3333 RELATING TO DOMESTIC AFFAIRS; RENAMING THE FAMILY VIOLENCE
3434 PROTECTION ACT AS THE PROTECTION AGAINST ABUSE AND VIOLENCE
3535 ACT; CLARIFYING DEFINITIONS; SPECIFYING THE STANDARD TO BE
3636 IMPLEMENTED FOR CERTAIN ORDERS OF PROTECTION; AMENDING AND
3737 REPEALING SECTIONS OF THE NMSA 1978.
3838 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3939 SECTION 1. Section 1-4-5.1 NMSA 1978 (being Laws 1993,
4040 Chapter 314, Section 7 and Laws 1993, Chapter 316, Section 7,
4141 as amended) is amended to read:
4242 "1-4-5.1. METHOD OF REGISTRATION--FORM.--
4343 A. A qualified elector may apply for registration
4444 using the paper form by mail, in the office of the secretary of
4545 state or county clerk or with a registration agent or officer.
4646 B. A person may request certificate of registration

7777 C. A qualified elector who wishes to register to
7878 vote shall fill out completely and sign the certificate of
7979 registration. The qualified elector may seek the assistance of
8080 any person in completing the certificate of registration.
8181 D. A qualified elector who has filed for an order
8282 of protection pursuant to the provisions of the [Family
8383 Violence] Protection Against Abuse and Violence Act and who
8484 presents a copy of that order from a state or tribal court to
8585 the registration officer shall be referred to the confidential
8686 address program administered by the secretary of state pursuant
8787 to the Confidential Substitute Address Act.
8888 E. Completed certificates of registration may be
8989 mailed or presented in person by the registrant or any other
9090 person to the secretary of state, to the county clerk of the
9191 county in which the registrant resides or to any other county
9292 clerk in this state.
9393 F. If the registrant wishes to vote in the next
9494 election, the completed and signed certificate of registration
9595 shall be delivered or mailed and postmarked within the time
9696 frame provided in Subsection A of Section 1-4-8 NMSA 1978.
9797 G. Within one business day after receipt of a
9898 certificate of registration, the secretary of state shall send

128128 qualified elector resides. Within one business day after
129129 receipt of a certificate of registration of another county, a
130130 county clerk shall send the certificate of registration to the
131131 county clerk in the county where the qualified elector resides.
132132 H. Only when the certificate of registration is
133133 properly filled out, signed by the qualified elector and
134134 accepted for filing by the county clerk as evidenced by the
135135 county clerk's signature or stamp and the date of acceptance
136136 thereon shall it constitute an official public record of the
137137 registration of the qualified elector. A qualified elector
138138 complies with a voter registration deadline established in the
139139 Election Code when a properly filled-out voter registration
140140 certificate has been received by a county clerk or the
141141 secretary of state, regardless of the date the certificate is
142142 processed.
143143 I. The secretary of state shall prescribe the form
144144 of the certificate of registration, which form shall be a
145145 postpaid mail-in format and shall be printed in Spanish and
146146 English. The certificate of registration form shall be clear
147147 and understandable to the average person and shall include
148148 brief but sufficient instructions to enable the qualified
149149 elector to complete the form without assistance. The form
150150 shall also include:
151151 (1) the question "Are you a citizen of the

182182 (2) the statement "If you checked 'no', do not
183183 complete this form.";
184184 (3) a statement informing the applicant that:
185185 (a) if the form is submitted by mail by
186186 the applicant and the applicant is registering for the first
187187 time in New Mexico, the applicant must submit with the form a
188188 copy of: 1) a photo identification issued by a government or
189189 educational institution; or 2) a current utility bill, bank
190190 statement, government check, paycheck, student identification
191191 card or other government document, including identification
192192 issued by an Indian nation, tribe or pueblo, that shows the
193193 name and current address of the applicant; and
194194 (b) if the applicant does not submit the
195195 required documentary identification, the applicant will be
196196 required to do so when voting in person or absentee; and
197197 (4) a statement requiring the applicant to
198198 swear or affirm that the information supplied by the applicant
199199 is true."
200200 SECTION 2. Section 29-15-2 NMSA 1978 (being Laws 1995,
201201 Chapter 146, Section 2, as amended) is amended to read:
202202 "29-15-2. DEFINITIONS.--As used in the Missing Persons
203203 Information and Reporting Act:
204204 A. "Brittany alert" means a notification relating

