THOMAS, JACKSON -- read twice and ordered printed, and when printed to be committed to the Committee on Cities 1 -- recommitted to the Committee on Cities 1 in accordance with Senate Rule 6, sec. 8 -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the administrative code of the city of New York and the general municipal law, in relation to requiring internet-based food delivery service providers to post the hyperlink for the online tool to view sanitary inspection letter grades of every food service estab- lishment The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The administrative code of the city of New York is amended 2 by adding a new section 17-195.1 to read as follows: 3 § 17-195.1 Posting of sanitary inspection grade. a. Definition. 4 "Internet-based food delivery service provider" shall mean any food 5 service establishment as defined in section 81.03 of the health code of 6 the city of New York that accepts food orders for delivery from custom- 7 ers via the internet, or any third-party website that accepts food 8 orders for delivery from customers via the internet. 9 b. Every internet-based food delivery service provider shall conspicu- 10 ously post on their website, including any mobile application, a hyper- 11 link to the city of New York's health department food establishments 12 lookup tool which lists the most current sanitary inspection letter 13 grade of any food service establishment, pursuant to section 81.51 of 14 the health code of the city of New York, for which food delivery 15 services are provided to customers. 16 c. Any internet-based food delivery service provider that violates 17 subdivision b of this section or any of the rules promulgated thereunder EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted.  S. 509--A 2 1 shall be liable for a civil penalty not to exceed one hundred dollars 2 for each violation. 3 § 2. The general municipal law is amended by adding a new section 139 4 to read as follows: 5 § 139. Posting of sanitary inspection grade. 1. As used in this 6 section "internet-based food delivery service provider" shall mean any 7 food service establishment that accepts food orders for delivery from 8 customers via the internet, or any third party website that accepts food 9 orders for delivery from customers via the internet. 10 2. In any municipal corporation that has adopted a local law or rule 11 requiring the posting of sanitary inspection results, every internet- 12 based food delivery service provider shall conspicuously post on their 13 website, including any mobile application, a hyperlink to the municipal 14 or state health department food establishments lookup tool which lists 15 the most current sanitary inspection results of any food service estab- 16 lishment located in such municipal corporation for which food delivery 17 services are provided to customers. 18 § 3. This act shall take effect on the one hundred twentieth day after 19 it shall have become a law.
