2828 AN ACT relating to state purchasing; providing for the disposition

3131 Legislative Counsel’s Digest:
3232 Existing law sets forth various procedures for public purchasing by state 1
3333 agencies in the Executive Department of the State Government, known as “using 2
3434 agencies.” (NRS 333.020, 333.250-333.460) Existing law further creates the 3
3535 Account to Stabilize the Operation of State Government in the State General Fund, 4
3636 commonly known as the Rainy Day Fund. (NRS 353.288) 5
3737 This bill provides for the disposition of money received by the State in the form 6
3838 of rebates for purchases made by using charge cards issued to using agencies or 7
3939 their authorized representatives, commonly known as “procurement cards,” where 8
4040 the disposition is not otherwise prohibited by law or any other restriction on the use 9
4141 or disposition of the money used for such a purchase. Under the provisions of this 10
4242 bill, after deducting administrative costs: (1) 50 percent of any such rebate must be 11
4343 deposited into the Account to Stabilize the Operation of the State Government; and 12
4444 (2) the other 50 percent must be given to the using agency that made the purchase. 13
4545 Such money deposited into the Rainy Day Fund must not be used to replace or 14
4646 supplant funding from other sources. Also, such money received by the using 15
4747 agency: (1) must not be used to replace or supplant funding from other sources; and 16
4848 (2) may be used at the discretion of the head of the agency. 17

5656 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

5858 Section 1. Chapter 333 of NRS is hereby amended by adding 1
5959 thereto a new section to read as follows: 2
6060 1. Except as otherwise prohibited by law or any other 3
6161 applicable restriction on the use or disposition of the money used 4
6262 for the purchase, any money provided to the State in the form of a 5
6363 rebate for a purchase made with a procurement card must, after 6
6464 deducting administrative costs, be distributed as follows: 7
6565 (a) Fifty percent must be deposited into the Account to 8
6666 Stabilize the Operation of the State Government created by NRS 9
6767 353.288; and 10
6868 (b) Fifty percent must be given to the using agency that made 11
6969 the purchase. 12

7272 State Government pursuant to subsection 1 must not be used to 15
