Increases the number of members of the public health and health planning council from 25 to 26; requires that a representative of freestanding ambulatory surgery centers be selected as a member of the public health and health planning council.
Requires notice and additional review for managed care providers of the methodologies and fee schedules and other materials used for determining medicaid reimbursement rates.
Requires that if a person is treated at a hospital and such hospital conducts a urine drug screening to assist in diagnosing the person's condition, the hospital shall include testing for fentanyl in such urine drug screening; defines urine drug screening.
Allows a practitioner in a hospital without a full-time pharmacy to dispense to a patient in a hospital emergency room for use off the premises a 24 hour supply of certain drugs, unless the federal drug enforcement administration has authorized a longer time period for the purpose of initiating maintenance treatment, detoxification treatment, or both.
Relates to municipal limited health care service facilities; diagnostic or treatment centers or other facilities managed and administered by a local health department for the purpose of providing limited health care services.
Provides for availability of ambulance services and advanced life support first response service to store and distribute blood and initiate and administer blood transfusions, by expanding current provisions for air transport to apply additionally to motor vehicle based ambulance services.
Directs the center for agricultural medicine and health to design and create silo safety warning placards and a silo safety advocacy program; creates a silo safety fund and state income tax gift option for funding of such placards and advocacy program.
Requires that newborns are tested for duchenne muscular dystrophy using a test validated by the Wadsworth center for laboratories and research; directs the Wadsworth center for laboratories and research to begin the process of testing validation upon the development of a test for duchenne muscular dystrophy.
Relates to certain prohibitions in contracts or agreements by health maintenance organizations; prohibits clauses which entitle reimbursement at the lowest price or rate; prohibits contracts which restrict referral of patients based solely upon a health care provider's status with a managed care product; prohibits contracts which allow for the substitution of a pharmaceutical drug or agent by any person other than the prescribing health care professional.
Relates to the definition of elevated blood lead levels; provides that elevated lead levels means a blood lead level greater than or equal to 3.5 micrograms of lead per deciliter of whole blood or such lower blood lead level as may be established by the department of health pursuant to rule or regulation.
