3157 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3358 SECTION 1. AMENDATORY Section 1, Chapter 356, O.S.L.
3459 2013, as amended by Section 1, Chapter 33, O.S.L. 2015 (70 O.S.
3560 Supp. 2020, Section 3-168), is amended to read as follows:

3761 Section 3-168. A. This section shall be known and may be cited
3862 as the "Student Data Accessibility, Transparency and Accountability
3963 Act of 2013".
64+B. As used in this act:
65+1. "Board" means the State Boar d of Education;
66+2. "Department" means the State Departm ent of Education;

4794 3. "Data system" means the Oklahoma State Department of

5096 4. "Aggregate data" means data collected and/or reported at the
5197 group, cohort, or institution al level;

5398 5. "De-identified data" means a student datas et in which parent
5499 and student identifying information, including the state -assigned
55100 student identifier, has been removed;

57101 6. "Student testing number" means the unique student identifier
58102 assigned by the state to each student that shall not be or include
59103 the Social Security number of a student in whole or in part;

61104 7. "Student data" means data collected and/or reported at the
62105 individual student level included in a student's educational record.

64106 a. "Student data" includes:

66107 (1) state and national assessment re sults, including
67108 information on untested public school students,

69109 (2) course taking and completion, credits earned, and
70110 other transcript information,

72111 (3) course grades and grade point average,

74112 (4) date of birth, grade level and expected
75113 graduation date/grad uation cohort,

77114 (5) degree, diploma, credential attainment, and other
78115 school exit information such as General
79116 Educational Development and drop-out dropout

104160 b. Unless included in a student's educational record,
105161 "student data" shall not include:

107162 (1) juvenile delinquency records,

109163 (2) criminal records,

117167 8. "Military student identifier" m eans a unique identifier for
118168 each student whose parent or guardian is a member of the Armed

119196 Forces of the United States, a reserve component of the Armed Forces
120197 of the United States or the National Gua rd which will allow for the
121198 disaggregation of each cate gory.

123199 C. The State Board of Education shall:

125200 1. Create, publish and make publicly available a data inventory
126201 and dictionary or index of data elements with definitions of
127202 individual student data field s currently in the student data system
128203 including:

130204 a. any individual student data required to be reported by
131205 state and federal education mandates,
132-
133206 b. any individual student data which has been proposed
134207 for inclusion in the student data system with a
135208 statement regarding the purpose or reason for the

138210 c. any individual student data that the State Department
139211 of Education collects or maintains with no current
140212 purpose or reason;

142213 2. Develop, publish and make publicly available policies and
143214 procedures to comply with the Federal Family Education al Rights and
144215 Privacy Act (FERPA) and other relevant privacy laws and policies ,
145216 including but not limited to:

147217 a. access to student and de -identified data in the
148218 student data system shall be restricted to:

151247 Education and the Department's contractors who
152248 require such access to perform their assigned
153249 duties, including staff and contractors from the
154250 Information Services Division of the Office of
155251 Management and Enterprise Services assigned to
156252 the Department,

158253 (2) district administrators, teachers and school
159254 personnel who require such access to perform
160255 their assigned duties,
161-
162256 (3) students and their parents, and
163-
164257 (4) the authorized staff of other state agencies in
165258 Oklahoma as required by law and/or defined by
166259 interagency data-sharing agreements,
167-
168260 b. the State Department of Education shall use only
169261 aggregate data in public reports or in response to
170262 record requests in accordance with paragraph 3 of this
171263 subsection,

173264 c. the State Department of Education shall develop
174265 criteria for the approval of research and data
175266 requests from state and local agencies, the State
176267 Legislature, researchers and the public:

178268 (1) unless otherwise approved by the State Board of
179269 Education, student data maintained by the State

183299 (2) unless otherwise approved by the State Board of
184300 Education to release student or de -identified
185301 data in specific instances, the Department may
186302 only use aggregate data i n the release of data in
187303 response to research and data requests, and

