4949 RELATING TO MOTOR VEHICLES; ENACTING A NEW SECTION OF THE MOTOR
5050 VEHICLE CODE REQUIRING VEHICLE DRIVERS TO YIELD THE RIGHT OF
5151 WAY TO A TRANSIT BUS THAT IS DISPLAYING A YIELD SIGN; DEFINING
5252 TERMS; PROVIDING PENALTIES.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. Section 66-1-4.11 NMSA 1978 (being Laws 1990,
5555 Chapter 120, Section 12, as amended) is amended to read:
5656 "66-1-4.11. DEFINITIONS.--As used in the Motor Vehicle
5757 Code:
5858 A. "mail" means any item properly addressed with
5959 postage prepaid delivered by the United States postal service
6060 or any other public or private enterprise primarily engaged in
6161 the transport and delivery of letters, packages and other
6262 parcels;

9090 B. "manufactured home" means a movable or portable
9191 housing structure that exceeds either a width of eight feet or
9292 a length of forty feet, constructed to be towed on its own
9393 chassis and designed to be installed with or without a
9494 permanent foundation for human occupancy;
9595 C. "manufacturer" means every person engaged in the
9696 business of constructing or assembling vehicles of a type
9797 required to be registered under the Motor Vehicle Code;
9898 D. "manufacturer's certificate of origin" means a
9999 certification, on a form supplied by or approved by the
100100 department, signed by the manufacturer that the new vehicle or
101101 boat described in the certificate has been transferred to the
102102 New Mexico dealer or distributor named in the certificate or to
103103 a dealer duly licensed or recognized as such in another state,
104104 territory or possession of the United States and that such
105105 transfer is the first transfer of the vehicle or boat in
106106 ordinary trade and commerce;
107107 E. "mass transit" means a coordinated system of
108108 transit modes providing transportation for use by the general
109109 public;
110110 [E.] F. "moped" means a two-wheeled or three-
111111 wheeled vehicle with an automatic transmission and a motor
112112 having a piston displacement of less than fifty cubic
113113 centimeters, that is capable of propelling the vehicle at a
114114 maximum speed of not more than thirty miles an hour on level

144144 [F.] G. "motorcycle" means every motor vehicle
145145 having a seat or saddle for the use of the rider and designed
146146 to travel on not more than three wheels in contact with the
147147 ground, including autocycles and excluding a tractor;
148148 [G.] H. "motor home" means a camping body built on
149149 a self-propelled motor vehicle chassis so designed that seating
150150 for driver and passengers is within the body itself;
151151 [H.] I. "motor vehicle" means every vehicle that is
152152 self-propelled and every vehicle that is propelled by electric
153153 power obtained from batteries or from overhead trolley wires,
154154 but not operated upon rails, including an electric mobility
155155 device, but does not include an electric-assisted bicycle; for
156156 the purposes of the Mandatory Financial Responsibility Act,
157157 "motor vehicle" does not include "special mobile equipment";
158158 and
159159 [I.] J. "motor vehicle insurance policy" means a
160160 policy of vehicle insurance that covers self-propelled vehicles
161161 of a kind required to be registered pursuant to New Mexico law
162162 for use on the public streets and highways. A "motor vehicle
163163 insurance policy":
164164 (1) shall include:
165165 (a) motor vehicle bodily injury and
166166 property damage liability coverages in compliance with the
167167 Mandatory Financial Responsibility Act; and

203203 the insurer agree to include within the policy."
204204 SECTION 2. Section 66-1-4.14 NMSA 1978 (being Laws 1990,
205205 Chapter 120, Section 15, as amended) is amended to read:
206206 "66-1-4.14. DEFINITIONS.--As used in the Motor Vehicle
207207 Code:
208208 A. "park" or "parking" means the standing of a
209209 vehicle, whether occupied or not, other than temporarily for
210210 the purpose of and while actually engaged in loading and
211211 unloading;
212212 B. "parking lot" means a parking area provided for
213213 the use of patrons of any office of state or local government
214214 or of any public accommodation, retail or commercial
215215 establishment;
216216 C. "parts car" means a motor vehicle generally in
217217 nonoperable condition that is owned by a collector to furnish
218218 parts that are usually nonobtainable from normal sources, thus
219219 enabling a collector to preserve, restore and maintain a motor
220220 vehicle of historic or special interest;

