2929 AN ACT relating to education; revising provisions relating to

3737 Legislative Counsel’s Digest:
3838 Existing law requires the preparation of an annual report of accountability for 1
3939 each school district and sponsor of charter schools in this State, as well as for all 2
4040 public schools in the State as a whole. (NRS 385A.010-385A.520) Existing law 3
4141 imposes certain duties on the Superintendent of Public Instruction relating to the 4
4242 accountability of public schools. (NRS 385A.080) Section 3.3 of this bill 5
4343 additionally requires the Superintendent to establish metrics of performance for 6
4444 public schools for each grade and, along with each school district and charter 7
4545 school, publish such metrics on their respective Internet websites and report data on 8
4646 such metrics to the Governor, State Board of Education and Director of the 9
4747 Legislative Counsel Bureau for transmission to the Joint Interim Standing 10
4848 Committee on Education. 11
4949 Existing law creates the Education Stabilization Account in the State Education 12

7575 and Means or Interim Finance Committee. Section 4.5 of this bill expands the 34
7676 duties of the Commission by requiring the Commission to: (1) review the academic 35
7777 progress made by pupils in each public school; and (2) review and consider 36
7878 strategies to improve the accessibility and ensure the equitability of existing and 37
7979 new programs within and between public schools. Section 7.5 of this bill: (1) 38
8080 expires the terms of incumbent members of the Commission on June 30, 2023; (2) 39
8181 requires the appointment or reappointment of members of the Commission on or 40
8282 before July 1, 2023, to staggered terms; and (3) requires the Commission to hold its 41
8383 first meeting during Fiscal Year 2023-2024 on or before September 1, 2023. 42
8484 Section 7 of this bill requires the Commission to conduct interim studies on 43
8585 school funding and school accountability. Section 7 requires the interim study on 44
8686 school funding to examine topics relating to: (1) the funding of building 45
8787 improvement and modernization projects by small school districts; (2) the number 46
8888 of professional educators graduating from institutions of higher education in this 47
8989 State; (3) the classification and compensation of professional educators and support 48
9090 personnel at public schools; and (4) changes to the laws governing sales and use tax 49
9191 and property tax to fully fund public schools in this State at an optimal level of 50
9292 funding. Section 7 requires the interim study on school accountability to include 51
9393 recommendations for performance metrics to assess the impact of increased 52
9494 investments in K-12 public education and accountability measures to ensure the 53
95-effective use of such investments. Section 6 of this bill appropriates $500,000 from 54
96-the State General Fund to the Commission for the cost of the studies required by 55
97-section 7. Sections 6.3 and 6.5 of this bill appropriate money for the payment of 56

138138 by the representatives with respect to the program. 26
139139 (d) Establish metrics of performance for public schools for 27
140140 each grade which include, without limitation, metrics for: 28
141141 (1) The growth and proficiency of pupils in literacy, 29
142142 mathematics and science; 30
143143 (2) The engagement and proficiency of pupils in courses 31
144144 for college and career readiness; and 32
145145 (3) The retention and recruitment of teachers and 33
146146 education support professionals. 34
147147 2. The Superintendent of Public Instruction may consult with 35
148148 representatives of parent groups other than the Nevada Parent 36
149149 Teacher Association concerning the program adopted pursuant to 37
150150 subsection 1 of NRS 385A.070 and consider any advice or 38
151151 recommendations submitted by the representatives with respect to 39
152152 the program. 40
153153 3. The Superintendent of Public Instruction and each school 41
154154 district and charter school shall: 42
155155 (a) Publish the metrics established pursuant to paragraph (d) 43

