30	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	58		SECTION 1. AMENDATORY 70 O.S. 2011, Section 1210.284, as
33	59		last amended by Section 79, Chapter 229, O.S.L. 2013 (7 0 O.S. Supp.
34	60		2020, Section 1210.284), is amended to read as follows:

36		-	Section 1210.284 A. 1. The parent or legal guardian of each

38	63		shall provide certification to school personnel that the student
39	64		passed a vision screening within the previous twelve (12) months or

41	93		personnel listed on the statewide registry as maintained by the
42	94		State Department of Health.

44	95		2. The parent or legal guardian of each student enrolled in
45	96		first or third grade at a public school in this state shall provide
46		-	within thirty (30) days of the beginning of the school year ~~ENR. H. B. NO. 1598 Page 2~~
	97	+	within thirty (30) days of the beginning of the school year
47	98		certification to school personnel that the student passed a vision
48	99		screening within the previ ous twelve (12) months. Such screening
49	100		shall be conducted by personnel listed on the statewide registry as
50	101		maintained by the State Department of Health or by personnel
51	102		approved by the State Department of Education as provided in
52	103		subsection C of this secti on.

54	104		3. The parent or legal guardian of each student who rece ives a
55	105		vision screening as required by this section shall receive
56	106		notification that a vision screening is not the equivalent of a
57	107		comprehensive eye exam.

59	108		B. 1. The Infant and Children's Health Advisory Council
60	109		created in Section 44 of this act Section 1-103a.1 of Title 63 of
61	110		the Oklahoma Statutes shall make recommendations to the State Board
62	111		of Health on:

64	112		a. standards for vision screening and referral,
65		-
66	113		b. qualifications for initial recognition a nd renewal of
67	114		recognition of vision screeners,

69	115		c. qualifications for initial recognition and renewal of
70	116		recognition of vision screener trainers,

72	144		d. qualifications for initial recognition and renewal of
73	145		recognition of trainers of vision screener trainers,

76	147		e. grounds for denial, refusal, suspension or revocation
77	148		of recognition of vision screeners, vision screener
78	149		trainers and trainers of vision screener trainers.

80	150		2. The Department shall:

82	151		a. establish and thereafter maintain a statewide
83	152		registry, available via the Internet, which shall
84	153		contain a list of approved vi sion screeners,
85		-
86	154		b. maintain a list of approved vision screener trainers
87	155		and trainers of vision screener trainers, and
88		-
89	156		c. maintain the standards for vision screening and
90	157		referral.

92	158		3. After notice and hearing, the Department may deny, refuse,
93	159		suspend or revoke approval to an applicant which has a history of:
94		-
95	160		a. noncompliance or incomplete or partial compliance with
96	161		the provisions of this section or the rules adopted by
97	162		the Board to implement the pr ovisions of this section,

99	163		b. referring persons to a business in which the applicant
100	164		has a financial interest or a business which is owned
101	165		or operated by someone within the third degree of
102	166		consanguinity or affinity of the applicant, or

104	194		c. conduct which demonstrates that the applicant is
105	195		providing services in a manner which does not warrant
106	196		public trust.

108	197		4. The Board, giving consideration to the recommendations of
109	198		the Infant and Children's Health Advisory Council created in Section
110	199		44 of this act Section 1-103a.1 of Title 63 of the Oklahoma
111	200		Statutes, shall promulgate rules to implement the provisions of this
112	201		section.

114	202		C. In addition to the statewide registry maintained by the
115	203		State Department of Health, the State Department of Education shall
116	204		be authorized to approve vision screeners to conduct vision
117	205		screenings pursuant to this section.

119	206		D. 1. The parent or legal guardian of each student who fails
120	207		the vision screening required in subsection A of this section shall
121	208		receive a recommendation to undergo a compre hensive eye examination
122	209		performed by an ophthalmologist or op tometrist.

124	210		2. The ophthalmologist or optometrist shall forward a written
125	211		report of the results of the comprehensive eye examination to the
126	212		student's school, parent or legal guardian, and primary health care
127	213		provider designated by the parent or legal guardian. The report
128	214		shall include, but not be limited to:

130	215		a. date of report,

132	216		b. name, address and date of birth of the student,

134	217		c. name of the student's school,

139	247		diagnoses, medication used , duration of action of
140	248		medication, treatment, prognosis, whether or not a
141		-	return visit is recommended and, if so , when,

143	250		f. recommended educational adjustments for the child, if
144	251		any, which may include: preferential seating in the
145	252		classroom, eyeglasses for f ull-time use in school,
146	253		eyeglasses for part-time use in school, sight -saving
147	254		eyeglasses, and any other recommendations, and

149	255		g. name, address and signature of the examiner.

151	256		D. E. No student shall be prohibited from attending school for
152	257		a parent's or legal guardian's failure to furnish a report of the
153	258		student's vision screening or an examiner's failure to furnish the
154	259		results of a student's comprehensive eye examination required by
155	260		this section.

157	261		E. F. School districts shall notify parents or legal guardians
158	262		of students who enroll in kindergarten, first , or third grade for
159	263		the 2007-08 school year and each year thereafter of the requirements
160	264		of this section.

162	265		F. G. The State Board of Education shall a dopt rules for the
163	266		implementation of this section except as p rovided in subsection B of
164	267		this section. The State Department of Education shall issue a
165	268		report annually on the impact and effectiveness of this section.

169	297		SECTION 3. It being immediately necessary for the preservation
170	298		of the public peace, health or safety, an emergency is hereby