234234 (1) who is a missing person; and
235235 (2) about whom there is a clear indication
236236 that the person has a developmental disability as defined in
237237 Subsection A of Section 28-16A-6 NMSA 1978 and that the
238238 person's health or safety is at risk;
239239 B. "child" means a person under the age of eighteen
240240 years who is not emancipated;
241241 C. "clearinghouse" means the missing persons
242242 information clearinghouse;
243243 D. "custodian" means a parent, guardian or other
244244 person who exercises legal physical control, care or custody of
245245 a child or of an adult with a developmental disability; or a
246246 person who performs one or more activities of daily living for
247247 an adult;
248248 E. "endangered person" means a missing person who:
249249 (1) is in imminent danger of causing harm to
250250 the person's self;
251251 (2) is in imminent danger of causing harm to
252252 another;
253253 (3) is in imminent danger of being harmed by
254254 another or who has been harmed by another;
255255 (4) has been a victim of a crime as provided
256256 in the Crimes Against Household Members Act or in Section
257257 30-3A-3 or 30-3A-3.1 NMSA 1978, or their equivalents in any

287287 (5) is or was protected by an order of
288288 protection pursuant to the [Family Violence ] Protection Against
289289 Abuse and Violence Act;
290290 (6) has Alzheimer's disease, dementia or
291291 another degenerative brain disorder or a brain injury; or
292292 (7) has a developmental disability as defined
293293 in Subsection A of Section 28-16A-6 NMSA 1978 and that person's
294294 health or safety is at risk;
295295 F. "immediate family member" means the spouse,
296296 nearest relative or close friend of a person;
297297 G. "law enforcement agency" means a law enforcement
298298 agency of the state, a state agency or a political subdivision
299299 of the state;
300300 H. "lead station" means an AM radio station that
301301 has been designated as the "state primary station" by the
302302 federal communications commission for the emergency alert
303303 system;
304304 I. "missing person" means a person whose
305305 whereabouts are unknown to the person's custodian or immediate
306306 family member and the circumstances of whose absence indicate
307307 that:
308308 (1) the person did not leave the care and
309309 control of the custodian or immediate family member voluntarily
310310 and the taking of the person was not authorized by law; or

339339 (2) the person voluntarily left the care and
340340 control of the custodian without the custodian's consent and
341341 without intent to return;
342342 J. "missing person report" means information that
343343 is:
344344 (1) given to a law enforcement agency on a
345345 form used for sending information to the national crime
346346 information center; and
347347 (2) about a person whose whereabouts are
348348 unknown to the reporter and who is alleged in the form
349349 submitted by the reporter to be missing;
350350 K. "person" means an individual, regardless of age;
351351 L. "possible match" means the similarities between
352352 unidentified human remains and a missing person that would lead
353353 one to believe they are the same person;
354354 M. "reporter" means the person who reports a
355355 missing person;
356356 N. "silver alert" means a notification relating to
357357 an endangered person:
358358 (1) who is a missing person; and
359359 (2) who is fifty years or older; or
360360 (3) about whom there is a clear indication
361361 that the individual suffers from Alzheimer's disease or another
362362 form of dementia, regardless of age;
363363 O. "state agency" means an agency of the state, a

396396 health pursuant to the Vital Statistics Act."
397397 SECTION 3. Section 30-1-15 NMSA 1978 (being Laws 2002,
398398 Chapter 34, Section 1 and Laws 2002, Chapter 35, Section 1, as
399399 amended) is amended to read:
400400 "30-1-15. ALLEGED VICTIMS OF DOMESTIC ABUSE, STALKING OR
401401 SEXUAL ASSAULT--FORBEARANCE OF COSTS.--
402402 A. An alleged victim of an offense specified in
403403 Subsection B of this section is not required to bear the cost
404404 of:
405405 (1) the prosecution of a misdemeanor or felony
406406 domestic violence offense, including costs associated with
407407 filing a criminal charge against an alleged perpetrator of the
408408 offense;
409409 (2) the filing, issuance or service of a
410410 warrant;
411411 (3) the filing, issuance or service of a
412412 witness subpoena; or
413413 (4) the filing, issuance, registration or
414414 service of a protection order.
415415 B. The provisions of Subsection A of this section

447447 (2) sexual offenses described in Sections
448448 30-9-11 through 30-9-14 and 30-9-14.3 NMSA 1978;
449449 (3) crimes against household members described
450450 in Sections 30-3-12 through 30-3-16 NMSA 1978;
451451 (4) harassment, stalking and aggravated
452452 stalking described in Sections 30-3A-2 through 30-3A-3.1 NMSA
453453 1978; and
454454 (5) the violation of an order of protection
455455 that is issued pursuant to the [Family Violence ] Protection
456456 Against Abuse and Violence Act or entitled to full faith and
457457 credit."
458458 SECTION 4. Section 31-12-12 NMSA 1978 (being Laws 2003,
459459 Chapter 387, Section 2, as amended) is amended to read:
460460 "31-12-12. DOMESTIC VIOLENCE OFFENDER TREATMENT OR
461461 INTERVENTION FUND CREATED--APPROPRIATION--PROGRAM
462462 REQUIREMENTS.--
463463 A. The "domestic violence offender treatment or
464464 intervention fund" is created in the state treasury. The fund
465465 consists of gifts, grants, donations, appropriations and
466466 distributions to the fund made pursuant to the Tax
467467 Administration Act.
468468 B. Balances in the domestic violence offender
469469 treatment or intervention fund are appropriated to the