166166 Sec. 3.5. NRS 387.1213 is hereby amended to read as follows: 6
167167 387.1213 1. The Education Stabilization Account is hereby 7
168168 created in the State Education Fund. Except as otherwise provided 8
169169 in subsections 3 and 4, each year after the close of the previous 9
170170 fiscal year and before the issuance of the State Controller’s annual 10
171171 report, each county school district shall transfer from the county 11
172172 school district fund to the Education Stabilization Account any 12
173173 amount by which the budgeted ending fund balance of the county 13
174174 school district fund exceeds 16.6 percent of the total budgeted 14
175175 expenditures for the fund. The interest and income earned on the 15
176176 money in the Account, after deducting any applicable charges, must 16
177177 be credited to the Account. 17
178178 2. Money transferred pursuant to subsection 1 to the Education 18
179179 Stabilization Account is a continuing appropriation solely for the 19
180180 purpose of authorizing the expenditure of the transferred money for 20
181181 the purposes set forth in this section. 21
182182 3. The balance in the Education Stabilization Account must not 22
183183 exceed 15 percent of the total of all appropriations and 23
184184 authorizations from the State Education Fund, excluding the 24
185185 Education Stabilization Account, for the immediately preceding 25
186186 fiscal year. Any money transferred to the Education Stabilization 26
187187 Account which exceeds this amount must instead be transferred to 27
188188 the State Education Fund. 28
189189 4. If the Interim Finance Committee finds that: 29
190190 (a) Upon submission of a request from the Department, the 30
191191 actual enrollment growth for a fiscal year exceeds the projected 31
192192 enrollment growth by an amount that the Interim Finance 32
193193 Committee determines would make a transfer of money to the State 33
194194 Education Fund necessary to fund the excess enrollment; [or] 34
195195 (b) The collection of revenue in any fiscal year will result in the 35
196196 State Education Fund receiving 97 percent or less of the money 36
197197 authorized for expenditure from the State Education Fund [,] ; 37
198198 (c) Upon submission of a request from the Department, any 38
199199 amount of money which was deposited in the State Education 39
200200 Fund is found by an audit to have been deposited in error; or 40
201201 (d) Upon submission of a request from the Department, any 41
202202 error in the application of the Pupil-Centered Funding Plan by the 42
203203 Department has created a shortfall in the State Education Fund, 43
204204  the Committee shall by resolution establish an amount of money 44

213213 5. The balance remaining in the State Education Fund, 4
214214 excluding the balance remaining in the Education Stabilization 5
215215 Account, that has not been committed for expenditure on or before 6
216216 June 30 of an odd-numbered fiscal year must be transferred to the 7
217217 Education Stabilization Account to the extent that such a transfer 8
218218 would not cause the balance in the Education Stabilization Account 9
219219 to exceed the limit established in subsection 3. 10
220220 Sec. 4. NRS 387.1246 is hereby amended to read as follows: 11
221221 387.1246 1. The Commission on School Funding, consisting 12
222222 of 11 members, is hereby created. 13
223223 2. The Commission consists of the following members, who 14
224224 may not be Legislators: 15
225225 (a) One member appointed by the Governor, who serves as 16
226226 Chair; 17
227227 (b) Two members appointed by the Majority Leader of the 18
228228 Senate; 19
229229 (c) Two members appointed by the Speaker of the Assembly; 20
230230 (d) One member appointed by the Minority Leader of the 21
231231 Senate; 22
232232 (e) One member appointed by the Minority Leader of the 23
233233 Assembly; 24
234234 (f) Two members appointed by the Governor, each of whom is 25
235235 the chief financial officer of a school district in this State which has 26
236236 more than 40,000 pupils enrolled in its public schools, nominated by 27
237237 the Nevada Association of School Superintendents or its successor 28
238238 organization; and 29
239239 (g) Two members appointed by the Governor, each of whom is 30
240240 the chief financial officer of a school district in this State which has 31
241241 40,000 or fewer pupils enrolled in its public schools, nominated by 32
242242 the Nevada Association of School Superintendents or its successor 33
243243 organization. 34
244244  In making appointments to the Commission, the appointing 35
245245 authorities shall consider whether the membership generally reflects 36
246246 the geographic distribution of pupils in the State. 37
247247 3. Each member of the Commission must: 38
248248 (a) Be a resident of this State; 39
249249 (b) Not have been registered as a lobbyist pursuant to NRS 40
250250 218H.200 for a period of at least 2 years immediately preceding 41
251251 appointment to the Commission; 42
252252 (c) Have relevant experience in public education; 43
253253 (d) Have relevant experience in fiscal policy, school finance or 44
254254 similar or related financial activities; 45

