2653 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2854 SECTION 1. AMENDATORY 17 O.S. 2021, Section 139.108, is
2955 amended to read as follows:

3156 Section 139.108 A. Except for the provisions of this section,
3257 nothing in this act shall be construed as appl icable to the
3358 telecommunications network known as On eNet or to any other component
3459 of the Oklahoma Government Telecommunications Network. Neither
3560 OneNet nor any other component of the Oklahoma Government
3661 Telecommunications Network shall be assessed any fe e or other charge
3762 for the support of universal servi ce.

3963 B. No provider of Internet service or any company providing
4064 telecommunications services or its affiliate or subsidiary, may

4192 price such Internet service in an anticompetitive, discriminatory,
4293 or predatory manner or subsidize the price of Internet servi ce with
4394 revenues received from other services. No governmental agency or
4495 entity using or being eligible to use OneNet facilities may price
4596 such Internet services in an anticompetitive or predatory manner .

97+Any governmental agency or entity using OneNet fa cilities is hereby
4798 prohibited from reselling OneNet access directly to the general
4899 public at any nonpublic site. Any company or individual damaged
49100 from a violation of this subsection by a private company or
50101 individual shall be entitled to treble damages. The Attorney
51102 General shall be responsible for bringing an action for violation of
52103 this section against a private company or individual.

54104 C. The Corporation Commission shall not approve, endorse,
55105 forward or file any application for reimbursement submitted pursuant
56106 to subsection (h) of Section 254 of the Communications Act of 1934,
57107 as amended, for transmission services requiring a circuit of T -1 or
58108 greater capacity unless OneNet is the circuit provider. Fo r
59109 purposes of this subsection, "T-1" means a digital, one-million-
60110 five-hundred-forty-four-thousand-bit (1.544 Mbit) circuit with
61111 capacity sufficient to simultaneously transmit twenty -four (24)
62112 voice or data channels at sixty -four thousand bits per second ( 64
63113 Kbits/sec).
