88 AN ACT relating to education; revising the date by which a school
99 district or public school is required to create and post certain
1010 reports on the Internet; revising certain limitations on the use
1111 of money appropriated for programs of career and technical
1212 education; eliminating end-of-course finals; revising
1313 provisions governing educational involvement accords;
1414 eliminating the use of certain forms prescribed by the
1515 Department of Education that teachers in elementary schools
1616 are authorized to use to provide certain reports to parents and
1717 legal guardians of pupils; and providing other matters
1818 properly relating thereto.
1919 Legislative Counsel’s Digest:
2020 Existing law requires each school district and public school in this State to
2121 create and post on the Internet on or before October 1 of each year a report relating
2222 to educational expenditures, personnel employed and services provided by the
2323 school district or public school, as applicable, during the immediately preceding
2424 school year. (NRS 387.12468) Section 1 of this bill extends the deadline for the
2525 creation and posting of the report to on or before January 1 of each year.
2626 Existing law prohibits the State Board of Education from using more than 7.5
2727 percent of the money appropriated for programs of career and technical education
2828 to provide certain leadership and training activities, including: (1) activities by or
2929 for a pupil organization; (2) training and conferences for teachers; (3) marketing of
3030 career and technical education classes; and (4) the development of standards and
3131 assessments of career and technical education. (NRS 388.392) Section 2 of this bill
3232 increases this limitation to 20 percent of such appropriated money and expands the
3333 activities for which money within the 20 percent limitation may be used to include:
3434 (1) certain specific training activities for teachers of classes or programs of career
3535 and technical education; and (2) certain activities relating to work-based learning,
3636 industry-recognized credentials and career exploration.
3737 Existing law requires the State Board to prescribe criterion-referenced
3838 examinations to measure the achievement of pupils who are enrolled in grades 3 to
3939 12, inclusive. (NRS 390.105) Existing law also requires the State Board to select a
4040 college and career readiness assessment to be administered to pupils who are
4141 enrolled in grade 11. (NRS 390.610) Existing law additionally requires the State
4242 Board to adopt regulations regarding end-of-course finals, including the courses for
4343 which an end-of-course final must be administered. (NRS 390.700) Sections 3 and
4444 5 of this bill eliminate end-of-course finals.
4545 The federal Every Student Succeeds Act of 2015 requires local educational
4646 agencies to develop a written policy for meaningful parental and family
4747 involvement with the education of the pupil. (20 U.S.C. § 6318) Existing state law
4848 also requires all public schools in the State to use educational involvement accords,
4949 which are agreements between the schools and parents concerning the
5050 responsibilities of the parents, pupils and schools. Existing law requires: (1) the
5151 Department of Education to prescribe a form for educational involvement accords
5252 that complies with the policies of the federal Every Student Succeeds Act of 2015
5353 and the policies of this State to involve parents and families in the education of the
5454 pupil; and (2) the board of trustees of each school district to adopt a policy

5959 providing for the development and distribution of educational involvement accords.
6060 (NRS 392.4575) Section 4 of this bill removes the requirement for the Department
6161 to prescribe such a form and, instead, requires the Department to ensure that public
6262 schools use educational involvement accords that comply with certain federal and
6363 state policies. Section 5 also eliminates a form prescribed by the Department that
6464 teachers in elementary schools are authorized to use to provide reports to parents
6565 and legal guardians concerning parental involvement and compliance by pupils
6666 with certain school policies. (NRS 392.456)

7171 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
7272 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

