  STATE OF NEW YORK ________________________________________________________________________ 4185 2025-2026 Regular Sessions  IN SENATE February 3, 2025 ___________ Introduced by Sens. PARKER, ADDABBO, LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Trans- portation AN ACT to amend the vehicle and traffic law, in relation to increasing penalties for leaving the scene of an accident without reporting The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph c of subdivision 2 of section 600 of the vehicle 2 and traffic law, as amended by chapter 497 of the laws of 2022, is 3 amended to read as follows: 4 c. A violation of the provisions of paragraph a of this subdivision 5 resulting solely from the failure of an operator to exhibit [his or her] 6 their license and insurance identification card for the vehicle or 7 exchange the information required in such paragraph shall constitute a 8 class B misdemeanor punishable by a fine of not less than two hundred 9 fifty nor more than five hundred dollars in addition to any other penal- 10 ties provided by law. Any subsequent such violation shall constitute a 11 class A misdemeanor punishable by a fine of not less than five hundred 12 nor more than one thousand dollars in addition to any other penalties 13 provided by law. Any violation of the provisions of paragraph a of this 14 subdivision, other than for the mere failure of an operator to exhibit 15 [his or her] their license and insurance identification card for such 16 vehicle or exchange the information required in such paragraph, shall 17 constitute a class [A misdemeanor] E felony, punishable by a fine of not 18 less than [seven hundred fifty] one thousand dollars nor more than [one] 19 two thousand five hundred dollars in addition to any other penalties 20 provided by law. Any such violation committed by a person after such 21 person has previously been convicted of such a violation shall consti- 22 tute a class [E] D felony, punishable by a fine of not less than [one] 23 two thousand nor more than [three] five thousand dollars in addition to 24 any other penalties provided by law.  S. 4185 2 1 paragraph a of this subdivision, other than for the mere failure of an 2 operator to exhibit [his or her] their license and insurance identifica- 3 tion card for such vehicle or exchange the information required in such 4 paragraph, where the personal injury involved (i) results in serious 5 physical injury, as defined in section 10.00 of the penal law, shall 6 constitute a class E felony, punishable by a fine of not less than one 7 thousand nor more than five thousand dollars in addition to any other 8 penalties provided by law, or (ii) results in death shall constitute a 9 class D felony punishable by a fine of not less than two thousand nor 10 more than five thousand dollars in addition to any other penalties 11 provided by law. 12 § 2. This act shall take effect on the first of November next succeed- 13 ing the date on which it shall have become a law.