249249 D. "passenger van" means a vehicle with seating for
250250 thirteen or fewer people, a maximum interior headroom of
251251 fifty-two inches and single rear tires;
252252 [D.] E. "pedestrian" means any natural person on
253253 foot;
254254 [E.] F. "person" means every natural person, firm,
255255 copartnership, association, corporation or other legal entity;
256256 [F.] G. "personal information" means information
257257 that identifies an individual, including an individual's
258258 photograph, social security number, driver identification
259259 number, name, address other than zip code, telephone number and
260260 medical or disability information, but "personal information"
261261 does not include information on vehicles, vehicle ownership,
262262 vehicular accidents, driving violations or driver status;
263263 [G.] H. "placard" or "parking placard" means a
264264 card-like device that identifies the vehicle as being currently
265265 in use to transport a person with severe mobility impairment
266266 and issued pursuant to Section 66-3-16 NMSA 1978 to be
267267 displayed inside a motor vehicle so as to be readily visible to
268268 an observer outside the vehicle;
269269 [H.] I. "platoon" means a series of motor vehicles
270270 that are traveling in a unified manner by means of being
271271 connected with wireless communications or other technology
272272 allowing for coordinated movement;
273273 [I.] J. "pneumatic tire" means every tire in which

303303 [J.] K. "pole trailer" means any vehicle without
304304 motive power, designed to be drawn by another vehicle and
305305 attached to the towing vehicle by means of a reach or pole or
306306 by being boomed or otherwise secured to the towing vehicle and
307307 ordinarily used for transporting long or irregularly shaped
308308 loads such as poles, structures, pipes and structural members
309309 capable, generally, of sustaining themselves as beams between
310310 the supporting connections;
311311 [K.] L. "police or peace officer" means every
312312 officer authorized to direct or regulate traffic or to make
313313 arrests for violations of the Motor Vehicle Code;
314314 [L.] M. "private road or driveway" means every way
315315 or place in private ownership used for vehicular travel by the
316316 owner and those having express or implied permission from the
317317 owner, but not other persons; [and ]
318318 [M.] N. "property owner" means the owner of a piece
319319 of land or the agent of that property owner; and
320320 O. "public mass transit operator" means an agency
321321 or a political subdivision of the state that provides mass
322322 transit services."
323323 SECTION 3. Section 66-1-4.17 NMSA 1978 (being Laws 1990,
324324 Chapter 120, Section 18, as amended) is amended to read:

355355 A. "tank vehicle" means a motor vehicle that is
356356 designed to transport any liquid or gaseous material within a
357357 tank that is either permanently or temporarily attached to the
358358 vehicle or the chassis and that has either a gross vehicle
359359 weight rating of twenty-six thousand one or more pounds or is
360360 used in the transportation of hazardous materials requiring
361361 placarding of the vehicle under applicable law;
362362 B. "taxicab" means a motor vehicle used for hire in
363363 the transportation of persons, having a normal seating capacity
364364 of not more than seven persons;
365365 C. "temporary off-site location" means a location
366366 other than a dealer's established or additional place of
367367 business that is used exclusively for the display of vehicles
368368 or vessels for sale or resale and for related business;
369369 D. "through highway" means every highway or portion
370370 of a highway at the entrance to which vehicular traffic from
371371 intersecting highways is required by law to stop before
372372 entering or crossing it when stop signs are erected as provided
373373 in the Motor Vehicle Code;
374374 E. "title service company" means a person, other
375375 than the department, an agent of the department, a licensed
376376 dealer or the [motor transportation ] New Mexico state police
377377 division of the department of public safety, who for
378378 consideration issues temporary registration plates or prepares
379379 and submits to the department on behalf of others applications

