RYAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation -- commit- tee discharged, bill amended, ordered reprinted as amended and recom- mitted to said committee AN ACT to amend the vehicle and traffic law and the parks, recreation and historic preservation law, in relation to vintage snowmobile registrations <B><U>The People of the State of New York, represented in Senate and Assem-</U></B> <B><U>bly, do enact as follows:</U></B> 1 Section 1. Subdivision 4-a of section 2222 of the vehicle and traffic 2 law, as amended by section 1 of part MM of chapter 58 of the laws of 3 2023, is amended to read as follows: 4 4-a. Additional fee. <B><U>(a)</U></B> In addition to the other fees provided for in 5 paragraphs (a), (b) and (c) of subdivision four of this section the 6 commissioner shall, upon application in such cases for the registration 7 of a snowmobile or the renewal thereof, collect the annual one hundred 8 twenty-five dollar fee for residents and one hundred twenty-five dollar 9 fee for nonresidents or a fifty-five dollar fee for residents and 10 fifty-five dollar fee for nonresidents who provide proof, at the time of 11 registration, that such individual is a member of an organized New York 12 state snowmobile club that is a member of the New York state snowmobile 13 association or is a member of an organized New York state snowmobile 14 club that is a trail maintenance entity and a member of the New York 15 state snowmobile association which are imposed by section 21.07 of the 16 parks, recreation and historic preservation law. In the event that an 17 individual seeking snowmobile club membership is unable, for any reason, 18 to secure such club membership, [<B><S>he or she</S></B>] <B><U>they</U></B> may contact the New 19 York state snowmobile association, who shall secure such membership for 20 such person. This fee shall also be collected from dealers at the time 21 of original registration and at the time of each renewal. The commis- 22 sioner shall effectuate regulations regarding what is required as proof EXPLANATION--Matter in <B><U>italics</U></B> (underscored) is new; matter in brackets [<B><S> </S></B>] is old law to be omitted. LBD11538-02-5 </PRE><P CLASS="brk"><PRE WIDTH="108"> S. 7200--A 2 1 of membership in an organized New York state snowmobile club that is a 2 trail maintenance entity and a member of the New York state snowmobile 3 association for the purposes of this subdivision. 4 <B><U>(b) Notwithstanding any provision of law to the contrary, the commis-</U></B> 5 <B><U>sioner is hereby authorized and directed to develop and issue to appli-</U></B> 6 <B><U>cants a special vintage registration for a snowmobile manufactured more</U></B> 7 <B><U>than thirty years prior. Such vintage registration shall be identifi-</U></B> 8 <B><U>able by a vintage registration sticker, have a unique registration</U></B> 9 <B><U>number and be subject to annual renewal. In addition to the fees</U></B> 10 <B><U>collected pursuant to paragraph (f) of subdivision four of this section,</U></B> 11 <B><U>the commissioner shall collect an annual fee of twenty dollars for a</U></B> 12 <B><U>resident and non-resident applicant who provides proof, at the time of</U></B> 13 <B><U>registration, that such individual is a member of an organized New York</U></B> 14 <B><U>state snowmobile club that is a member of the New York state snowmobile</U></B> 15 <B><U>association or is a member of an organized New York state snowmobile</U></B> 16 <B><U>club that is a trail maintenance entity and a member of the New York</U></B> 17 <B><U>state snowmobile association. The commissioner may provide that applica-</U></B> 18 <B><U>tions for a vintage snowmobile registration and the issuing of a vintage</U></B> 19 <B><U>snowmobile registration may only be accepted and processed at one or</U></B> 20 <B><U>more facilities operated by the department either by mail or in person.</U></B> 21 &#167; 2. Subdivision 4 of section 2222 of the vehicle and traffic law is 22 amended by adding a new paragraph (f) to read as follows: 23 <B><U>(f) A fee of five dollars for each individual resident and non-resi-</U></B> 24 <B><U>dent vintage registration.</U></B> 25 &#167; 3. Section 21.07 of the parks, recreation and historic preservation 26 law is amended by adding a new subdivision 3 to read as follows: 27 <B><U>3. Notwithstanding the fee as established in subdivisions one and two</U></B> 28 <B><U>of this section, an individual resident or nonresident registering a</U></B> 29 <B><U>vintage snowmobile who provides proof at the time of registration, that</U></B> 30 <B><U>such individual is a member of an organized New York state snowmobile</U></B> 31 <B><U>club that is a member of the New York state snowmobile association or is</U></B> 32 <B><U>a member of an organized New York state snowmobile club that is a trail</U></B> 33 <B><U>maintenance entity and a member of the New York state snowmobile associ-</U></B> 34 <B><U>ation, shall pay an additional fee of twenty dollars for each vintage</U></B> 35 <B><U>snowmobile for the snowmobile trail development and maintenance fund in</U></B> 36 <B><U>addition to the registration required by the vehicle and traffic law. In</U></B> 37 <B><U>the event that an individual seeking snowmobile club membership is</U></B> 38 <B><U>unable, for any reason, to secure such club membership, they may contact</U></B> 39 <B><U>the New York state snowmobile association, who shall secure such member-</U></B> 40 <B><U>ship for such person.</U></B> 41 &#167; 4. This act shall take effect immediately; provided, however, a 42 special vintage registration for a snowmobile shall not be issued until 43 the commissioner of motor vehicles certifies that the department of 44 motor vehicles is prepared to issue special vintage registrations for 45 snowmobiles; and provided that the commissioner of motor vehicles shall 46 notify the legislative bill drafting commission upon such certification 47 in order that the commission may maintain an accurate and timely effec- 48 tive data base of the official text of the laws of the state of New York 49 in furtherance of effectuating the provisions of section 44 of the 50 legislative law and section 70-b of the public officers law.
