45101 SECTION 1. AMENDATORY 59 O.S. 2011, Section 509, as last
46102 amended by Section 36, Chapter 161, O.S.L. 2020 (59 O.S. Su pp. 2020,
47103 Section 509), is amended to read as follows:

49104 Section 509. The words "unprofessional conduct " as used in
50105 Sections 481 through 518.1 of this title are hereby declared to
51106 include, but shall not be limited to, the following:

53107 1. Procuring, aiding or abetting a criminal operation;

55108 2. The obtaining of any fee o r offering to accept any fee,
56109 present or other form of remuneration whatsoever, on the assurance
57110 or promise that a manifestly incurable disease can or will be cured;

59111 3. Willfully betraying a pr ofessional secret to the detriment
60112 of the patient;

62113 4. Habitual intemperance or the habitual use of habit -forming
63114 drugs;

65115 5. Conviction or confession of, or plea of guilty, nolo
66116 contendere, no contest or Alford plea to a felony or any offense
67117 involving moral turpitude;

69118 6. All advertising of medical business in which statements are
70119 made which are grossly untrue or improbable and calculated to

86156 8. Dishonorable or immor al conduct which is likely to deceive,
87157 defraud, or harm the pu blic;

89158 9. The commission of any act which is a violation of the
90159 criminal laws of any state when such act is connected with the
91160 physician's practice of medicine. A complaint, indictment or
92161 confession of a criminal violation shall not be necessary for the
93162 enforcement of this provision. Proof of the commission of the act
94163 while in the practice of medicine or under the guise of the practice
95164 of medicine shall be unprofessional conduct;

97165 10. Failure to keep complete and accurate records of purchase
98166 and disposal of controlled drugs or of narcotic drugs;

100167 11. The writing of false or fictitious prescriptions for any
101168 drugs or narcotics declared by the laws of this state to be
102169 controlled or narcotic drugs;

104170 12. Prescribing or administering a drug or treatment without
105171 sufficient examination and the establishment of a valid physician -
106172 patient relationship and not prescribing in a safe, medically
107173 accepted manner;

109201 13. The violation, or attempted violation, direc t or indirect,
110202 of any of the provisions of the Oklahoma Allopa thic Medical and
111203 Surgical Licensure and Supervision Act, either as a principal,
112204 accessory or accomplice;

114205 14. Aiding or abetting, directly or indirectly, the practice of
115206 medicine by any person n ot duly authorized under the laws of this
116207 state;

118208 15. The inability to practice medicine with reasonable skill
119209 and safety to patients by reason of age, illness, drunkenness,
120210 excessive use of drugs, narcotics, chemicals, or any other type of
121211 material or as a result of any mental or physical condition. In
122212 enforcing this section the State Board of Medical Licensure and
123213 Supervision may, upon probable cause, request a physician to submit
124214 to a mental or physical examination by physicians designated by it.
125215 If the physician refuses to submit to the examination, the Board
126216 shall issue an order requiring the physician to show cause why the
127217 physician will not submit to the examination and shall schedule a
128218 hearing on the order within thirty (30) days after notice is se rved
129219 on the physician, exclusive of the day of service. The p hysician
130220 shall be notified by either personal service or by certified mail
131221 with return receipt requested. At the hearing, the physician and
132222 the physician's attorney are entitled to present any testimony and

137254 license of a physician ordered to s ubmit for examination may be
138255 suspended until the results of the examination are received and
139256 reviewed by the Board;

141257 16. a. Prescribing, dispensing or administering of controlled
142258 substances or narcotic drugs in excess of the amount
143259 considered good medical p ractice,

145260 b. prescribing, dispensing or administering controlled
146261 substances or narcotic drugs without medical need in
147262 accordance with pertinent licensing board standards,

150264 c. prescribing, dispensing or administering opioid drugs
151265 in excess of the maximum l imits authorized in Section
152266 2-309I of Title 63 of the Oklahoma Statutes;

154267 17. Engaging in physical conduct with a patient which is sexual
155268 in nature, or in any verbal beha vior which is seductive or sexually
156269 demeaning to a patient;