259259 (e) Have the education, experience and skills necessary to 1
260260 effectively execute the duties and responsibilities of a member of 2
261261 the Commission; and 3
262262 (f) Have demonstrated ability in the field of economics, taxation 4
263263 or other discipline necessary to school finance and be able to bring 5
264264 knowledge and professional judgment to the deliberations of the 6
265265 Commission. 7
266266 4. Each member of the Commission serves a term of 3 years 8
267267 and may be reappointed to additional terms. 9
268268 5. Each member may be removed by the appointing authority 10
269269 for good cause. A vacancy on the Commission must be filled in the 11
270270 same manner as the original appointment. 12
271271 6. The Commission shall: 13
272272 (a) Elect a Vice Chair from among its members at its first 14
273273 meeting for a term of 3 years. A vacancy in the office of Vice Chair 15
274274 must be filled by the Commission by election for the remainder of 16
275275 the existing term. 17
276276 (b) Adopt such rules governing the conduct of the Commission 18
277277 as it deems necessary. 19
278278 (c) [Hold its first meeting on or before October 1, 2019,] Meet 20
279279 at least once each month and hold such [additional] number of 21
280280 meetings as may be necessary to accomplish the tasks assigned to it 22
281281 in the time allotted. 23
282282 (d) Meet in person or, at the discretion of the Chair in 24
283283 consultation with the Superintendent of Public Instruction based 25
284284 on the items on the agenda for a meeting, by use of a remote 26
285285 technology system, as defined in NRS 241.015. 27
286286 7. A majority of the members of the Commission constitutes a 28
287287 quorum and a majority of those present must concur in any decision. 29
288288 8. The Department shall provide the Commission with meeting 30
289289 rooms, data processing services and administrative and clerical 31
290290 assistance. The Superintendent of Public Instruction and Office of 32
291291 Finance shall jointly provide the Commission with professional staff 33
292292 services. 34
293293 9. While engaged in the business of the Commission, each 35
294294 member is entitled to receive the per diem allowance and travel 36
295295 expenses provided for state officers and employees generally. 37
296296 10. The Commission may meet only [between] : 38
297297 (a) Between July 1 of an odd -numbered year and 39
298298 [September 30] December 31 of the subsequent even-numbered 40
299299 year [.] ; or 41
300300 (b) During any regular or special session of the Legislature, if 42
301301 requested to do so by the chair of the: 43
302302 (1) Senate Standing Committee on Education; 44

315315 the implementation of the Pupil-Centered Funding Plan. 8
316316 (b) Monitor the implementation of the Pupil-Centered Funding 9
317317 Plan and make any recommendations to the Joint Interim Standing 10
318318 Committee on Education that the Commission determines would, 11
319319 within the limits of appropriated funding, improve the 12
320320 implementation of the Pupil-Centered Funding Plan or correct any 13
321321 deficiencies of the Department or any school district or public 14
322322 school in carrying out the Pupil-Centered Funding Plan. 15
323323 (c) Review the statewide base per pupil funding amount, the 16
324324 adjusted base per pupil funding for each school district and the 17
325325 multiplier for weighted funding for each category of pupils 18
326326 appropriated by law pursuant to NRS 387.1214 for each biennium 19
327327 and recommend any revisions the Commission determines to be 20
328328 appropriate to create an optimal level of funding for the public 21
329329 schools in this State, including, without limitation, by 22
330330 recommending the creation or elimination of one or more categories 23
331331 of pupils to receive additional weighted funding. If the Commission 24
332332 makes a recommendation pursuant to this paragraph which would 25
333333 require more money to implement than was appropriated from the 26
334334 State Education Fund in the immediately preceding biennium, 27
335335 the Commission shall also identify a method to fully fund the 28
336336 recommendation within 10 years after the date of the 29
337337 recommendation. 30
338338 (d) Review the laws and regulations of this State relating to 31
339339 education, make recommendations to the Joint Interim Standing 32
340340 Committee on Education for any revision of such laws and 33
341341 regulations that the Commission determines would improve the 34
342342 efficiency or effectiveness of public education in this State and 35
343343 notify each school district of each such recommendation. 36
344344 (e) Review and recommend to the Department revisions of the 37
345345 cost adjustment factors for each county established pursuant to NRS 38
346346 387.1215 and the method for calculating the attendance area 39
347347 adjustment established pursuant to NRS 387.1218. 40
348348 (f) Review the academic progress made by pupils in each 41
349349 public school since the implementation of the Pupil-Centered 42
350350 Funding Plan, including, without limitation, any changes to the 43
351351 academic progress of such pupils as the result of any additional 44
352352 money provided to each such school by the Pupil-Centered 45

