CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the real property law, in relation to succession rights data <B><U>The People of the State of New York, represented in Senate and Assem-</U></B> <B><U>bly, do enact as follows:</U></B> 1 Section 1. The real property law is amended by adding a new section 2 235-k to read as follows: 3 <B><U>&#167; 235-k. Succession rights data. A landlord of a building containing</U></B> 4 <B><U>five or more rental units shall submit a quarterly report to New York</U></B> 5 <B><U>homes and community renewal in a form prescribed by the commissioner of</U></B> 6 <B><U>such agency indicating the number of applications for right of</U></B> 7 <B><U>succession such landlord received over the course of the previous three</U></B> 8 <B><U>months, the date such applications were received, whether such applica-</U></B> 9 <B><U>tions were granted or denied and, if denied, the reasons given for such</U></B> 10 <B><U>denial.</U></B> 11 <B><U>For the purposes of this section, "right of succession" shall mean the</U></B> 12 <B><U>right to a rent stabilized renewal lease or protection from eviction in</U></B> 13 <B><U>an apartment under rent control redounding to the benefit of an eligible</U></B> 14 <B><U>family member of the tenant having occupied such apartment immediately</U></B> 15 <B><U>prior to permanently vacating such apartment or immediately prior to</U></B> 16 <B><U>such tenant's death.</U></B> 17 &#167; 2. This act shall take effect on the first of January next succeed- 18 ing the date on which it shall have become a law.
