CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the executive law, in relation to enacting the "Wander- ing Officers Act" prohibiting the hiring of certain persons as a police officer <B><U>The People of the State of New York, represented in Senate and Assem-</U></B> <B><U>bly, do enact as follows:</U></B> 1 Section 1. Short title. This act shall be known and may be cited as 2 the "Wandering Officers Act." 3 § 2. Section 840 of the executive law is amended by adding a new 4 subdivision 2-c to read as follows: 5 <B><U>2-c. The council shall promulgate rules and regulations concerning</U></B> 6 <B><U>eligibility of persons for provisional or permanent appointment in the</U></B> 7 <B><U>competitive class of the civil service as police officers of any police</U></B> 8 <B><U>agency or the division of state police to prohibit the provisional or</U></B> 9 <B><U>permanent appointment of a person as a police officer if such person has</U></B> 10 <B><U>previously been fired as a police officer from any jurisdiction within</U></B> 11 <B><U>or without the state, if such person left a position as a police officer</U></B> 12 <B><U>either while under an investigation or while being the subject of a</U></B> 13 <B><U>disciplinary action which could result in termination from any jurisdic-</U></B> 14 <B><U>tion within or without the state, or if such person resigned while crim-</U></B> 15 <B><U>inal charges were pending stemming from actions committed while on duty</U></B> 16 <B><U>as a police officer in any jurisdiction within or without the state.</U></B> 17 § 3.