7474 Section 1. NRS 387.12468 is hereby amended to read as
7575 follows:
7676 387.12468 1. On or before [October] January 1 of each year,
7777 each school district shall create a report that includes a description
7878 of the personnel employed and services provided by the school
7979 district during the immediately preceding school year and any
8080 changes that the school district anticipates making to the personnel
8181 and services during the current school year. The school district shall
8282 post a copy of the report on the Internet website maintained by the
8383 school district.
8484 2. On or before [October] January 1 of each year, each public
8585 school shall create a report that includes a description of the
8686 personnel employed and services provided by the school during the
8787 immediately preceding school year and any changes the school
8888 anticipates making to the personnel and services during the current
8989 school year. The public school shall post a copy of the report on the
9090 Internet website maintained by the public school or, if the public
9191 school does not maintain an Internet website, on the Internet website
9292 maintained by the school district or the governing body or sponsor
9393 of the public school, as applicable.
9494 3. The Department shall prescribe by regulation the format and
9595 contents of the information to be provided to create the report
9696 created by each school district pursuant to subsection 1 and each
9797 public school pursuant to subsection 2. The reports must include, as
9898 applicable and without limitation:
9999 (a) Each grade level at which the public school enrolls pupils;
100100 (b) The number of pupils attending the public school;
101101 (c) The average class size at the public school;
102102 (d) The number of persons employed by the public school to
103103 provide instruction, support to pupils, administrative support and
104104 other personnel including, without limitation, the number of

109109 employees in any subgroup of each type or classification of
110110 personnel as prescribed by the Department;
111111 (e) The professional development provided by the public school;
112112 (f) The amount of money spent per pupil for supplies, materials,
113113 equipment and textbooks;
114114 (g) For each category of pupils for which the public school
115115 receives any additional funding, including, without limitation, pupils
116116 with disabilities, pupils who are English learners, at-risk pupils and
117117 gifted and talented pupils:
118118 (1) The number of pupils in each category who attend the
119119 public school;
120120 (2) If the Department determines that pupils within a
121121 category must be divided based on severity of need, the number of
122122 pupils in each such subcategory; and
123123 (3) The number of persons employed to provide instruction,
124124 support to pupils, administrative support and other personnel
125125 employed by the public school and dedicated to providing services
126126 to each category or subcategory of pupils, including, without
127127 limitation, any subgroup of each kind of personnel prescribed by the
128128 Department;
129129 (h) The total amount of money received to support the
130130 operations of the public school, divided by the number of pupils
131131 enrolled in the public school and expressed as a per pupil amount;
132132 (i) The total amount of money received by the public school as
133133 adjusted base per pupil funding, divided by the number of pupils
134134 enrolled in the public school and expressed as a per pupil amount;
135135 and
136136 (j) The amount of money received by the public school as
137137 weighted funding for each category of pupils supported by weighted
138138 funding, divided by the number of pupils enrolled in the public
139139 school who are identified in the appropriate category and expressed
140140 as a per pupil amount for each category.
141141 Sec. 2. NRS 388.392 is hereby amended to read as follows:
142142 388.392 1. Of state money appropriated for use in a fiscal
143143 year for programs of career and technical education, the State Board
144144 shall not use more than [7.5] 20 percent to provide leadership and
145145 training activities or workforce development activities, or both, in
146146 that fiscal year.
147147 2. Before allocating state money, if any, to provide leadership
148148 and training activities [,] or workforce development activities, or
149149 both, the State Board shall:
150150 (a) Distribute 30 percent of the state money in the manner set
151151 forth in NRS 388.393; and