409409 F. "traffic" means pedestrians, ridden or herded
410410 animals, vehicles and other conveyances either singly or
411411 together using any highway for purposes of travel;
412412 G. "traffic-control signal" means any device,
413413 whether manually, electrically or mechanically operated, by
414414 which traffic is alternately directed to stop and to proceed;
415415 H. "traffic safety bureau" means the traffic safety
416416 bureau of the department of transportation;
417417 I. "trailer" means any vehicle without motive
418418 power, designed for carrying persons or property and for being
419419 drawn by a motor vehicle, and so constructed that no
420420 significant part of its weight rests upon the towing vehicle;
421421 J. "transaction" means all operations necessary at
422422 one time with respect to one identification card, one driver,
423423 one vessel or one vehicle;
424424 K. "transit bus" means a bus operated by a public
425425 mass transit operator;
426426 [K.] L. "transportation inspector" means an
427427 employee of the [motor transportation ] New Mexico state police
428428 division of the department of public safety who has been
429429 certified by the director of the division to enter upon and
430430 perform inspections of motor carriers' vehicles in operation;
431431 [L.] M. "transporter of manufactured homes" means a
432432 commercial motor vehicle operation engaged in the business of

462462 location to the first dealer's location. A "transporter of
463463 manufactured homes" may or may not be associated with or
464464 affiliated with a particular manufacturer or dealer;
465465 [M.] N. "travel trailer" means a trailer with a
466466 camping body and includes recreational travel trailers and
467467 camping trailers;
468468 [N.] O. "trial court" means the magistrate,
469469 municipal or district court that tries the case concerning an
470470 alleged violation of a provision of the Motor Vehicle Code;
471471 [O.] P. "tribal court" means a court created by a
472472 tribe or a court of Indian offense created by the United States
473473 secretary of the interior;
474474 [P.] Q. "tribe" means an Indian nation, tribe or
475475 pueblo located wholly or partially in New Mexico;
476476 [Q.] R. "truck" means every motor vehicle designed,
477477 used or maintained primarily for the transportation of
478478 property;
479479 [R.] S. "truck camper" means a camping body
480480 designed to be loaded onto, or affixed to, the bed or chassis
481481 of a truck. A camping body, when combined with a truck or
482482 truck cab and chassis, even though not attached permanently,
483483 becomes a part of the motor vehicle, and together they are a
484484 recreational unit to be known as a "truck camper"; there are
485485 three general types of truck campers:

517517 (2) "chassis-mount camper" means a camping
518518 body designed to be affixed to a truck cab and chassis; and
519519 (3) "pickup cover" or "camper shell" means a
520520 camping body designed to provide an all-weather protective
521521 enclosure over the bed of a pickup truck and to be affixed to
522522 the pickup truck; and
523523 [S.] T. "truck tractor" means every motor vehicle
524524 designed and used primarily for drawing other vehicles and
525525 constructed to carry a part of the weight of the vehicle and
526526 load drawn."
527527 SECTION 4. A new Section 66-7-332.2 NMSA 1978 is enacted
528528 to read:
529529 "66-7-332.2. [NEW MATERIAL ] YIELD TO TRANSIT BUSES
530530 DISPLAYING PROPER SIGNAGE.--
531531 A. A driver shall yield the right of way to a
532532 transit bus, excepting a passenger van, when an illuminated
533533 yield sign is displayed on the rear of the bus and the bus is
534534 attempting to merge into a traffic lane from a designated bus
535535 stop.
536536 B. This section does not require a public mass
537537 transit operator to install illuminated yield signs on the
538538 buses it operates.

947947 B. The term "penalty assessment misdemeanor" does
948948 not include a violation that has caused or contributed to the
949949 cause of an accident resulting in injury or death to a person.
950950 C. When an alleged violator of a penalty assessment
951951 misdemeanor elects to accept a notice to appear in lieu of a
952952 notice of penalty assessment, a fine imposed upon later
953953 conviction shall not exceed the penalty assessment established
954954 for the particular penalty assessment misdemeanor and probation
955955 imposed upon a suspended or deferred sentence shall not exceed
956956 ninety days.
957957 D. The penalty assessment for speeding in violation
958958 of Paragraph (5) of Subsection A of Section 66-7-301 NMSA 1978
959959 is twice the penalty assessment established in Subsection A of
960960 this section for the equivalent miles per hour over the speed