499499 domestic violence offender treatment or intervention programs
500500 to defray the cost of providing treatment or intervention to
501501 domestic violence offenders. Unexpended or unencumbered
502502 balances remaining in the fund at the end of any fiscal year
503503 shall not revert to the general fund.
504504 C. Payment out of the domestic violence offender
505505 treatment or intervention fund shall be made on vouchers issued
506506 and signed by the secretary of children, youth and families
507507 upon warrants drawn by the department of finance and
508508 administration.
509509 D. In order to be eligible for money from the
510510 domestic violence offender treatment or intervention fund, a
511511 domestic violence offender treatment or intervention program
512512 shall include the following components in its program:
513513 (1) an initial assessment to determine if a
514514 domestic violence offender will benefit from participation in
515515 the program;
516516 (2) a written contract, which must be signed
517517 by the domestic violence offender, that sets forth:
518518 (a) attendance and participation
519519 requirements;
520520 (b) consequences for failure to attend
521521 or participate in the program; and
522522 (c) a confidentiality clause that

552552 or intervention sessions;
553553 (3) strategies to hold domestic violence
554554 offenders accountable for their violent behavior;
555555 (4) a requirement that group discussions are
556556 limited to members of the same gender;
557557 (5) an education component that:
558558 (a) defines physical, emotional, sexual,
559559 economic and verbal abuse and techniques for stopping those
560560 forms of abuse; and
561561 (b) examines gender roles,
562562 socialization, the nature of violence, the dynamics of power
563563 and control and the effects of domestic violence on children;
564564 (6) a requirement that a domestic violence
565565 offender not be under the influence of alcohol or drugs during
566566 a treatment or intervention session;
567567 (7) a requirement, except with respect to a
568568 domestic violence offender who is a voluntary participant in
569569 the program, that the program provide monthly written reports
570570 to the presiding judge or the domestic violence offender's
571571 probation or parole officer regarding:
572572 (a) proof of the domestic violence
573573 offender's enrollment in the program;
574574 (b) progress reports that address the
575575 domestic violence offender's attendance, fee payments and

605605 (c) evaluations of progress made by the
606606 domestic violence offender and recommendations as to whether or
607607 not to require the offender's further participation in the
608608 program; and
609609 (8) a requirement that the term of the program
610610 be at least fifty-two weeks.
611611 E. Counseling for couples shall not be a component
612612 of a domestic violence offender treatment or intervention
613613 program.
614614 F. As used in this section, "domestic violence
615615 offender" means a person:
616616 (1) convicted for an offense pursuant to the
617617 provisions of the Crimes Against Household Members Act;
618618 (2) convicted for violating an order of
619619 protection granted by a court pursuant to the provisions of the
620620 [Family Violence] Protection Against Abuse and Violence Act;
621621 (3) referred to a domestic violence offender
622622 treatment or intervention program by a judge, a domestic
623623 violence special commissioner or the parole board; or
624624 (4) who voluntarily participates in a domestic
625625 violence offender treatment or intervention program."
626626 SECTION 5. Section 32A-2-3 NMSA 1978 (being Laws 1993,
627627 Chapter 77, Section 32, as amended) is amended to read:
628628 "32A-2-3. DEFINITIONS.--As used in the Delinquency Act:

657657 A. "delinquent act" means an act committed by a
658658 child that would be designated as a crime under the law if
659659 committed by an adult, not including a violation of Section
660660 30-9-2 NMSA 1978, including the following offenses:
661661 (1) any of the following offenses pursuant to
662662 municipal traffic codes or the Motor Vehicle Code:
663663 (a) driving while under the influence of
664664 intoxicating liquor or drugs;
665665 (b) failure to stop in the event of an
666666 accident causing death, personal injury or damage to property;
667667 (c) unlawful taking of a vehicle or
668668 motor vehicle;
669669 (d) receiving or transferring of a
670670 stolen vehicle or motor vehicle;
671671 (e) homicide by vehicle;
672672 (f) injuring or tampering with a
673673 vehicle;
674674 (g) altering or changing of an engine
675675 number or other vehicle identification numbers;
676676 (h) altering or forging of a driver's
677677 license or permit or any making of a fictitious license or
678678 permit;
679679 (i) reckless driving;
680680 (j) driving with a suspended or revoked
681681 license; or

