Prohibits the search, with or without a warrant, of geolocation and keyword data of a group of people who are under no individual suspicion of having committed a crime, but rather are defined by having been at a given location at a given time or searched particular words, phrases, character strings, or websites.
Permits an application for an order that a witness or prospective witness who is over the age of seventy-five be examined conditionally under oath in order that such testimony may be received into evidence at subsequent proceedings in or related to the action.
Establishes the crime of failure to retreat when a person who is within twenty-five feet of a police officer or peace officer engaged in the performance of his or her duties and the police officer or peace officer orders such person to halt or retreat and the person fails to do so immediately; requires the posting of bail.
Requires the notice to crime victims of case disposition to inform the victim that he or she has the right to attend interviews between the board of parole and the incarcerated individual in cases where the final disposition includes a felony defined in article one hundred twenty-five of the penal law that results in the commitment of the defendant to the custody of the department of corrections and community supervision for an indeterminate sentence; requires the board of parole to review victim impact statements, failure to review such statements shall make a hearing by the board of parole invalid.
Relates to expanding the geographical area of employment of university police officers; extends the jurisdiction of New York state university police officers from state university of New York property and abutting roadways to all areas of the state.
Requires the prosecution to disclose to defense counsel certain information relating to jailhouse informants; requires prosecutors to notify victims of the informant's crimes if the prosecutor has offered the informant a benefit in exchange for testimony or other cooperation.
Establishes the crime of assault on sports officials and aggravated harassment of a sports official; makes aggravated harassment of a sports official a class B misdemeanor; requires the state education department to establish an information campaign to be distributed to all youth and school sports programs requiring such programs to disseminate information to parents and other spectators of such programs on the protections afforded sports officials.
Provides that the period of immunity from prosecution for a criminal or civil action that a defendant is entitled to by virtue of holding the office of president of the United States shall not apply to the calculation of the time limitation applicable to commencement of such actions.
Relates to gun buy back programs; requires entities operating such programs to check the serial number of all firearms obtained against the NYSPIN records and to obtain the express permission of the lawful owner of any firearm found to be stolen before the destruction thereof.
