AN ACT relating to state purchasing; providing for the disposition of rebates for purchases made with procurement cards; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law sets forth various procedures for public purchasing by state 1 agencies in the Executive Department of the State Government, known as “using 2 agencies.” (NRS 333.020, 333.250-333.460) Existing law further creates the 3 Account to Stabilize the Operation of State Government in the State General Fund, 4 commonly known as the Rainy Day Fund. (NRS 353.288) 5 This bill provides for the disposition of money received by the State in the form 6 of rebates for purchases made by using charge cards issued to using agencies or 7 their authorized representatives, commonly known as “procurement cards,” where 8 the disposition is not otherwise prohibited by law or any other restriction on the use 9 or disposition of the money used for such a purchase. Under the provisions of this 10 bill, after deducting administrative costs: (1) 50 percent of any such rebate must be 11 deposited into the Account to Stabilize the Operation of the State Government; and 12 (2) the other 50 percent must be given to the using agency that made the purchase. 13 Such money deposited into the Rainy Day Fund must not be used to replace or 14 supplant funding from other sources. Also, such money received by the using 15 agency: (1) must not be used to replace or supplant funding from other sources; and 16 (2) may be used at the discretion of the head of the agency. 17 – 2 – - *AB2* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 333 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 1. Except as otherwise prohibited by law or any other 3 applicable restriction on the use or disposition of the money used 4 for the purchase, any money provided to the State in the form of a 5 rebate for a purchase made with a procurement card must, after 6 deducting administrative costs, be distributed as follows: 7 (a) Fifty percent must be deposited into the Account to 8 Stabilize the Operation of the State Government created by NRS 9 353.288; and 10 (b) Fifty percent must be given to the using agency that made 11 the purchase. 12 2. The money: 13 (a) Deposited into the Account to Stabilize the Operation of the 14 State Government pursuant to subsection 1 must not be used to 15 replace or supplant funding available from other sources. 16 (b) Received by a using agency pursuant to subsection 1: 17 (1) Must not be used to replace or supplant funding 18 available from other sources; and 19 (2) May be used at the discretion of the head of the using 20 agency. 21 3. As used in this section, “procurement card” means a 22 charge card issued to a using agency or its authorized 23 representative for the purchase of goods and services pursuant to 24 the provisions of this chapter. 25 Sec. 2.
