Includes additional definitions for procedures relating to state purchasing of tropical hardwoods; requires state to maximize the use of environmentally preferable building materials; requires use of information provided by forest certifiers; requires the department of environmental conservation to develop a list of eligible forest certifiers and a chain of custody certifiers.
Requires state agency and authority public works contracts to include a clause authorizing contractors to recover reasonable damages for delay under limited circumstances.
Requires state agencies that issue requests for proposals to provide notification to elected officials for requests for proposals for projects in excess of ten million dollars.
Provides that the director of the division of minority and women's business development shall establish a procedure enabling the office to grant temporary certification to minority and women-owned business enterprise applicants which attest in the certification application that the business enterprise is intending to participate in the medical cannabis or adult-use cannabis industries.
Provides that guidelines by the state procurement council shall include certain preferences for any business located in a county within the state with a population of less than one million based on the latest federal decennial census or any small business as such term is defined in section one hundred thirty-one of the economic development law.
Relates to purchasing restrictions and investment of certain public funds in persons that contract to build a border wall; requires the commissioner to develop and publish, using credible information available to the public, a list of persons determined by the commissioner, that have contracted to build a border wall.
Directs contracting state agencies to develop a growth plan in order to increase participation of minority- and women-owned businesses with respect to state contracts and subcontracts which includes an analyses of the use of discretionary buying.
Relates to requiring agencies to provide unsuccessful bidders that are certified minority- and women-owned business enterprises with a written statement of the completion of the procurement selection process and that such enterprise was not selected.
Encourages the participation of minority- and women-owned business enterprises in state contracts by avoiding unnecessary and unjustified bundling of contract requirements that preclude minority- and women-owned business participation.
Relates to RFPs for gun violence reduction; provides that any state agency that issues an RFP relating to gun violence reduction shall establish a coordination plan including all awardees; requires that such coordination plans shall be in a form as prescribed by the department of state; requires that at a minimum, such coordination plan shall help ensure complete coverage of the area for which such RFP is issued and minimize competition between awardees.
Requires contracting agencies to contact minority and women-owned business enterprises when such enterprise is listed on a utilization plan and when a contract is awarded; mandates that the prime contractor use such enterprise identified on the utilization plan, unless such enterprise cannot perform or is no longer state certified.
Requires a separate section in the annual report of the director of the division of minority and women's business development detailing every instance of an entity fraudulently representing itself as a minority and women-owned business enterprise when it was not.
Provides a rebuttable presumption relating to recertification as a minority and women-owned business enterprise if there is no change in the ownership of the enterprise and no material change in the nature or management of the enterprise from the time of approval of the previous minority and women-owned business enterprise certification.
