31	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33	58		SECTION 1. AMENDATORY Section 1, Chapter 356, O.S.L.
34	59		2013, as amended by Section 1, Chapter 33, O.S.L. 2015 (70 O.S.
35	60		Supp. 2020, Section 3-168), is amended to read as follows:
36		-
37	61		Section 3-168. A. This section shall be known and may be cited
38	62		as the "Student Data Accessibility, Transparency and Accountability
39	63		Act of 2013".
	64	+	B. As used in this act:
	65	+	1. "Board" means the State Boar d of Education;
	66	+	2. "Department" means the State Departm ent of Education;

50	96		4. "Aggregate data" means data collected and/or reported at the
51	97		group, cohort, or institution al level;

53	98		5. "De-identified data" means a student datas et in which parent
54	99		and student identifying information, including the state -assigned
55	100		student identifier, has been removed;
56		-
57	101		6. "Student testing number" means the unique student identifier
58	102		assigned by the state to each student that shall not be or include
59	103		the Social Security number of a student in whole or in part;
60		-
61	104		7. "Student data" means data collected and/or reported at the
62	105		individual student level included in a student's educational record.

64	106		a. "Student data" includes:
65		-
66	107		(1) state and national assessment re sults, including
67	108		information on untested public school students,
68		-
69	109		(2) course taking and completion, credits earned, and
70	110		other transcript information,
71		-
72	111		(3) course grades and grade point average,
73		-
74	112		(4) date of birth, grade level and expected
75	113		graduation date/grad uation cohort,
76		-
77	114		(5) degree, diploma, credential attainment, and other
78	115		school exit information such as General
79	116		Educational Development and drop-out dropout

97	155		information, including tribal affiliation and
98	156		other data associated with students who have been
99	157		identified as having American Indian heritage,

104	160		b. Unless included in a student's educational record,
105	161		"student data" shall not include:
106		-
107	162		(1) juvenile delinquency records,
108		-
109	163		(2) criminal records,
110		-
111	164		(3) medical and health records,
112		-
113	165		(4) student Social Security number, and
114		-
115	166		(5) student biometric information; and
116		-
117	167		8. "Military student identifier" m eans a unique identifier for
118	168		each student whose parent or guardian is a member of the Armed

123	199		C. The State Board of Education shall:

125	200		1. Create, publish and make publicly available a data inventory
126	201		and dictionary or index of data elements with definitions of
127	202		individual student data field s currently in the student data system
128	203		including:

130	204		a. any individual student data required to be reported by
131	205		state and federal education mandates,
132		-
133	206		b. any individual student data which has been proposed
134	207		for inclusion in the student data system with a
135	208		statement regarding the purpose or reason for the

	209	+	proposed collection, and
138	210		c. any individual student data that the State Department
139	211		of Education collects or maintains with no current
140	212		purpose or reason;

142	213		2. Develop, publish and make publicly available policies and
143	214		procedures to comply with the Federal Family Education al Rights and
144	215		Privacy Act (FERPA) and other relevant privacy laws and policies ,
145	216		including but not limited to:

147	217		a. access to student and de -identified data in the
148	218		student data system shall be restricted to:

155	251		Management and Enterprise Services assigned to

158	253		(2) district administrators, teachers and school
159	254		personnel who require such access to perform
160	255		their assigned duties,

162	256		(3) students and their parents, and
163		-
164	257		(4) the authorized staff of other state agencies in
165	258		Oklahoma as required by law and/or defined by
166	259		interagency data-sharing agreements,
167		-
168	260		b. the State Department of Education shall use only
169	261		aggregate data in public reports or in response to
170	262		record requests in accordance with paragraph 3 of this
171	263		subsection,
172		-
173	264		c. the State Department of Education shall develop
174	265		criteria for the approval of research and data
175	266		requests from state and local agencies, the State
176	267		Legislature, researchers and the public:

178	268		(1) unless otherwise approved by the State Board of
179	269		Education, student data maintained by the State

185	301		data in specific instances, the Department may
186	302		only use aggregate data i n the release of data in
187	303		response to research and data requests, and

