20	49		Section 1-324.1, as last amended by Section 53,
21	50		Chapter 161, O.S.L. 2020 (6 3 O.S. Supp. 2020, Section
22	51		1-324.1), which relates to birth, death, or
23	52		stillbirth certificates; prohibiting certain actions;

30	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	60		SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -317, as
33	61		last amended by Section 2, Chapter 305, O.S.L. 2019 (63 O.S. Supp.
34	62		2020, Section 1-317), is amended to read as follows:

36	63		Section 1-317. A. A death certificate for each death which
37	64		occurs in this state shall be filed with the State Department of
38	65		Health, within three (3) days after such death.

40	66		B. The funeral director shall personally sign the death
41	67		certificate and shall be responsible for filing the death

42	95		certificate. If the funeral director is not available , the person
43	96		acting as such who first assumes custo dy of a dead body in
44	97		accordance with Section 1158 of Title 21 of the Oklahoma Statutes
45	98		shall personally sign and file the death certificate. The personal

	99	+	data shall be obtained from the next of kin or the best qualified
47	100		person or source available. The funeral director or person acting
48	101		as such shall notify the person providing the personal data that it
49	102		is a felony to knowingly provide false data or misrepresent any
50	103		person's relationship to the decedent . The certificate shall be
51	104		completed as to personal da ta and delivered to the attending
52	105		physician or the medical examiner responsible for completing the
53	106		medical certification portion of the certificate of death within
54	107		twenty-four (24) hours after the death. No later than July 1, 2012,
55	108		the personal data, and no later than July 1, 2017, the medical
56	109		certificate portion, shall be entered into the prescribed electronic
57	110		system provided by the State Registrar of Vital Statistics and the
58	111		information submitted to the State Registrar of Vital Statistics.
59	112		The resultant certificate produced by the electronic system shall be
60	113		provided to the physician or medical examiner for medical
61	114		certification within twenty -four (24) hours after the death.

63	115		C. The medical certification shall be completed and signed
64	116		within forty-eight (48) hours after death by the physician in charge
65	117		of the patient's care for the illness or condition which resulted in
66	118		death, except when inquiry as to the cause of death is required by

67	146		Section 938 of this t itle. No later than July 1, 2017, the medical
68	147		certification portion of certificate data shall be entered into the
69	148		prescribed electronic system provided by the State Registrar of
70	149		Vital Statistics and the information submitted to the State
71	150		Registrar of Vital Statistics.

73	151		D. In the event that the physician i n charge of the patient 's
74	152		care for the illness or condition which resulted in death is not in
75	153		attendance at the time of death, the medical certification shall be
76	154		completed and signed within forty -eight (48) hours after death by
77	155		the physician in attendance at the time of death, except:
78		-
79	156		1. When the patient is under hospice care at the time of death,
80	157		the medical certification may be signed by the hospice 's medical
81	158		director; and

83	159		2. When inquiry as to the caus e of death is required by Section
84	160		938 of this title.

86	161		Provided, that such certification, if signed by other than the
87	162		attending physician, shall note on the face the name of the
88	163		attending physician and that the information shown is only as
89	164		reported.

91	165		E. A certifier completing cause of death on a certificate of
92	166		death who knows that a lethal drug, overdose or other means of
93	167		assisting suicide within the meaning of Sections 3141.2 through
94	168		3141.4 of this title caused or contributed to the death shall list
95	169		that means among the chain of events under cause of death o r list it

101	201		SECTION 2. AMENDATORY 63 O.S. 2011, Section 1 -324.1, as
102	202		last amended by Section 53, Chapter 161, O.S.L. 2020 (63 O.S. Supp.
103	203		2020, Section 1-324.1), is amended to read as follows:

105		-	Section 1-324.1 A. It shall be unlawful for any person to

113	210		false pretenses;

115	211		3. Alter information contained on a birth, death or stillbirth
116	212		certificate;

118	213		4. Obtain, display or represent a birth certificate of any
119	214		person as one's own by any person, other than the person named on
120	215		the birth certificate;

122	216		5. Obtain, display or represent a fictitious death or
123	217		stillbirth certificate for the purpose of fraud;

125	218		6. Make a false statement or knowingly conceal a material fact
126	219		or otherwise commit fraud in an applicat ion for a birth, death or

137	253		B. Except as otherwise provided in t his subsection, it is a
138	254		felony for any employee or person authorized to issue or create a
139	255		birth, death or stillbirth certificate or related record under this
140	256		title to knowingly issue such certificate or r elated record to a
141	257		person not entitled thereto, or t o knowingly create or record such
142	258		certificate bearing erroneous information thereon. A certifier who
143	259		knowingly omits to list a lethal agent or improperly states manner
144	260		of death in violation of subsection E of Section 1-317 of this title
145	261		shall be deemed to have engaged in unprofessional conduct as
146	262		described in paragraph 8 of Section 509 of Title 59 of the Oklahoma
147	263		Statutes.

149	264		C. Except as otherwise provided in subsection B of this
150	265		section, a violation of an y of the provisions of this section shall
151	266		constitute a felony.

153	267		D. Notwithstanding any provision of this section, the State
154	268		Commissioner of Health or a designated agent, upon the request of a
155	269		chief administrator of a health or law enforcement agency, may
156	270		authorize the issuance, display or possession of a bi rth, death or
157	271		stillbirth certificate, which would otherwise be in violation of
