5457 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5558 SECTION 1. AMENDATORY Section 21, Chapter 366, O.S.L.
56-2016, as amended by Section 1, Chapter 81, O.S.L. 2020 (37A O.S.
57-Supp. 2020, Section 2-109), is amended to read as follows:

5861 Section 2-109. A. A retail spirits license shall authorize the
5962 holder thereof:
6063 1. To purchase wine or spirits from a wine and spirits
6164 wholesaler;
6265 2. To purchase beer from a beer distributor or from the holder
6366 of a small brewer self -distribution license; and

9094 3. To sell same on the licensed premises in such containers to
9195 consumers for off-premises consumption only and not for resale;
9296 provided, spirits, wine and beer may be sold to charitable
9397 organizations that are holders of charitable alcoholic beverage
9498 auction or charitable alcohol ic beverage event licenses ; and
9599 4. To offer product samples of alcoholic beverages on the
96100 licensed premises during any hours the licensed premises are
97101 authorized to be open . The following requirements apply to samples:
98102 a. Samples shall not be bought or s old. The samples
99103 served shall be provided to pa trons at no cost and
100104 shall not be considered a sale of alcoholic beverages
101105 within the meaning of Article XXVIII -A of the Oklahoma
102106 Constitution. The retail spirits license holder shall
103107 be responsible for the cost of the samples.
104108 b. Any alcoholic beverages sold shall be in their
105109 original factory-sealed packages or containers.
106110 c. The licensee shall not receive any gift or thing of
107111 value in violation of Section 3 -119 of this title.
108112 d. Sample quantities shall be limited as follows for each
109113 person during a twenty -four-hour period:
110114 (1) distilled spirits: not to exceed twenty-five
111115 hundredths (0.25) ounces per sample and not to
112116 exceed four samples,

139144 (2) beer and wine: not to exceed one (1) ounce per
140145 sample and not to exceed four samples.
141146 Retail license holders reserve the right to select the brands and
142147 varieties of alcoholic beverages that will be served as samples.
143148 Retail license holders shall not be required to offer samples and
144149 reserve the right to refuse to offer s amples.
145150 B. A retail wine license shall authorize the holder thereof:
146151 1. To purchase wine from a wine and spirits wholesaler;
147152 2. To purchase wine from a small farm winemaker who is
148153 permitted and has elected to self -distribute as provided in Article
149-XXVIII-A of the Oklahoma Constitution; and
154+XXVIIIA XXVIII-A of the Oklahoma Constitution; and
150155 3. To sell same on the licensed premises in such containers to
151156 consumers for off-premises consumption only and not for resale;
152157 provided, wine may be sold to charitable organizations that are
153158 holders of charitable alcoholic beverage auction or charitable
154159 alcoholic beverage event licenses.
155160 Provided, no holder of a Retail Wine License may sell wine with
156161 alcohol beverage volume in excess of fifteen percent (15%).
157162 C. A retail beer license shall authorize the holder thereof:
158163 1. To purchase beer from a beer distributor;
159164 2. To purchase beer from the holder of a small brewer self -
160165 distribution license; and
161166 3. To sell same on the licensed premises in such containers to
162167 consumers for off-premises consumption only and no t for resale;
