10659 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
10760 SECTION 1. AMENDATORY 22 O.S. 2011, Section 1105.3, as
10861 last amended by Section 1, Chapter 2, O.S.L. 2018 (22 O.S. Su pp.
10962 2020, Section 1105.3), is amended to read as follows:
11063 Section 1105.3. A. Any county, pursuant to the provisions of
11164 this act the Pretrial Release Act, may establish and fund a pretrial
11265 program to be utilized by the district court in that jurisdiction.
11366 Any entity offering pretrial services in a county within this state
11467 shall also be subject to the provisions of the Pretrial Release Act.
115-B. When a pretrial release program is established pursuant to
116-operating in this act state and private bail has not been furnished,
117-the judge may order a person to be evaluated through the pretrial
118-program. After conducting an evaluation of the person applying for
119-pretrial release, the pretrial program shall make a recommendation
120-to the court. The recommendation shall indicate any special
121-supervisory conditions for pretrial re lease. The judge shall
122-consider the recommendations and may grant or deny pretrial release.
123-The presiding judge of the judicial district may issue a standing
124-order outlining criteria for cases that may automatically be
125-evaluated for pretrial release by a pretrial program operating in

154-C. Except as otherwise authorized by the provisions of this
155-subsection, persons accused of or det ained for any of the following
156-offenses or conditions shall not be eligible for pretrial release by
157-any pretrial program:
158-1. Aggravated driving under the influence of an intoxicating
159-substance;
160-2. Any felony driving under the influence of an intoxicating
161-substance;
162-3. Any offense prohibited by the Trafficking In Illegal Drugs
163-Act;
164-4. Any person having a violent felony conviction within the
165-past ten (10) years;
166-5. Appeal bond;
167-6. Arson in the first degree, including attempts to commit
168-arson in the first degree;
169-7. Assault and battery on a police officer;
170-8. Bail jumping;

269-D. A person not eligible for pretrial release pursuant to the
270-provisions of subsection C of this section may be released upon
271-order of a district judge, associat e district judge or special judge
272-under conditions prescribed by the judge, which may include an order
273-to require the defendant, as a condition of pretrial release, to use

300-or participate in any monitoring or testing including, but not
301-limited to, a Global Positioning System (GPS) monitoring device and
302-urinalysis testing. The court may further order the defendant to
303-pay costs and expenses related to any supervision, monitoring or
304-testing.
305-E. Every pretrial services program operating pursuant to the
306-provisions of in this act state shall meet the following minimum
307-criteria:
308-1. The program shall establish a procedure for screening and
309-evaluating persons who are detained or have been arrested for the
310-alleged commission of a crime. The program shall obtain through a
311-law enforcement agency criminal history records on detained persons
312-through the National Crime Information Center (NCIC) and background
313-information from the defendant including all previous arrests,
314-convictions and orders of protection. The program shall use court
315-records available through the Oklahoma State Courts Network,
316-Department of Corrections, Oklahoma State Bureau of Investigation
317-and any other information provider as ordered by the court . The
318-information obtained from the screening and eva luation process must
319-be submitted in a written report without unnecessary delay to the
320-judge who is assigned to hear pretrial release applications when the
321-person is eligible for pretrial release;
322-2. The program shall provide reliable information to the j udge
323-relating to the person applying for pretrial release so a reasonable

350-decision can be made concerning the amount and type of bail
351-appropriate for pretrial release. The information provided shall be
352-based upon facts relating to the person's risk of dan ger to the
353-community and the risk of failure to appear for court; and
354-3. The program shall make all reasonable attempts to provide
355-the court with information appropriate to each person considered for
356-pretrial release.
357-F. A pretrial program established pursuant to operating in this
358-act state may provide different methods and levels of community -
359-based supervision to meet any court -ordered conditions of release.
360-The program may use existing supervision methods for persons who are
361-released prior to trial. P retrial programs which employ peace
362-officers certified by the Council on Law Enforcement Education and
363-Training (CLEET) are authorized to enforce court -ordered conditions
364-of release.
365-G. Each pretrial program established pursuant to operating in
366-this act shall provide a quarterly report to the presiding judge of
367-the judicial district of the jurisdiction in which it operates. A
368-copy of the report state shall prepare a monthly report to be filed
369-of record with the court clerk as a public record in and of the
370-jurisdiction of each pretrial release obtained . Each report shall
371-include, but is not limited to, the following information:
372-1. The total number of persons screened, evaluated or otherwise
373-considered for pretrial release;

400-2. The total number and nature of recommendations made;
401-3. The number of persons admitted to pretrial release that
402-failed to appear; and
403-4. The name, case number and criminal charge of each person for
404-whom the program obtained a pretrial release;
405-5. The name and case number of each person for whom the program
406-obtained a pretrial release who failed to appear in court or failed
407-to comply with the conditions of pretrial release;
408-6. The name and case number of each person the program obtained
409-a commitment from a judge or any return to c ustody by the program
410-and the reason for the return to custody;
411-7. The amount each person was charged for participating in the
412-pretrial program; and
413-8. Any other information deemed appropriate by the reporting
414-judicial district or that the program desire s to report.
415-H. Every pretrial release program established pursuant to
416-operating in this section state shall utilize the services of local
417-providers; provided, however, any program in continuous existence
418-since July 1, 1999, shall be exempt from the provi sions of this
419-subsection.
420-SECTION 2. This act shall become effective November 1, 2021. "
