54	115		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

56	116		SECTION 1. NEW LAW A new section of law not to be
57	117		codified in the Oklahoma Statutes reads as follows:
58		-
59	118		This act shall be known and may be cited as the "Sarah Stitt
60	119		Act".
61		-
62	120		SECTION 2. NEW LAW A new section of law to be codified
63	121		in the Oklahoma Statutes as Section 513.3 of Title 57, unless there
64	122		is created a duplication in numbering, reads as follows:
65		-
66	123		A. When any inmate shall be discharged from an institution of
67	124		the Department of Corrections and the intended residence designated
68	125		by the inmate is within this state, the Department of Corrections
69	126		shall provide the inmate with relevant documentation to ass ist the
70	127		inmate in obtaining post-release employment and shall coordinate
71	128		with the Department of Public Safety to provide a REAL ID
72	129		Noncompliant Identification Card if the inmate does not have a
73	130		current state-issued identification card or driver license.

75	131		B. 1. Within nine (9) months prior to the release of an inmate
76	132		from custody, the Department of Corrections shall identify whether

77	160		the inmate has a current form of state identification and begin the
78	161		process of gathering the documentation required for the is suance of
79	162		a REAL ID Noncompliant Identification Card pursuant to Section 6 -
80	163		105.3 of Title 47 of the Oklahoma Statutes. If an inmate has any
81	164		valid form of a state -issued identification card or driver license,
82	165		the inmate may avail himself or herself of the provisions of this
83	166		section.

85	167		2. The Department of Corrections may utilize any funds
86	168		available to cover the costs associated with the implementation and
87	169		administration of this section and the purchase of REAL ID
88		-	Noncompliant Identification Card s, including, but not limited to,
	170	+	Noncompliant Identification Card s including, but not limited to,
89	171		inmate trust funds, existing funds of the Department of Corrections
90	172		and donations.

92	173		3. The provisions of this section shall apply only to inmates
93	174		who may receive a state -issued identification card pursuant to
94	175		Section 1550.42 of Title 21 of the Oklahoma Statutes.

96	176		C. For purposes of assisting an inmate in obt aining post-
97	177		release employment, the Department of Corrections shall provide the
98	178		inmate with the following documentation:

100	179		1. A copy of the vocational training record of the inmate, if
101	180		applicable;

103	181		2. A copy of the work record of the inmate, if applicable;

105	182		3. A certified copy of the birth certificate of the inmate, if
106	183		obtainable;

112	214		the proficiency at tha t trade by the inmate; and

114	215		6. Documentation that the inmate has completed a practice job
115	216		interview.

117	217		In addition, the Department shall notify the inmate if he or she
118	218		is eligible to apply for a license from a state entity charged with
119	219		oversight of an occupa tional license or certification.

121	220		D. The Department of Corrections is authorized to promulgate
122	221		rules and procedures to implement the provisions of this section.

124	222		SECTION 3. AMENDATORY 47 O.S. 2011, Section 6 -105.3, as
125	223		last amended by Section 2, Chapter 1, O.S.L. 2017 (47 O.S. Supp.
126	224		2020, Section 6-105.3), is amended to read as follows:

128		-	Section 6-105.3 A. In addition to the licenses to operate

130	227		Oklahoma residents for purposes of identification only. The

139	263		to administer oaths by the person under the age of eighteen (18)
140	264		years with the application. Except as otherwise provid ed in this
141	265		section, the identification cards shall be valid for a period o f
142	266		four (4) years from the month of issuance; however, the
143	267		identification cards issued to persons sixty -five (65) years of age
144	268		or older shall be valid indefinitely from the month of i ssuance.

146	269		B. 1. The Department of Corrections shall coordinate with the
147	270		Department of Public Safety to provide REAL ID Noncompliant
148	271		Identification Cards to all inmates who do not have a current state -
149	272		issued identification card or driver license upon their release from
150	273		custody. The identification cards shall be issued, replaced ,
151	274		canceled and denied in the same manner as driver licenses in this
152	275		state.

