54	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	58		SECTION 1. AMENDATORY Section 21, Chapter 366, O.S.L.

58	61		Section 2-109. A. A retail spirits license shall authorize the
59	62		holder thereof:
60	63		1. To purchase wine or spirits from a wine and spirits
61	64		wholesaler;
62	65		2. To purchase beer from a beer distributor or from the holder
63	66		of a small brewer self -distribution license; and

90	94		3. To sell same on the licensed premises in such containers to
91	95		consumers for off-premises consumption only and not for resale;
92	96		provided, spirits, wine and beer may be sold to charitable
93	97		organizations that are holders of charitable alcoholic beverage
94	98		auction or charitable alcohol ic beverage event licenses ; and
95	99		4. To offer product samples of alcoholic beverages on the
96	100		licensed premises during any hours the licensed premises are
97	101		authorized to be open . The following requirements apply to samples:
98	102		a. Samples shall not be bought or s old. The samples
99	103		served shall be provided to pa trons at no cost and
100	104		shall not be considered a sale of alcoholic beverages
101	105		within the meaning of Article XXVIII -A of the Oklahoma
102	106		Constitution. The retail spirits license holder shall
103	107		be responsible for the cost of the samples.
104	108		b. Any alcoholic beverages sold shall be in their
105	109		original factory-sealed packages or containers.
106	110		c. The licensee shall not receive any gift or thing of
107	111		value in violation of Section 3 -119 of this title.
108	112		d. Sample quantities shall be limited as follows for each
109	113		person during a twenty -four-hour period:
110	114		(1) distilled spirits: not to exceed twenty-five
111	115		hundredths (0.25) ounces per sample and not to
112	116		exceed four samples,

139	144		(2) beer and wine: not to exceed one (1) ounce per
140	145		sample and not to exceed four samples.
141	146		Retail license holders reserve the right to select the brands and
142	147		varieties of alcoholic beverages that will be served as samples.
143	148		Retail license holders shall not be required to offer samples and
144	149		reserve the right to refuse to offer s amples.
145	150		B. A retail wine license shall authorize the holder thereof:
146	151		1. To purchase wine from a wine and spirits wholesaler;
147	152		2. To purchase wine from a small farm winemaker who is
148	153		permitted and has elected to self -distribute as provided in Article
149		-	XXVIII-A of the Oklahoma Constitution; and
	154	+	XXVIIIA XXVIII-A of the Oklahoma Constitution; and
150	155		3. To sell same on the licensed premises in such containers to
151	156		consumers for off-premises consumption only and not for resale;
152	157		provided, wine may be sold to charitable organizations that are
153	158		holders of charitable alcoholic beverage auction or charitable
154	159		alcoholic beverage event licenses.
155	160		Provided, no holder of a Retail Wine License may sell wine with
156	161		alcohol beverage volume in excess of fifteen percent (15%).
157	162		C. A retail beer license shall authorize the holder thereof:
158	163		1. To purchase beer from a beer distributor;
159	164		2. To purchase beer from the holder of a small brewer self -
160	165		distribution license; and
161	166		3. To sell same on the licensed premises in such containers to
162	167		consumers for off-premises consumption only and no t for resale;