158270 18. Failure to maintain a n office record for each patient which
159271 accurately reflects the evaluation, treatment, and medical necessity
160272 of treatment of the patient;

164302 relationship can be severed by either party providing a reasonable
165303 period of time is granted; or

167304 20. Performance of an abortion as defined by Section 1 -730 of
168305 Title 63 of the Oklahoma Statutes, except for an abortion necessary
169306 to prevent the death of the mother or to prevent substantial or
170307 irreversible physical impairment of the mother that substantially
171308 increases the risk of death. The performance of an abortion on the
172309 basis of the mental or emotional health of the mother shall be a
173310 violation of this paragraph, notwithstanding a claim or diagnosis
174311 that the woman may engage in conduct which she intends to result in
175312 her death. The Board shall impose a penalty as provi ded in Section
176313 509.1 of this title on a licensee who violates this paragraph. The
177314 penalty shall include, but not be limited to, suspension of the

180316 21. Failure to provide a proper and safe medical faci lity
181317 setting and qualified assistive personnel for a recognized medical
182318 act, including but not limited to an initial in -person patient
183319 examination, office surgery, diagnostic service or any other medical
184320 procedure or treatment. Adequate medical records to support
185321 diagnosis, procedure, treatment or prescribed medications must be
186322 produced and maintained.

192353 Section 637. A. The State Board of Osteopat hic Examiners may
193354 refuse to admit a person to an examination or may refuse to issue or
194355 reinstate or may suspend or revoke any license issued or reinstated
195356 by the Board upon proof that the applic ant or holder of such a
196357 license:

198358 1. Has obtained a license, l icense renewal or authorization to
199359 sit for an examination, as the case may be, through fraud,
200360 deception, misrepresentation or bribery; or has been granted a
201361 license, license renewal or authoriza tion to sit for an examination
202362 based upon a material mistake o f fact;

204363 2. Has engaged in the use or employment of dishonesty, fraud,
205364 misrepresentation, false promise, false pretense, unethical conduct
206365 or unprofessional conduct, as m ay be determined by the Board, in the
207366 performance of the functions or duties of an ost eopathic physician,
208367 including but not limited to the following:

210368 a. obtaining or attempting to obtain any fee, charge,
211369 tuition or other compensation by fraud, deception or
212370 misrepresentation; will fully and continually
213371 overcharging or overtreating patients; o r charging for
214372 visits to the physician 's office which did not occur
215373 or for services which were not rendered,

217374 b. using intimidation, coercion or deception to obtain or
218375 retain a patient or discour age the use of a second

227409 age, experience or licensure to pe rform them, noting
228410 that delegation may only occur within an appropriate

230412 record is maintained including, but not limi ted to, at
231413 the minimum, a current history and physical,

233414 e. misrepresenting that any di sease, ailment, or
234415 infirmity can be cured by a method, procedure,
235416 treatment, medicine or device,

237417 f. acting in a manner which results in final disciplinary
238418 action by any professional society or a ssociation or
239419 hospital or medical staff of such hospital in th is or
240420 any other state, whether agreed to voluntarily or not,
241421 if the action was in any way related to professional

243423 other violation of the Okla homa Osteopathic Medicine

251457 medically accepted thera peutic or experimental or
252458 investigational purpose duly authorized by a state or
253459 federal agency, or not in good faith to relieve pain
254460 and suffering, or not to treat an ail ment, physical
255461 infirmity or disease, or violating any state or
256462 federal law on controll ed dangerous substances
257463 including, but not limited to, prescribing, dispensing
258464 or administering opioid drugs in excess of the maximum
259465 limits authorized in Section 2 -309I of Title 63 of the
260466 Oklahoma Statutes,

262467 h. engaging in any sexual activity within a phys ician-
263468 patient relationship,

265469 i. terminating the care of a patient without adequate
266470 notice or without making other arrangements for the

282509 purchase and disposal of controlled drugs or narcotic

285511 3. Has engaged in gross negligence, gr oss malpractice or gross
286512 incompetence;

288513 4. Has engaged in repeated acts of negligence, malpractice or
289514 incompetence;

