| 55 | 55 | A. Unlawful use of underground water consists of a | |
| 56 | 56 | person selling, trading, bartering or otherwise using or | |
| 57 | 57 | appropriating underground water requiring a permit pursuant to | |
| 58 | 58 | Chapter 72, Article 12 NMSA 1978: | |
| 59 | 59 | (1) for any use other than a use permitted by | |
| 60 | 60 | the state engineer; or | |
| 61 | 61 | (2) without a permit. | |
| 62 | 62 | B. Whoever commits unlawful use of underground | |
