 E. The amount of the prepaid wireless [enhanced ]
956956 911 surcharge that is collected by a seller from a consumer, if
957957 such amount is separately stated on an invoice, receipt or
958958 other similar document provided to the consumer by the seller,
959959 shall not be included in the base for measuring any tax, fee,
960960 surcharge or other charge that is imposed by this state, any
961961 political subdivision of this state or any intergovernmental
962962 agency.

992992 sold with one or more other products or services for a single,
993993 non-itemized price, the percentage specified in Subsection B of
994994 this section shall apply to the entire non-itemized price
995995 unless the seller elects to apply such percentage to:
996996 (1) if the amount of the prepaid wireless
997997 communication service is disclosed to the consumer as a dollar
998998 amount, such dollar amount; or
999999 (2) if the seller can identify the portion of
10001000 the price that is attributable to the prepaid wireless
10011001 communication service by reasonable and verifiable standards
10021002 from its books and records that are kept in the regular course
10031003 of business for other purposes, including non-tax purposes,
10041004 such portion.
10051005 G. However, if a minimal amount of prepaid wireless
10061006 communication service is sold with a prepaid wireless device
10071007 for a single, non-itemized price, the seller may elect not to
10081008 apply the percentage specified in Subsection B of this section
10091009 to such transaction. For purposes of this subsection, an
10101010 amount of service denominated as ten minutes or less, or five
10111011 dollars ($5.00) or less, is minimal.
10121012 H. Prepaid wireless [enhanced ] 911 surcharges
10131013 collected by sellers shall be remitted to the department at the
10141014 times and in the manner provided with respect to the Gross
10151015 Receipts and Compensating Tax Act. The department shall

10501050 I. The audit and appeal procedures applicable to
10511051 the Gross Receipts and Compensating Tax Act shall apply to
10521052 prepaid wireless [enhanced ] 911 surcharges.
10531053 J. The department shall establish procedures by
10541054 which a seller of prepaid wireless communication services may
10551055 document that a sale is not a retail transaction, which
10561056 procedures shall substantially coincide with the procedures for
10571057 documenting sale for resale transactions for the Gross Receipts
10581058 and Compensating Tax Act.
10591059 K. No provider or seller of prepaid wireless
10601060 communication services shall be liable for damages to any
10611061 person resulting from or incurred in connection with the
10621062 provision of or failure to provide 911 or [enhanced 911
10631063 service] next generation 911 services or for identifying or
10641064 failing to identify the telephone number, address, location or
10651065 name associated with any person or device that is accessing or
10661066 attempting to access 911 or [enhanced 911 service ] next
10671067 generation 911 services .
10681068 L. No provider or seller of prepaid wireless

11031103 or other law enforcement activity by such law enforcement

11051105 M. In addition to the protection from liability
11061106 provided by Subsections K and L of this section, each provider
11071107 and seller [shall be] is entitled to the further protection
11081108 from liability as provided pursuant to Section 63-9D-10 NMSA
11091109 1978.
11101110 N. The prepaid wireless [enhanced ] 911 surcharge
11111111 applies to retail transactions occurring on or after July 1,
11121112 2017."
11131113 SECTION 7. Section 63-9D-7 NMSA 1978 (being Laws 1989,
11141114 Chapter 25, Section 7, as amended) is amended to read:
11151115 "63-9D-7. REMITTANCE OF CHARGES--ADMINISTRATIVE FEE.--
11161116 A. The surcharge collected shall be remitted
11171117 monthly to the department, which shall administer and enforce
11181118 collection of the surcharge in accordance with the Tax
11191119 Administration Act. The surcharge shall be remitted to the
11201120 department no later than the twenty-fifth day of the month

11571157 surcharge collected pursuant to the [Enhanced ] 911 Act. The
11581158 record shall be maintained for a period of three years after
11591159 the time the surcharges were collected.
11601160 B. From a remittance to the department made on or
11611161 before the date it becomes due, a telecommunications company or
11621162 commercial mobile radio service provider required to make a
11631163 remittance shall be entitled to deduct and retain one percent
11641164 of the collected amount or fifty dollars ($50.00), whichever is
11651165 greater, as the administrative cost for collecting the
11661166 surcharge."
11671167 SECTION 8. Section 63-9D-8 NMSA 1978 (being Laws 1989,
11681168 Chapter 25, Section 8, as amended) is amended to read:

12091209 the general fund.
12101210 D. Payments shall be made from the fund to, or on
12111211 behalf of, participating local governing bodies, primary or
12121212 secondary public safety answering points or their fiscal agents
12131213 upon vouchers signed by the director of the division solely for
12141214 the purpose of reimbursing local governing bodies, primary or
12151215 secondary public safety answering points or their fiscal agents
12161216 and communications service providers for their costs of
12171217 providing [enhanced] 911 [service] emergency services,
12181218 including next generation 911 equipment and infrastructure . A
12191219 person who purchases communication services from a
12201220 communications service provider [for the purpose of reselling
12211221 that service] to resell is not eligible for reimbursement from
12221222 the fund. Money in the fund may be used for the payment of
12231223 bonds issued pursuant to the [Enhanced ] 911 Bond Act.
12241224 E. Annually, the division may expend no more than
12251225 five percent of all money deposited annually in the fund for
12261226 administering and coordinating activities associated with
12271227 implementation of the [Enhanced ] 911 Act, including next

12591259 equipment upon application of local governing bodies, primary
12601260 or secondary public safety answering points or their fiscal
12611261 agents to the division and upon approval by the state board of
12621262 finance. If it is anticipated that the [funds ] money available
12631263 to pay all requests for grants will be insufficient, the state
12641264 board of finance may reduce the percentage of assistance to be
12651265 awarded. In the event of such reduction, the state board of
12661266 finance may award supplemental grants to local governing bodies
12671267 that demonstrate financial hardship.
12681268 G. After requesting [enhanced ] 911 [service]
12691269 services from a communications service provider, a local
12701270 governing body may, by ordinance or resolution, recover from
12711271 the fund an amount necessary to recover the costs of providing
12721272 the [enhanced] 911 system in its designated 911 service area.
12731273 The division, on behalf of local governing bodies, shall
12741274 directly pay or reimburse communications service providers for
12751275 their costs of providing [enhanced ] 911 [service] services. If
12761276 a communications service provider does not receive payment or
12771277 reimbursement for the costs of providing [enhanced ] 911
12781278 [service] services, the provider is not obligated to provide
12791279 [that service] those services.

14261426 number may be furnished to the [enhanced ] 911 system for call
14271427 routing or for automatic retrieval of location information in

14371437 permission of the submitting provider except that information
14381438 may be released or published as aggregated data that does not

15851585 SECTION 15. Section 63-9D-15 NMSA 1978 (being Laws 1990,
15861586 Chapter 61, Section 4) is amended to read:
15871587 "63-9D-15. USE OF PROCEEDS OF BOND ISSUE.--It is unlawful
15881588 to divert, use or expend any money received from the issuance
15891589 of [enhanced] 911 bonds for any purpose other than the purposes
15901590 for which the bonds were issued."
15911591 SECTION 16. Section 63-9D-16 NMSA 1978 (being Laws 1990,
15921592 Chapter 61, Section 5) is amended to read:
15931593 "63-9D-16. [ENHANCED ] 911 BONDS--TERMS.--[Enhanced ] 911

16941694 "63-9D-19. [ENHANCED ] 911 BONDS NOT GENERAL OBLIGATIONS--
16951695 AUTHENTICATION.--
16961696 A. [Enhanced] 911 bonds or refunding bonds issued
16971697 as authorized by the [Enhanced ] 911 Bond Act are:
16981698 (1) not general obligations of the state; and
16991699 (2) collectible only from the proper pledged
17001700 revenues, and each bond shall state that it is payable solely
17011701 from the pledged revenues and that the bondholders may not look
17021702 to any other state fund for the payment of the interest and

17391739 A. The legislature shall provide for the continued

17411741 surcharge into the [enhanced ] 911 emergency service fund in
17421742 amounts that, together with other amounts deposited into the
17431743 fund, [will be] is sufficient to produce an amount necessary to
17441744 meet annual debt service charges on all respective outstanding
17451745 [enhanced] 911 bonds.
17461746 B. The legislature shall not repeal, amend or
17471747 otherwise modify any law that affects the 911 [emergency ]
17481748 surcharge in a manner that impairs any outstanding [enhanced ]
17491749 911 bonds secured by a pledge of the 911 [emergency ] surcharge
17501750 unless:
17511751 (1) the outstanding [enhanced ] 911 bonds to
17521752 which the revenues from the surcharge are pledged have been
17531753 discharged in full; or
17541754 (2) provision has been made to discharge fully
17551755 the outstanding [enhanced ] 911 bonds to which the revenues from
17561756 the surcharge are pledged.