154	276		2. If an inmate is unable to provide a valid identification
155	277		document and no other form of identification i s available, the
156	278		Department of Public Safety shall allow the use of a Depa rtment of
157	279		Corrections-issued consolidated record card to serve as a valid
158	280		identification document to obtain a REAL ID Noncompliant
159	281		Identification Card.

161	282		3. REAL ID Noncompliant Ident ification Cards issued with a
162	283		consolidated record card from the Department of Corrections for
163	284		inmates shall be valid for a period of four (4) years from the month

167	314		4. The fee charged for the issuance or replacement of a REAL ID
168	315		Noncompliant Identification Card pursuant to this subsection shall
169	316		be deposited in the Department of Public Safety Revolving Fund.
170	317		Provided, however, REAL I D Noncompliant Identification Cards issued
171	318		to individuals required to regi ster pursuant to the Sex Offenders
172	319		Registration Act shall only be valid for a period of one (1) year.
173	320		No person sixty-five (65) years of age or older shall be charged a
174	321		fee for a REAL ID Noncompliant Identification Card.

176	322		5. The Department of Public Safet y is authorized to promulgate
177	323		rules and procedures to implement the provisions of this subsection.

179	324		C. No person shall hold more than one state -issued or
180	325		territory-issued REAL ID Compliant Driver License or REAL ID
181		-	Compliant Identification Card, as defined in subsection G of Section ~~ENR. H. B. NO. 1679 Page 5~~
	326	+	Compliant Identification Card, as defined in subsection G of Section
182	327		6-101 of this title. The Department shall not issue a REAL ID
183	328		Compliant Identification Card to any applicant who has been
184	329		previously issued a REAL ID Com pliant Driver License or REAL ID
185	330		Compliant Identification Card unless such license or identification
186	331		card has been surrendered to the Department by the applicant. The
187	332		Department may promulgate rules related to the issuance of
188	333		replacement REAL ID Compliant Identification Cards in the event of
189	334		loss or theft.

191	362		C. D. The fee charged for the issuance, renewal, or replacement
192	363		of a REAL ID Compliant Identification Card shall be Twenty -five
193	364		Dollars ($25.00). The fee charged for the issuance, renewal or
194	365		replacement of a REAL ID Noncompliant Identification Card pursuant
195	366		to this section shall be Twenty-five Dollars ($25.00); however, no
196	367		person sixty-five (65) years of age or older shall be charged a fee
197	368		for an identification card. Of each fee charged pursuant to the
198	369		provisions of this subsection:

200	370		1. Seven Dollars ($7.00) shall be apporti oned as provided in
201	371		Section 1104 of this title;

203	372		2. Three Dollars ($3.00) shall be credited to the Department of
204	373		Public Safety Computer Imaging System Revolving Fund to be used
205	374		solely for the purpose of the administration and maintenance of the
206	375		computerized imaging system of the Department;
207		-
208	376		3. Ten Dollars ($10.00) shall be deposited in the Department of
209	377		Public Safety Revolving Fund ;
210		-
211	378		4. Three Dollars ($3.00) shall be deposited to the State Public
212	379		Safety Fund created in Section 2 -147 of this title; and
213		-
214	380		5. a. Two Dollars ($2.00) of the fee authorized by this
215	381		subsection related to the issuance, renewal or
216	382		replacement of an identification card by a motor
217	383		license agent that does not proces s approved
218	384		applications or renewals for REAL ID Compliant Driver
219	385		Licenses or Identification Cards shall be deposited,

232	423		D. E. The Oklahoma Tax Commission is hereby authorized to
233	424		reimburse, from funds available to that agency, each motor license
234	425		agent issuing an identification card to a person sixty -five (65)
235	426		years of age or older, an amount not to exceed One Dollar ($1.0 0)
236	427		for each card or driver license so issued. The Tax Commission shall
237	428		develop procedures for claims for reimbursement.

239	429		E. F. When a person makes application for a new identificati on
240	430		card, or makes application to renew an identification card, and the
241	431		person has been convicted of, or received a deferred judgment for,
242	432		any offense required to register pursuant to the Sex Offenders
243	433		Registration Act, the identification card shall be vali d for a
244	434		period of one (1) year from the month of issuance, but may be
245	435		renewed yearly during the time the person is subject to registration
