3333 RELATING TO ZONING; RESTRICTING APPEALS OF DECISIONS OF ZONING
3434 AND PLANNING AUTHORITIES TO PEOPLE WHO HAVE AN OWNERSHIP
3535 INTEREST IN THE REAL PROPERTY THAT IS THE SUBJECT OF THE
3636 DECISION OR A PROPERTY THAT IS ADJACENT TO THE PROPERTY THAT IS
3737 THE SUBJECT OF THE DECISION.
3838 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3939 SECTION 1. Section 3-19-8 NMSA 1978 (being Laws 1965,
4040 Chapter 300, Section 14-18-8, as amended) is amended to read:
4141 "3-19-8. APPEAL.--[Any ] A person [in interest]
4242 dissatisfied with an order or determination of the planning
4343 commission, after review of the order or determination by the
4444 governing body of the municipality, may commence an appeal in
4545 the district court pursuant to the provisions of Section
4646 39-3-1.1 NMSA 1978; provided that if a specific real property

8080 SECTION 2. Section 3-21-4 NMSA 1978 (being Laws 1977,
8181 Chapter 80, Section 3, as amended) is amended to read:
8282 "3-21-4. EXTRATERRITORIAL ZONING ORDINANCE--ENFORCEMENT
8383 AND ADMINISTRATION--APPEALS.--
8484 A. A zoning ordinance adopted by a joint municipal-
8585 county zoning authority shall be an ordinance of the
8686 municipality and an ordinance of the county joining in the
8787 agreement pursuant to Subsection A of Section 3-21-3 NMSA 1978
8888 and may be enforced by appropriate procedures of either the
8989 municipality or the county. The agreement entered into
9090 pursuant to Subsection A of Section 3-21-3 NMSA 1978 may
9191 specify whether the municipality or the county shall assume
9292 primary enforcement responsibility.
9393 B. The extraterritorial zoning commission shall
9494 administer the zoning ordinance adopted by the joint municipal-
9595 county zoning authority in the manner provided in Subsection C
9696 of Section 3-21-7 NMSA 1978.
9797 C. Appeals from the decisions of the
9898 extraterritorial zoning commission shall be taken to the joint

128128 Section 3-21-8 NMSA 1978, and appeals from the decisions of the
129129 joint municipal-county zoning authority shall be taken to the
130130 district court in the manner provided in Section 39-3-1.1 NMSA
131131 1978; provided that if a specific real property is the subject
132132 of the decision, an appeal made pursuant to this section shall
133133 be limited to an aggrieved person who has an ownership interest
134134 in the real property that is the subject of the decision or has
135135 an ownership interest in a real property that is adjacent to
136136 the property that is the subject of the decision ."
137137 SECTION 3. Section 3-21-8 NMSA 1978 (being Laws 1965,
138138 Chapter 300, Section 14-20-6, as amended) is amended to read:
139139 "3-21-8. APPEALS TO ZONING AUTHORITY--GROUNDS--STAY OF
140140 PROCEEDINGS.--
141141 A. The zoning authority shall provide by resolution
142142 the procedure to be followed in considering appeals allowed by
143143 this section.
144144 B. [Any] An aggrieved person or [any ] an officer,
145145 department, board or bureau of the zoning authority affected by
146146 a decision of an administrative officer, commission or
147147 committee in the enforcement of Sections 3-21-1 through 3-21-14
148148 NMSA 1978 or ordinance, resolution, rule or regulation adopted
149149 pursuant to these sections may appeal to the zoning authority;
150150 provided that if a specific real property is the subject of the
151151 decision, an appeal made pursuant to this section shall be

180180 limited to an aggrieved person who has an ownership interest in
181181 the real property that is the subject of the decision or has an
182182 ownership interest in a real property that is adjacent to the
183183 property that is the subject of the decision . An appeal shall
184184 stay all proceedings in furtherance of the action appealed
185185 unless the officer, commission or committee from whom the
186186 appeal is taken certifies that by reason of facts stated in the
187187 certificate, a stay would cause imminent peril of life or
188188 property. Upon certification, the proceedings shall not be
189189 stayed except by order of district court after notice to the
190190 official, commission or committee from whom the appeal is taken
191191 and on due cause shown.
192192 C. When an appeal alleges that there is error in
193193 any order, requirement, decision or determination by an
194194 administrative official, commission or committee in the
195195 enforcement of Sections 3-21-1 through 3-21-14 NMSA 1978 or
196196 [any] an ordinance, resolution, rule or regulation adopted
197197 pursuant to these sections, the zoning authority by a majority
198198 vote of all its members may:
199199 (1) authorize, in appropriate cases and
200200 subject to appropriate conditions and safeguards, variances or
201201 special exceptions from the terms of the zoning ordinance or
202202 resolution:
203203 (a) that are not contrary to the public
204204 interest;

233233 (b) where, owing to special conditions,
234234 a literal enforcement of the zoning ordinance will result in
235235 unnecessary hardship;
236236 (c) so that the spirit of the zoning
237237 ordinance is observed and substantial justice done; and
238238 (d) so that the goals and policies of
239239 the comprehensive plan are implemented; or
240240 (2) in conformity with Sections 3-21-1 through
241241 3-21-14 NMSA 1978:
242242 (a) reverse any order, requirement,
243243 decision or determination of an administrative official,
244244 commission or committee;
245245 (b) decide in favor of the appellant; or
246246 (c) make [any change in any ] changes to
247247 an order, requirement, decision or determination of an
248248 administrative official, commission or committee."
249249 SECTION 4. Section 3-21-9 NMSA 1978 (being Laws 1965,
250250 Chapter 300, Section 14-20-7, as amended) is amended to read:
251251 "3-21-9. ZONING--APPEAL.--A person aggrieved by a
252252 decision of the zoning authority or any officer, department,
253253 board or bureau of the zoning authority may appeal the decision
254254 pursuant to the provisions of Section 39-3-1.1 NMSA 1978;
255255 provided that if a specific real property is the subject of the
256256 decision, an appeal made pursuant to this section shall be
