1645 An Act relating to students; amending 70 O.S. 2011,
1746 Section 1210.284, as last amended by Section 79,
1847 Chapter 229, O.S.L. 2013 (70 O.S. Supp. 2 020, Section

3057 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3258 SECTION 1. AMENDATORY 70 O.S. 2011, Section 1210.284, as
3359 last amended by Section 79, Chapter 229, O.S.L. 2013 (7 0 O.S. Supp.
3460 2020, Section 1210.284), is amended to read as follows:

4495 2. The parent or legal guardian of each student enrolled in
4596 first or third grade at a public school in this state shall provide

4798 certification to school personnel that the student passed a vision
4899 screening within the previ ous twelve (12) months. Such screening
49100 shall be conducted by personnel listed on the statewide registry as
50101 maintained by the State Department of Health or by personnel
51102 approved by the State Department of Education as provided in
52103 subsection C of this secti on.

54104 3. The parent or legal guardian of each student who rece ives a
55105 vision screening as required by this section shall receive
56106 notification that a vision screening is not the equivalent of a
57107 comprehensive eye exam.

59108 B. 1. The Infant and Children's Health Advisory Council
60109 created in Section 44 of this act Section 1-103a.1 of Title 63 of
61110 the Oklahoma Statutes shall make recommendations to the State Board
62111 of Health on:

66113 b. qualifications for initial recognition a nd renewal of
67114 recognition of vision screeners,

69115 c. qualifications for initial recognition and renewal of
70116 recognition of vision screener trainers,

80150 2. The Department shall:

82151 a. establish and thereafter maintain a statewide
83152 registry, available via the Internet, which shall
84153 contain a list of approved vi sion screeners,

86154 b. maintain a list of approved vision screener trainers
87155 and trainers of vision screener trainers, and

89156 c. maintain the standards for vision screening and
90157 referral.

92158 3. After notice and hearing, the Department may deny, refuse,
93159 suspend or revoke approval to an applicant which has a history of:

95160 a. noncompliance or incomplete or partial compliance with
96161 the provisions of this section or the rules adopted by
97162 the Board to implement the pr ovisions of this section,

99163 b. referring persons to a business in which the applicant
100164 has a financial interest or a business which is owned
101165 or operated by someone within the third degree of
102166 consanguinity or affinity of the applicant, or

104194 c. conduct which demonstrates that the applicant is
105195 providing services in a manner which does not warrant
106196 public trust.

108197 4. The Board, giving consideration to the recommendations of
109198 the Infant and Children's Health Advisory Council created in Section
110199 44 of this act Section 1-103a.1 of Title 63 of the Oklahoma
111200 Statutes, shall promulgate rules to implement the provisions of this
112201 section.

114202 C. In addition to the statewide registry maintained by the
115203 State Department of Health, the State Department of Education shall
116204 be authorized to approve vision screeners to conduct vision
117205 screenings pursuant to this section.

119206 D. 1. The parent or legal guardian of each student who fails
120207 the vision screening required in subsection A of this section shall
121208 receive a recommendation to undergo a compre hensive eye examination
122209 performed by an ophthalmologist or op tometrist.

124210 2. The ophthalmologist or optometrist shall forward a written
125211 report of the results of the comprehensive eye examination to the
126212 student's school, parent or legal guardian, and primary health care
127213 provider designated by the parent or legal guardian. The report
128214 shall include, but not be limited to:

132216 b. name, address and date of birth of the student,

139247 diagnoses, medication used , duration of action of
140248 medication, treatment, prognosis, whether or not a
141-return visit is recommended and, if so , when,

143250 f. recommended educational adjustments for the child, if
144251 any, which may include: preferential seating in the
145252 classroom, eyeglasses for f ull-time use in school,
146253 eyeglasses for part-time use in school, sight -saving
147254 eyeglasses, and any other recommendations, and

149255 g. name, address and signature of the examiner.

151256 D. E. No student shall be prohibited from attending school for
152257 a parent's or legal guardian's failure to furnish a report of the
153258 student's vision screening or an examiner's failure to furnish the
154259 results of a student's comprehensive eye examination required by
155260 this section.

157261 E. F. School districts shall notify parents or legal guardians
158262 of students who enroll in kindergarten, first , or third grade for
159263 the 2007-08 school year and each year thereafter of the requirements
160264 of this section.

162265 F. G. The State Board of Education shall a dopt rules for the
163266 implementation of this section except as p rovided in subsection B of
164267 this section. The State Department of Education shall issue a
165268 report annually on the impact and effectiveness of this section.

167296 SECTION 2. This act shall become effective July 1, 2021.

169297 SECTION 3. It being immediately necessary for the preservation
170298 of the public peace, health or safety, an emergency is hereby
171299 declared to exist, by reason whereof this act shall take effect and
172300 be in full force from and after its passage and approval.