357357 Funding Plan. In performing such a review, the Commission 1
358358 shall: 2
359359 (1) Use metrics to measure the academic achievement of 3
360360 pupils which include, without limitation: 4
361361 (I) The rate of graduation of pupils from high school by 5
362362 type of diploma; 6
363363 (II) The performance of pupils on standardized 7
364364 examinations in math, reading and science; 8
365365 (III) The number of credentials or other certifications in 9
366366 fields of career and technical education earned by pupils; 10
367367 (IV) The number of pupils who earn a passing score on 11
368368 an advanced placement examination; 12
369369 (V) The number of pupils who earn a passing score on 13
370370 an international baccalaureate examination; 14
371371 (VI) The percentage of pupils in each school who lack a 15
372372 sufficient number of credits to graduate by the end of their 12th 16
373373 grade year; 17
374374 (VII) The percentage of pupils in each school who drop 18
375375 out; 19
376376 (VIII) The number of pupils who enroll in higher 20
377377 education upon graduation; 21
378378 (IX) The number of pupils who enroll in a vocational or 22
379379 technical school or apprenticeship training program; 23
380380 (X) The attendance rate for pupils; 24
381381 (XI) The number of violent acts by pupils and 25
382382 disciplinary actions against pupils; and 26
383383 (XII) Any other metric prescribed by the Commission; 27
384384 (2) Use metrics to measure the improvement of pupils 28
385385 enrolled in elementary school in literacy which include, without 29
386386 limitation: 30
387387 (I) The literacy rate for pupils in first, third and fifth 31
388388 grades; 32
389389 (II) The number of pupils in elementary school who 33
390390 were promoted to the next grade after testing below proficient in 34
391391 reading in the immediately preceding school year, separated by 35
392392 grade level and by level of performance on the relevant test; 36
393393 (III) The number of schools that employ a licensed 37
394394 teacher designated to serve as a literacy specialist pursuant to NRS 38
395395 388.159 and the number of schools that fail to employ and 39
396396 designate such a licensed teacher; and 40
397397 (IV) Any other metric prescribed by the Commission; 41
398398 (3) Use metrics to measure the ability of public schools to 42
399399 hire and retain sufficient staff to meet the needs of the public 43
400400 schools which include, without limitation: 44