189304 d. notification to students and parents regarding their
190305 rights under federal and state law;
191-
192306 3. Unless otherwise approved by the State Board of Education,
193307 the State Department of Educatio n shall not transfer student or de-
194308 identified data deem ed confidential under division (1) of
195309 subparagraph c of paragraph 2 of this subsection to any federal,
196310 state or local agency or other organization/entity outside of the
197311 State of Oklahoma, with the foll owing exceptions:

199312 a. a student transfers out of state o r a school/district
200313 seeks help with locating an out -of-state transfer,
201-
202314 b. a student leaves the state to attend an out -of-state
203315 institution of higher education or training program,
204-
205316 c. a student registers for or takes a national or
206317 multistate assessment,
207-
208318 d. a student voluntarily participates in a program for
209319 which such a data transfer is a condition/requirement
210320 of participation,

212348 e. the Department enters into a contract that governs
213349 databases, assessments, special education or
214350 instructional supports with an ou t-of-state vendor,

216351 f. a student is classified as "migrant" for federal
217352 reporting purposes, or
218-
219353 g. a student with a military student identifier for
220354 purposes of assisting the Department of Defense in
221355 developing policy and military child education
222356 initiatives;

224357 4. Develop a detailed data security plan that includes:

226358 a. guidelines for authorizing access to the student data
227359 system and to individual student data including
228360 guidelines for authentication of autho rized access,

230361 b. privacy compliance standards,
231-
232362 c. privacy and security audits,
233-
234363 d. breach planning, notification and procedures, and
235-
236364 e. data retention and disposition policies;
237-
238365 5. Ensure routine and ongoing compliance by the State
239366 Department of Education w ith FERPA, other relevant privacy laws and
240367 policies, and the privacy and security policies and procedures
241368 developed under the authority of this act, including the performance
242369 of compliance audits;

244370 6. Ensure that any contracts that govern databases, assess ments
245371 or instructional supports that include student or de-identified data

246399 and are outsourced to private vendors include express provisions
247400 that safeguard privacy and security and include penalties for
248401 noncompliance;

250402 7. Notify the Governor and the Legisla ture annually of the
251403 following:

253404 a. new student data pro posed for inclusion in the state
254405 student data system:
255-
256406 (1) any new student data collection proposed by the
257407 State Board of Education becomes a provisional
258408 requirement to allow districts and their local
259409 data system vendors the opportunity to meet the
260410 new requirement, and
261-
262411 (2) the State Board of Education must submit any new
263412 "provisional" student data collection to the
264413 Governor and the Legislature for their approval
265414 within one (1) year in order to make the n ew
266415 student data a permanent requirement. Any
267416 provisional student data collection not approved
268417 by the Governor and the Legislature by the end of
269418 the next legislative session expires and is no
270-longer required, ENR. H. B. NO. 1104 Page 7

272420 b. changes to existing data collections require d for any
273421 reason, including changes to federal reportin g
274422 requirements made by the U.S. Department of Education,

276450 c. an explanation of any exceptions granted by the State
277451 Board of Education in the past year regarding the
278452 release or out-of-state transfer of student or de-
279453 identified data, and
280-
281454 d. the results of any and all privacy compliance and
282455 security audits completed in the past year.
283456 Notifications regarding privacy compliance and
284457 security audits shall not include any information that
285458 would itself pose a se curity threat to the state or
286459 local student information systems or to the secure
287460 transmission of data between state and local systems
288461 by exposing vulnerabilities; and
289-
290462 8. By July 1, 2016, include a military student identifier in
291463 the state student data syst em.

293464 D. The State Board of Education shall adopt rules for the State
294465 Department of Education to implement the provisions of the Student
295466 Data Accessibility, Transparency and Accountability Act of 2013.

297467 E. Upon the effective date of this act, any existing c ollection
298468 of student data by the State Department of Ed ucation and the
299469 addition of a military student identifier to the student data
300470 collected by the Department after the effective date of this act
301471 shall not be considered a new student data collection in a ccordance
302472 with subparagraph a of paragraph 7 of subsect ion C of this section.
