88 AN ACT relating to juvenile justice; designating criminal
99 investigators employed by the Division of Child and Family
1010 Services of the Department of Health and Human Services as
1111 category II peace officers; and providing other matters

1313 Legislative Counsel’s Digest:
1414 Existing law classifies peace officers as category I, category II or category III
1515 peace officers and requires peace officers in each category to meet certain training
1616 and educational requirements. (NRS 289.460, 289.470, 289.480, 289.510) Section
1717 1 of this bill designates criminal investigators employed by the Division of Child
1818 and Family Services of the Department of Health and Human Services as category
1919 II peace officers. Section 2 of this bill makes a conforming change necessitated by
2020 the addition of criminal investigators to the list of category II peace officers in
2121 section 1.

2626 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
2727 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

2929 Section 1. NRS 289.470 is hereby amended to read as follows:
3030 289.470 “Category II peace officer” means:
3131 1. The bailiffs of the district courts, justice courts and
3232 municipal courts whose duties require them to carry weapons and
3333 make arrests;
3434 2. Subject to the provisions of NRS 258.070, constables and
3535 their deputies;
3636 3. Inspectors employed by the Nevada Transportation
3737 Authority who exercise those powers of enforcement conferred by
3838 chapters 706 and 712 of NRS;
3939 4. Special investigators who are employed full-time by the
4040 office of any district attorney or the Attorney General;
4141 5. Investigators of arson for fire departments who are specially
4242 designated by the appointing authority;
4343 6. Investigators for the State Forester Firewarden who are
4444 specially designated by the State Forester Firewarden and whose
4545 primary duties are related to the investigation of arson;
4646 7. Agents of the Nevada Gaming Control Board who exercise
4747 the powers of enforcement specified in NRS 289.360, 463.140 or
4848 463.1405, except those agents whose duties relate primarily to
4949 auditing, accounting, the collection of taxes or license fees, or the
5050 investigation of applicants for licenses;

5555 8. Investigators and administrators of the Division of
5656 Compliance Enforcement of the Department of Motor Vehicles who
5757 perform the duties specified in subsection 2 of NRS 481.048;
5858 9. Officers and investigators of the Section for the Control of
5959 Emissions From Vehicles and the Enforcement of Matters Related
6060 to the Use of Special Fuel of the Department of Motor Vehicles who
6161 perform the duties specified in subsection 3 of NRS 481.0481;
6262 10. Legislative police officers of the State of Nevada;
6363 11. Parole counselors of the Division of Child and Family
6464 Services of the Department of Health and Human Services;
6565 12. Criminal investigators who are employed by the Division
6666 of Child and Family Services of the Department of Health and
6767 Human Services;
6868 13. Juvenile probation officers and deputy juvenile probation
6969 officers employed by the various judicial districts in the State of
7070 Nevada or by a department of juvenile justice services established
7171 by ordinance pursuant to NRS 62G.210 whose official duties require
7272 them to enforce court orders on juvenile offenders and make arrests;
7373 [13.] 14. Field investigators of the Taxicab Authority;
7474 [14.] 15. Security officers employed full-time by a city or
7575 county whose official duties require them to carry weapons and
7676 make arrests;
7777 [15.] 16. The chief of a department of alternative sentencing
7878 created pursuant to NRS 211A.080 and the assistant alternative
7979 sentencing officers employed by that department;
8080 [16.] 17. Agents of the Cannabis Compliance Board who
8181 exercise the powers of enforcement specified in NRS 289.355;
8282 [17.] 18. Criminal investigators who are employed by the
8383 Secretary of State; and
8484 [18.] 19. The Inspector General of the Department of
8585 Corrections and any person employed by the Department as a
8686 criminal investigator.
8787 Sec. 2. NRS 289.480 is hereby amended to read as follows:
8888 289.480 “Category III peace officer” means a peace officer
8989 whose authority is limited to correctional services, including the
9090 superintendents and correctional officers of the Department of
9191 Corrections. The term does not include a person described in
9292 subsection [18] 19 of NRS 289.470.
9393 Sec. 3. This act becomes effective upon passage and approval.