405405 (I) The rate of vacancies in positions for teachers, 1
406406 support staff and administrators; 2
407407 (II) The attendance rate for teachers; 3
408408 (III) The retention rate for teachers; 4
409409 (IV) The number of schools and classrooms within each 5
410410 school in which the number of pupils in attendance exceeds the 6
411411 designed capacity for the school or classroom; 7
412412 (V) The number of classes taught by a substitute teacher 8
413413 for more than 25 percent of the school year; and 9
414414 (VI) Any other metric prescribed by the Commission; 10
415415 (4) Use metrics to measure the extent to which schools meet 11
416416 the needs and expectations of pupils, parents or legal guardians of 12
417417 pupils, teachers and administrators which include, without 13
418418 limitation: 14
419419 (I) The results of an annual survey of satisfaction of 15
420420 school employees; 16
421421 (II) The results of an annual survey of satisfaction of 17
422422 pupils, parents or legal guardians of pupils and graduates; and 18
423423 (III) Any other metric prescribed by the Commission; 19
424424 (5) Identify the progress made by each school, school 20
425425 district and charter school on improving the literacy of pupils 21
426426 enrolled in elementary school; 22
427427 (6) Make recommendations for strategies to increase the 23
428428 efficacy, efficiency, transparency and accountability of public 24
429429 schools; and 25
430430 (7) Make recommendations to the Department, school 26
431431 districts and charter schools to improve the reporting, tracking, 27
432432 monitoring, analyzing and dissemination of data relating to pupil 28
433433 achievement and financial accountability, including, without 29
434434 limitation, revisions to the metrics identified in subparagraphs (1) 30
435435 to (4), inclusive. 31
436436 (g) Review and consider strategies to improve the accessibility 32
437437 and ensure the equitability of existing and new programs for 33
438438 pupils within and between public schools, including, without 34
439439 limitation, open zoning. 35
440440 2. The Commission shall present any recommendations 36
441441 pursuant to paragraphs (a) to (d), inclusive, of subsection 1 at a 37
442442 meeting of the Joint Interim Standing Committee on Education for 38
443443 consideration and revision by the Committee. The Joint Interim 39
444444 Standing Committee on Education shall review each 40
445445 recommendation of the Commission and determine whether to 41
446446 transmit the recommendation or a revised version of the 42
447447 recommendation to the Governor or the Legislature. 43

471471 created by NRS 387.1246. 19
472472 2. Any remaining balance of the appropriation made by 20
473473 subsection 1 must not be committed for expenditure after June 30, 21
474474 2025, by the entity to which the appropriation is made or any entity 22
475475 to which money from the appropriation is granted or otherwise 23
476476 transferred in any manner, and any portion of the appropriated 24
477477 money remaining must not be spent for any purpose after 25
478478 September 19, 2025, by either the entity to which the money was 26
479479 appropriated or the entity to which the money was subsequently 27
480480 granted or transferred, and must be reverted to the State General 28
481481 Fund on or before September 19, 2025. 29
482482 Sec. 6.5. 1. There is hereby appropriated from the State 30
483483 General Fund to the Department of Education for the payment of 31
484484 travel and per diem expenses for employees of the Department to 32
485485 attend meetings of the Commission on School Funding created by 33
486486 NRS 387.1246 the following sums: 34

505505 Sec. 7. 1. The Commission on School Funding created by 4
506506 NRS 387.1246 shall conduct an interim study concerning school 5
507507 funding. The study must include, without limitation, an examination 6
508508 of: 7
509509 (a) Methods to enable small school districts to acquire capital 8
510510 and engage in building improvement and modernization projects, 9
511511 including, without limitation: 10
512512 (1) The creation of a revolving fund to make loans to small 11
513513 school districts; 12
514514 (2) The allocation of additional funding to the Nevada State 13
515515 Infrastructure Bank and implementation of changes to statute or 14
516516 regulation as necessary to permit the Nevada State Infrastructure 15
517517 Bank to provide financial assistance to smaller school districts; and 16
518518 (3) Financial assistance through the Municipal Bond Bank 17
519519 pursuant to NRS 350A.010 to 350A.210, inclusive. 18
520520 (b) [Recommendations for performance metrics to assess the 19
521521 impact of increased investments in K-12 public education and 20
522522 accountability measures to ensure the effective use of such 21
523523 investments in K-12 public education. 22
524524 (c)] The number of teachers graduating from institutions of 23
525525 higher education in this State each year relative to the number of 24
526526 teacher positions sought to be filled by school districts in this State 25
527527 each year. 26
528528 [(d)] (c) The classification and compensation of teachers and 27
529529 support personnel at public schools in this State and whether 28
530530 insufficient compensation is contributing to the difficulty in 29
531531 attracting and retaining teachers and support personnel at public 30
532532 schools. 31
533533 [(e)] (d) Recommendations for changes to the laws governing 32
534534 sales and use tax and property tax to fully fund public schools in this 33
535535 State at an optimal level of funding. 34
536536 2. The Commission on School Funding created by NRS 35
537537 387.1246 shall conduct an interim study concerning school 36
538538 accountability. The study must include, without limitation, 37
539539 recommendations for performance metrics to assess the impact of 38
540540 increased investments in K-12 public education and accountability 39
541541 measures to ensure the effective use of such investments in K-12 40
542542 public education. 41
543543 3. On or before November 15, 2024, the Commission shall 42
544544 submit a report of its findings [,] from the studies performed 43
545545 pursuant to subsections 1 and 2, including, without limitation, any 44
546546 recommendations for legislation, to the Governor and the Director 45