189	304		d. notification to students and parents regarding their
190	305		rights under federal and state law;
191		-
192	306		3. Unless otherwise approved by the State Board of Education,
193	307		the State Department of Educatio n shall not transfer student or de-
194	308		identified data deem ed confidential under division (1) of
195	309		subparagraph c of paragraph 2 of this subsection to any federal,
196	310		state or local agency or other organization/entity outside of the
197	311		State of Oklahoma, with the foll owing exceptions:
198		-
199	312		a. a student transfers out of state o r a school/district
200	313		seeks help with locating an out -of-state transfer,
201		-
202	314		b. a student leaves the state to attend an out -of-state
203	315		institution of higher education or training program,
204		-
205	316		c. a student registers for or takes a national or
206	317		multistate assessment,
207		-
208	318		d. a student voluntarily participates in a program for
209	319		which such a data transfer is a condition/requirement
210	320		of participation,

214	350		instructional supports with an ou t-of-state vendor,

216	351		f. a student is classified as "migrant" for federal
217	352		reporting purposes, or

219	353		g. a student with a military student identifier for
220	354		purposes of assisting the Department of Defense in
221	355		developing policy and military child education
222	356		initiatives;

224	357		4. Develop a detailed data security plan that includes:

226	358		a. guidelines for authorizing access to the student data
227	359		system and to individual student data including
228	360		guidelines for authentication of autho rized access,
229		-
230	361		b. privacy compliance standards,
231		-
232	362		c. privacy and security audits,
233		-
234	363		d. breach planning, notification and procedures, and
235		-
236	364		e. data retention and disposition policies;
237		-
238	365		5. Ensure routine and ongoing compliance by the State
239	366		Department of Education w ith FERPA, other relevant privacy laws and
240	367		policies, and the privacy and security policies and procedures
241	368		developed under the authority of this act, including the performance
242	369		of compliance audits;
243		-
244	370		6. Ensure that any contracts that govern databases, assess ments
245	371		or instructional supports that include student or de-identified data

250	402		7. Notify the Governor and the Legisla ture annually of the
251	403		following:

253	404		a. new student data pro posed for inclusion in the state
254	405		student data system:
255		-
256	406		(1) any new student data collection proposed by the
257	407		State Board of Education becomes a provisional
258	408		requirement to allow districts and their local
259	409		data system vendors the opportunity to meet the
260	410		new requirement, and
261		-
262	411		(2) the State Board of Education must submit any new
263	412		"provisional" student data collection to the
264	413		Governor and the Legislature for their approval
265	414		within one (1) year in order to make the n ew
266	415		student data a permanent requirement. Any
267	416		provisional student data collection not approved
268	417		by the Governor and the Legislature by the end of
269	418		the next legislative session expires and is no
270		-	longer required, ENR. H. B. NO. 1104 Page 7

	419	+	longer required,
272	420		b. changes to existing data collections require d for any
273	421		reason, including changes to federal reportin g
274	422		requirements made by the U.S. Department of Education,

277	451		Board of Education in the past year regarding the
278	452		release or out-of-state transfer of student or de-
279	453		identified data, and

281	454		d. the results of any and all privacy compliance and
282	455		security audits completed in the past year.
283	456		Notifications regarding privacy compliance and
284	457		security audits shall not include any information that
285	458		would itself pose a se curity threat to the state or
286	459		local student information systems or to the secure
287	460		transmission of data between state and local systems
288	461		by exposing vulnerabilities; and
289		-
290	462		8. By July 1, 2016, include a military student identifier in
291	463		the state student data syst em.
292		-
293	464		D. The State Board of Education shall adopt rules for the State
294	465		Department of Education to implement the provisions of the Student
295	466		Data Accessibility, Transparency and Accountability Act of 2013.

297	467		E. Upon the effective date of this act, any existing c ollection
298	468		of student data by the State Department of Ed ucation and the
299	469		addition of a military student identifier to the student data
300	470		collected by the Department after the effective date of this act
301	471		shall not be considered a new student data collection in a ccordance
302	472		with subparagraph a of paragraph 7 of subsect ion C of this section.
