MANNION, CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Internet and Technology -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and delivered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the state technology law, in relation to requiring state agencies to conform any of their websites to the most current version of the Web Content Accessibility Guidelines adopted by the World Wide Web Consortium for accessibility The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The state technology law is amended by adding a new section 2 103-b to read as follows: 3 § 103-b. Website accessibility; state agencies. 1. Each state agency 4 shall be required to conform any of their websites to the most current 5 version of the Web Content Accessibility Guidelines adopted by the World 6 Wide Web Consortium for accessibility, or any successor standards. This 7 section shall not require an agency to take any action that would result 8 in a fundamental alteration in the nature of a service, program, or 9 activity. 10 2. No later than December thirty-first, two thousand twenty-three, and 11 every two years thereafter, the office designee shall submit to the 12 governor and the legislature a written report that documents the compli- 13 ance of websites maintained by or on behalf of state agencies or state 14 entities with the protocol adopted pursuant to subdivision one of this 15 section. 16 § 2. Subdivisions 20, 21, and 22 of section 103 of the state technolo- 17 gy law, subdivisions 21 and 22 as renumbered by chapter 658 of the laws EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. To issue guidance for state agencies in their compliance with the 4 Web Content Accessibility Guidelines required pursuant to section one 5 hundred three-b of the state technology law. 6 § 3. This act shall take effect on the one hundred eightieth day 7 after it shall have become a law; provided that section two of this act 8 shall take effect on the same date and in the same manner as chapter 658 9 of the laws of 2022 takes effect.