553553 Sec. 7.5. 1. The terms of the members of the Commission on 3
554554 School Funding appointed pursuant to NRS 387.1246 who are 4
555555 incumbent on June 30, 2023, expire on that date. 5
556556 2. Notwithstanding the provisions of subsection 4 of NRS 6
557557 387.1246, as amended by section 4 of this act, on or before July 1, 7
558558 2023: 8
559559 (a) The Governor shall: 9
560560 (1) Appoint to the Commission on School Funding to serve 10
561561 initial terms that expire on July 1, 2025: 11
562562 (I) One member described in paragraph (f) of subsection 12
563563 2 of NRS 387.1246, as amended by section 4 of this act. 13
564564 (II) One member described in paragraph (g) of subsection 14
565565 2 of NRS 387.1246, as amended by section 4 of this act. 15
566566 (2) Appoint to the Commission on School Funding to serve 16
567567 an initial term that expires on July 1, 2026: 17
568568 (I) One member described in paragraph (a) of subsection 18
569569 2 of NRS 387.1246, as amended by section 4 of this act. 19
570570 (II) One member described in paragraph (f) of subsection 20
571571 2 of NRS 387.1246, as amended by section 4 of this act. 21

574574 (b) The Majority Leader of the Senate shall: 24
575575 (1) Appoint to the Commission on School Funding to serve 25
576576 an initial term that expires on July 1, 2025, one member described in 26
577577 paragraph (b) of subsection 2 of NRS 387.1246, as amended by 27
578578 section 4 of this act. 28
579579 (2) Appoint to the Commission on School Funding to serve 29
580580 an initial term that expires on July 1, 2026, one member described in 30
581581 paragraph (b) of subsection 2 of NRS 387.1246, as amended by 31
582582 section 4 of this act. 32
583583 (c) The Speaker of the Assembly shall: 33
584584 (1) Appoint to the Commission on School Funding to serve 34
585585 an initial term that expires on July 1, 2025, one member described in 35
586586 paragraph (c) of subsection 2 of NRS 387.1246, as amended by 36
587587 section 4 of this act. 37
588588 (2) Appoint to the Commission on School Funding to serve 38
589589 an initial term that expires on July 1, 2026, one member described in 39
590590 paragraph (c) of subsection 2 of NRS 387.1246, as amended by 40
591591 section 4 of this act. 41
592592 (d) The Minority Leader of the Senate shall appoint to the 42
593593 Commission on School Funding to serve an initial term that expires 43
594594 on July 1, 2026, one member described in paragraph (d) of 44
595595 subsection 2 of NRS 387.1246, as amended by section 4 of this act. 45

600600 (e) The Minority Leader of the Assembly shall appoint to the 1
601601 Commission on School Funding to serve an initial term that expires 2
602602 on July 1, 2025, one member described in paragraph (e) of 3
603603 subsection 2 of NRS 387.1246, as amended by section 4 of this act. 4
604604 3. The Governor, Majority Leader of the Senate, Speaker of the 5
605605 Assembly, Minority Leader of the Senate and Minority Leader of 6
606606 the Assembly may reappoint a member of the Commission on 7
607607 School Funding whose term expires on June 30, 2023, if that 8
608608 member meets the qualifications for membership prescribed by 9
609609 subsection 2 of NRS 387.1246, as amended by section 4 of this act. 10
610610 4. The Commission on School Funding shall hold its first 11
611611 meeting during Fiscal Year 2023-2024 not later than September 1, 12
612612 2023. 13
613613 5. As used in this section, “Commission on School Funding” 14
614614 means the Commission on School Funding created by NRS 15
615615 387.1246, as amended by section 4 of this act. 16
616616 Sec. 8. This act becomes effective on July 1, 2023. 17
