BENDETT -- read once and referred to the Commit- tee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT authorizing the town of Kinderhook to transfer ownership of certain parkland to the Valatie Volunteer Rescue Squad, Inc. The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. (a) Subject to the provisions of this act, the town of 2 Kinderhook, county of Columbia, acting through its governing body is 3 hereby authorized to discontinue the use of town parkland more partic- 4 ularly described in section two of this act, and to convey its interest 5 in the real property to the Valatie Volunteer Rescue Squad, Inc. upon 6 terms agreed upon by the town of Kinderhook and the Valatie Volunteer 7 Rescue Squad, Inc. for use by the Valatie Volunteer Rescue Squad, Inc. 8 for the purpose of providing emergency medical services to the town of 9 Kinderhook. 10 (b) Any revenues received by the town of Kinderhook from the transfer 11 shall be used for capital improvements of existing park or recreational 12 and/or the acquisition of additional park or recreational facilities. 13 § 2. The parklands authorized to be conveyed by the town of Kinderhook 14 in section one of this act are located, bounded and described as 15 follows: 16 ALL that certain piece or parcel of land, situate, lying and being in 17 the Town of Kinderhook, County of Columbia, and State of New York, 18 bounded and described as follows: 19 BEGINNING at a steel pin at the southwesterly corner of the parcel 20 herein to be described, said point of beginning being at the southeast- 21 erly corner of the lands now or formerly of The State of New York said 22 point of beginning being further referenced as S 66°10'52" E a distance 23 of 380.86 feet from a steel pin on the easterly side of a Town of 24 Kinderhook highway commonly known as State Farm Road; 25 thence from said point of beginning and along lands of said State of New 26 York: N 34°15'00" E a distance of 456.84 feet to a point; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD14664-02-4A. 9847--A 2 1 Thence through lands of the Town of Kinderhook on the following four 2 courses; 3 S 62°25'13" E a distance of 602.24 feet to a point; 4 S 32°59'21" W a distance of 370.14 feet to a point; 5 N 89°51'57" W a distance of 110.48 feet to a point; 6 N 66°10'52" W a distance of 523.50 feet to the point of beginning; 7 having an area of 261069.10 square feet or 5.99 acres of land. 8 Subject to any and all easements of record. 9 § 3. Should the lands described in section two of this act cease to be 10 used for the purposes described in section one of this act, those lands 11 shall revert to the town of Kinderhook for public park and recreational 12 purposes. 13 § 4. In the event that the town of Kinderhook received any funding 14 support or assistance from the federal government for the purchase, 15 maintenance or improvement of the parklands set forth in section two of 16 this act, the discontinuance and alienation of such parkland authorized 17 by the provisions of this act shall not occur until the town of Kinder- 18 hook has complied with any federal requirements pertaining to the alien- 19 ation or conversion of parklands, including satisfying the secretary of 20 the interior that the alienation or conversion complies with all condi- 21 tions which the secretary of the interior deems necessary to ensure the 22 substitution of other lands shall be equivalent in fair market value and 23 usefulness to the lands being alienated or converted. 24 § 5. This act shall take effect immediately.