710710 (k) an offense punishable as a felony;
711711 (2) buying, attempting to buy, receiving,
712712 possessing or being served any alcoholic liquor or being
713713 present in a licensed liquor establishment, other than a
714714 restaurant or a licensed retail liquor establishment, except in
715715 the presence of the child's parent, guardian, custodian or
716716 adult spouse. As used in this paragraph, "restaurant" means an
717717 establishment where meals are prepared and served primarily for
718718 on-premises consumption and that has a dining room, a kitchen
719719 and the employees necessary for preparing, cooking and serving
720720 meals. "Restaurant" does not include an establishment, as
721721 defined in regulations promulgated by the director of the
722722 special investigations unit of the department of public safety,
723723 that serves only hamburgers, sandwiches, salads and other fast
724724 foods;
725725 (3) a violation of Section 30-29-2 NMSA 1978,
726726 regarding the illegal use of a glue, aerosol spray product or
727727 other chemical substance;
728728 (4) a violation of the Controlled Substances
729729 Act;
730730 (5) escape from the custody of a law
731731 enforcement officer or a juvenile probation or parole officer
732732 or from any placement made by the department by a child who has
733733 been adjudicated a delinquent child;
734734 (6) a violation of Section 30-15-1.1 NMSA 1978

763763 regarding unauthorized graffiti on personal or real property;
764764 (7) a violation of an order of protection
765765 issued pursuant to the provisions of the [Family Violence ]
766766 Protection Against Abuse and Violence Act; or
767767 (8) trafficking cannabis as provided in
768768 Section 26-2C-28 NMSA 1978;
769769 B. "delinquent child" means a child who has
770770 committed a delinquent act;
771771 C. "delinquent offender" means a delinquent child
772772 who is subject to juvenile sanctions only and who is not a
773773 youthful offender or a serious youthful offender;
774774 D. "detention facility" means a place where a child
775775 may be detained under the Children's Code pending a court
776776 hearing and does not include a facility for the care and
777777 rehabilitation of an adjudicated delinquent child;
778778 E. "felony" means an act that would be a felony if
779779 committed by an adult;
780780 F. "misdemeanor" means an act that would be a
781781 misdemeanor or petty misdemeanor if committed by an adult;
782782 G. "restitution" means financial reimbursement by
783783 the child to the victim or community service imposed by the
784784 court and is limited to easily ascertainable damages for injury
785785 to or loss of property, actual expenses incurred for medical,
786786 psychiatric and psychological treatment for injury to a person
787787 and lost wages resulting from physical injury, which are a

816816 direct and proximate result of a delinquent act. "Restitution"
817817 does not include reimbursement for damages for mental anguish,
818818 pain and suffering or other intangible losses. As used in this
819819 subsection, "victim" means a person who is injured or suffers
820820 damage of any kind by an act that is the subject of a complaint
821821 or referral to law enforcement officers or juvenile probation
822822 authorities. Nothing contained in this definition limits or
823823 replaces the provisions of Subsections A and B of Section
824824 32A-2-27 NMSA 1978;
825825 H. "serious youthful offender" means an individual
826826 fifteen to eighteen years of age who is charged with and
827827 indicted or bound over for trial for first degree murder. A
828828 "serious youthful offender" is not a delinquent child as
829829 defined pursuant to the provisions of this section;
830830 I. "supervised release" means the release of a
831831 juvenile, whose term of commitment has not expired, from a
832832 facility for the care and rehabilitation of adjudicated
833833 delinquent children, with specified conditions to protect
834834 public safety and promote successful transition and
835835 reintegration into the community. A juvenile on supervised
836836 release is subject to monitoring by the department until the
837837 term of commitment has expired and may be returned to custody
838838 for violating conditions of release; and
839839 J. "youthful offender" means a delinquent child
840840 subject to adult or juvenile sanctions who is:

11351135 C. Arbitration pursuant to this section shall be

11391139 D. If the parties have not agreed to an arbitrator,
11401140 the court shall appoint an arbitrator who:

11431143 (2) has practiced as an attorney for not less

23202320 (10) shall not order that the protected party
23212321 participate in treatment or counseling related to abuse .

23232323 that violation of any provision of the order of protection is a

31523152 F. "order of protection" means a court order

31573157 engaging in the protected activity of taking domestic abuse

31593159 SECTION 24. REPEAL.--Section 40-13-1.1 NMSA 1978 (being
31603160 Laws 2002, Chapter 34, Section 2 and Laws 2002, Chapter 35,
31613161 Section 2) is repealed.
31623162 SECTION 25. EFFECTIVE DATE.--The effective date of the
31633163 provisions of this act is July 1, 2025.