156156 (b) Distribute not more than 5 percent of the state money to
157157 pupil organizations for career and technical education in the manner
158158 set forth in NRS 388.394.
159159 3. After distributing the state money pursuant to subsection 2
160160 and allocating state money, if any, to provide leadership and training
161161 activities [,] or workforce development activities, or both, the State
162162 Board shall distribute the remainder of state money in the manner
163163 set forth in NRS 388.395.
164164 4. The State Board shall request that representatives of the
165165 industry sector councils established pursuant to subsection 2 of
166166 NRS 232.935 provide recommendations to the Superintendent of
167167 Public Instruction on the awarding of grants pursuant to
168168 NRS 388.393.
169169 5. As used in this section [, “leadership] :
170170 (a) “Leadership and training activities” means:
171171 [(a)] (1) Activities by or for pupil organizations for career and
172172 technical education;
173173 [(b)] (2) Training activities for teachers of classes or programs
174174 of career and technical education [;
175175 (c)] , including, without limitation:
176176 (I) Training activities to support pupils who are earning
177177 industry-recognized credentials, as identified by the Governor’s
178178 Office of Workforce Innovation pursuant to paragraph (d) of
179179 subsection 4 of NRS 232.975; and
180180 (II) Training activities to provide dual credit courses in
181181 career and technical education to pupils;
182182 (3) Activities at or for a conference of teachers of classes or
183183 programs of career and technical education;
184184 [(d)] (4) Promotion and marketing of classes or programs of
185185 career and technical education; and
186186 [(e)] (5) The development of standards and assessments of
187187 career and technical education for the purposes of leadership and
188188 training.
189189 (b) “Workforce development activities” means:
190190 (1) Activities by or for pupils participating in a work-based
191191 learning program pursuant to NRS 389.167;
192192 (2) Activities by or for pupils to earn industry-recognized
193193 credentials, as identified by the Governor’s Office of Workforce
194194 Innovation pursuant to paragraph (d) of subsection 4 of
195195 NRS 232.975; and
196196 (3) Activities by or for pupils enrolled in middle school or
197197 junior high school who are participating in career exploration.

202202 Sec. 3. NRS 389.0186 is hereby amended to read as follows:
203203 389.0186 1. Except as otherwise provided in this section,
204204 each public high school, including without limitation, a charter
205205 school, must allow a pupil enrolled in the school to receive a fourth
206206 unit of credit towards the mathematics credits required for
207207 graduation from high school or a third unit of credit towards the
208208 science credits required for graduation from high school for
209209 successful completion of:
210210 (a) An advanced placement computer science course;
211211 (b) A computer science course that is offered through a program
212212 of career and technical education; or
213213 (c) A computer science course that is offered by a community
214214 college or university which has been approved pursuant to
215215 NRS 389.160.
216216 2. A pupil [:
217217 (a) May] may not apply more than one unit of credit received for
218218 the completion of one or more courses described in subsection 1
219219 toward the mathematics or science credits required for graduation
220220 from high school.
221221 [(b) Must successfully complete each mathematics or science
222222 course for which an end-of-course examination is prescribed by the
223223 State Board pursuant to 20 U.S.C. § 6311(b)(2).]
224224 Sec. 4. NRS 392.4575 is hereby amended to read as follows:
225225 392.4575 1. The Department shall [prescribe a form for
226226 educational involvement accords to be used by] ensure that all
227227 public schools in this State [.] use educational involvement accords
228228 that comply with the requirements of this section. The educational
229229 involvement accord must comply with the policy:
230230 (a) For parental involvement required by the federal Every
231231 Student Succeeds Act of 2015, as set forth in 20 U.S.C. § 6318.
232232 (b) For parental involvement and family engagement adopted by
233233 the State Board pursuant to NRS 392.457.
234234 2. Each educational involvement accord must include, without
235235 limitation:
236236 (a) A description of how the parent or legal guardian will be
237237 involved in the education of the pupil, including, without limitation:
238238 (1) Reading to the pupil, as applicable for the grade or
239239 reading level of the pupil;
240240 (2) Reviewing and checking the pupil’s homework; and
241241 (3) Contributing 5 hours of time each school year, including,
242242 without limitation, by attending school-related activities, parent-
243243 teacher association meetings, parent-teacher conferences,

