MYRIE, BROUK, CLEARE, COMRIE, COONEY, FERNANDEZ, GIANARIS, GONZALEZ, GOUNARDES, HOYLMAN-SIGAL, JACKSON, KRUEGER, RAMOS, SALAZAR, SEPULVEDA, SERRANO, STAVISKY, WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Judici- ary -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to article 1 of the constitution, in relation to the abolition of slavery for persons convicted of crimes 1 Section 1. Resolved (if the Assembly concur), That article 1 of the 2 constitution be amended by adding a new section 20 to read as follows: 3 § 20. Abolition of slavery for persons convicted of crimes. Neither 4 slavery nor involuntary servitude shall exist in the state of New York 5 for persons convicted of crimes. No incarcerated individual in any 6 state or local prison, penitentiary, jail or reformatory shall be 7 compelled or induced to provide labor against his or her will by actual 8 or threatened force, punishment, sexual assault, or by any other means 9 reasonably likely to cause the incarcerated individual to believe that 10 if they do not provide such labor that they or another person would 11 suffer physical, emotional or mental harm, or other adverse conse- 12 quences. 13 Any incarcerated individual who voluntarily provides labor shall be 14 entitled to all labor protections that would be provided for work of a 15 similar nature, but for such individual's condition of incarceration. 16 This section shall be self-executing. 17 § 2. Resolved (if the Assembly concur), That the foregoing be referred 18 to the first regular legislative session convening after the next 19 succeeding general election of members of the assembly, and, in conform- 20 ity with section 1 of article 19 of the constitution, be published for 3 21 months previous to the time of such election.