291515 5. Has been finally adjudicated and found guilty, or entered a
292516 plea of guilty or nolo contendere in a criminal prosecution, for any
293517 offense reasonably related to t he qualifications, functions or
294518 duties of an osteopathic physi cian, whether or not sentence is
295519 imposed, and regardless of the pendency of an appeal;

297520 6. Has had the authority to engage in the activities regulated
298521 by the Board revoked, suspended, restricted , modified or limited, or
299522 has been reprimanded, warned or cens ured, probated or otherwise
300523 disciplined by any other state or federal agency whether or not
301524 voluntarily agreed to by the physician including, but not limited
302525 to, the denial of licensure, surrend er of the license, permit or
303526 authority, allowing the license, permit or authority to expire or
304527 lapse, or discontinuing or limiting the practice of osteopathic
305528 medicine pending disposition of a complaint or completion of an
306529 investigation;

340609 her death. The Board shall impose a penalty as provided in this
341610 section and in Section 637.1 of this title on a licensee who
342611 violates this paragraph. The penal ty shall include, but no t be
343612 limited to, suspension of the license for a period of not less than
344613 one (1) year; or

346614 15. Has been adjudicated to be insane, or incompetent, or
347615 admitted to an institution for the treatment of psychiatric
348616 disorders.

350617 B. The State Board of Osteopathic E xaminers shall neither
351618 refuse to renew, nor suspend, nor revok e any license, however, for
352619 any of these causes, unless the person accused has been given at
353620 least twenty (20) days ' notice in writing of the charge against him
354621 or her and a public hearing by th e Board; provided, three-fourths
355622 (3/4) of a quorum present at a meeting may vote to suspend a license
356623 in an emergency situation if the licensee affected is provided a
357624 public hearing within thirty (30) days of the emergency suspensio n.

359625 C. The State Board o f Osteopathic Examiners shall have the
360626 power to order or subpo ena the attendance of witnesses, the
361627 inspection of records and premises and the production of relevant
362628 books and papers for the investigation of matters that may come
363629 before them. The presiding officer of the Board shall have the
364630 authority to compel the g iving of testimony as is conferred on
365631 courts of justice.

367659 D. Any osteopathic physician in the State of Oklahoma whose
368660 license to practice osteopathic medicine is revoked or suspended
369661 under this section shall have the right to seek judicial review of a
370662 ruling of the Board pursuant to the Administrative Procedures Act.

372663 E. The Board may enact rules and regulations pursuant to the
373664 Administrative Procedures Act setting out add itional acts of
374665 unprofessional conduct;, which acts shall be grounds for refusal to
375666 issue or reinstate, or for action to condition, suspend or revoke a
376667 license.

378668 SECTION 3. NEW LAW A new section of law not to be
379669 codified in the Oklahoma Statutes reads as follows:

381670 In the event that any provision of Section 509 or 637 of Title
382671 59 of the Oklahoma Statutes , as last amended by Section 1 or 2 of
383672 this act, is challenged in court in any action alleging violation of
384673 either the Constitution o f the United States of A merica or the State
385674 of Oklahoma, the Office of the Attorney Ge neral shall determine the
386675 amount of state or local funds expended to defend such action. Such
387676 determination shall include the number of hours of time spent by any
388677 public employee in such defens e multiplied by the rate of
389678 compensation paid to such employee , as well as the costs of any
390679 outside counsel paid for such purpose, and shall include both direct
391680 and indirect costs. The Office of the Attorney General shall report
392681 such amounts for each cale ndar quarter to all members of the
393682 Legislature.

395710 SECTION 4. NEW LAW A new section of law not to be
396711 codified in the Oklahoma Statut es reads as follows:

398712 In the event that any provision of Section 509 or 637 of Title
399713 59 of the Oklahoma Statutes, as last amended by Section 1 or 2 of
400714 this act, is ever temporarily or permanently restrained or enjoined
401715 by court order, the remaining provisions of such section shall be
402716 enforced as though the restrained or enjoined pro visions had not
403-been adopted; provided, however, if such temporary or permanent ENR. H. B. NO. 1102 Page 10
717+been adopted; provided, however, if such temporary or permanent
404718 restraining order or injunction is stayed, dissolved or otherwise
405719 ceases to have effect, such provisions shall have full force and