248248 volunteering at the school and chaperoning school-sponsored
249249 activities.
250250 (b) The responsibilities of a pupil in a public school, including,
251251 without limitation:
252252 (1) Reading each day before or after school, as applicable for
253253 the grade or reading level of the pupil;
254254 (2) Using all school equipment and property appropriately
255255 and safely;
256256 (3) Following the directions of any adult member of the staff
257257 of the school;
258258 (4) Completing and submitting homework in a timely
259259 manner; and
260260 (5) Respecting himself or herself, others and all property.
261261 (c) The responsibilities of a public school and the
262262 administrators, teachers and other personnel employed at a school,
263263 including, without limitation:
264264 (1) Ensuring that each pupil is provided proper instruction,
265265 supervision and interaction;
266266 (2) Maximizing the educational and social experience of
267267 each pupil;
268268 (3) Carrying out the professional responsibility of educators
269269 to seek the best interest of each pupil; and
270270 (4) Making staff available to the parents and legal guardians
271271 of pupils to discuss the concerns of parents and legal guardians
272272 regarding the pupils.
273273 3. Each educational involvement accord must be accompanied
274274 by, without limitation:
275275 (a) Information describing how the parent or legal guardian may
276276 contact the pupil’s teacher and the principal of the school in which
277277 the pupil is enrolled;
278278 (b) The curriculum of the course or standards for the grade in
279279 which the pupil is enrolled, as applicable, including, without
280280 limitation, a calendar that indicates the dates of major examinations
281281 and the due dates of significant projects, if those dates are known by
282282 the teacher at the time that the information is distributed;
283283 (c) The homework and grading policies of the pupil’s teacher or
284284 school;
285285 (d) Directions for finding resource materials for the course or
286286 grade in which the pupil is enrolled, as applicable;
287287 (e) Suggestions for parents and legal guardians to assist pupils in
288288 their schoolwork at home;
289289 (f) The dates of scheduled conferences between teachers or
290290 administrators and the parents or legal guardians of the pupil;

295295 (g) The manner in which reports of the pupil’s progress will be
296296 delivered to the parent or legal guardian and how a parent or legal
297297 guardian may request a report of progress;
298298 (h) The classroom rules and policies;
299299 (i) The dress code of the school, if any;
300300 (j) The availability of assistance to parents who have limited
301301 proficiency in the English language;
302302 (k) Information describing the availability of free and reduced-
303303 price meals, including, without limitation, information regarding
304304 school breakfast, school lunch and summer meal programs;
305305 (l) Opportunities for parents and legal guardians to become
306306 involved in the education of their children and to volunteer for the
307307 school or class; and
308308 (m) The code of honor relating to cheating prescribed pursuant
309309 to NRS 392.461.
310310 4. The board of trustees of each school district shall adopt a
311311 policy providing for the development and distribution of the
312312 educational involvement accord. The policy adopted by a board of
313313 trustees must require each classroom teacher to:
314314 (a) Distribute the educational involvement accord to the parent
315315 or legal guardian of each pupil in the teacher’s class at the beginning
316316 of each school year or upon a pupil’s enrollment in the class, as
317317 applicable; and
318318 (b) Provide the parent or legal guardian with a reasonable
319319 opportunity to sign the educational involvement accord.
320320 [5. Except as otherwise provided in this subsection, the board
321321 of trustees of each school district shall ensure that the form
322322 prescribed by the Department is used for the educational
323323 involvement accord of each public school in the school district. The
324324 board of trustees of a school district may authorize the use of an
325325 expanded form that contains additions to the form prescribed by the
326326 Department if the basic information contained in the expanded form
327327 complies with the form prescribed by the Department.
328328 6. The Department and the board of trustees of each school
329329 district shall, at least once each year, review and amend their
330330 respective educational involvement accords.]
331331 Sec. 5. NRS 390.700 and 392.456 are hereby repealed.
332332 Sec. 6. 1. This section becomes effective upon passage and
333333 approval.
334334 2. Sections 3, 4 and 5 of this act become effective:
335335 (a) Upon passage and approval for the purpose of adopting any
336336 regulations and performing any other preparatory administrative
337337 tasks that are necessary to carry out the provisions of this act; and

342342 (b) On July 1, 2023, for all other purposes.
343343 3. Sections 1 and 2 of this act become effective on July 1,
