43	40		An Act relating to agriculture; amending 2 O.S. 2 021,

51	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	49		SECTION 1. AMENDATORY 2 O.S. 2021, Section 20-25, is
53	50		amended to read as follows:
54	51		Section 20-25. A. 1. The State Board of Agriculture is
55	52		authorized and directed to promulgate a violation points system for
56	53		violating the Oklahoma Swine Feeding Operations Act which provides
57	54		greater punishment for violations which are intentional and for
58	55		violations which pose a greater thre at to the environment.
59	56		2. The State Board of Agriculture shall have the power to
60	57		suspend, revoke or not renew the license of any swine feeding
61	58		operation based on the point system after a hearing, and after an
62	59		administrative determination that the swine fe eding operation has
63	60		violated or has failed to comply with any of the provisions of the

91	87		Oklahoma Swine Feeding Operations Act, or any rule promulgated
92	88		pursuant thereto.
93	89		3. 2. The Board shall have the power and duty to reinstate any
94	90		such suspended or revoke d licenses, or renew the licenses, upon a
95	91		satisfactory and acceptable showing and assurance that the swine
96	92		feeding operation conducted swine feeding operations in con formity
97	93		with, and in compliance with, the provisions of the Oklahoma Swine
98	94		Feeding Operations Act and rules promulgated pursuant thereto, and
99	95		that conformity and compliance will be continuous.
100	96		B. In order to protect the public health and safety and the
101	97		environment of this state, the Board, pursuant to the Oklahoma Swine
102	98		Feeding Operations Act, may deny issuance of a license or transfer
103	99		of a license to establish and operate a swine feeding operation on
104	100		and after September 1, 1997, to any person or other leg al entity
105	101		which:
106	102		1. Is not in substantial compliance with a final agency order
107	103		or any final order or judgment of a court of record secured by any
108	104		state or federal agency relating to swine feeding operations; or
109	105		2. Has evidenced a reckless disregard for t he protection of the
110	106		public and the environment as demonstrated by a history of
111	107		noncompliance with environmental laws and rules resulting in
112	108		endangerment of human health or the environment.
113	109		C. Any action taken in regard to the denial, suspension or
114	110		revocation of a license shall be in conformity with the rules of the
115	111
