29112 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

31113 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, is
32114 amended to read as follows:

34115 Section 3247. A. A student shall be eligible for in -state
35116 status regardless of the residency of the student if the student is
36117 a:

38118 1. Dependent child or spouse of a person currently servin g as a
39119 member of the active uniformed services of the United States on
40120 full-time active duty status of more than thirty (30) days and for
41121 whom Oklahoma is the home of record;
42-
43122 2. Dependent child or spouse of a person currently serving as a
44123 member of the military reserve on active duty orders of more th an
45124 thirty (30) days and for whom Okl ahoma is the home of record;

47151 3. Person, or spouse or dependent child of a person, currently
48152 serving as a member of the uniformed services of the United States
49153 who is on full-time active duty for a period of more than th irty
50154 (30) days and is stationed or t emporarily present in Oklahoma
51155 through military orders;

53156 4. Person, or spouse or dependent child of a person, who was
54157 discharged or released from a period of not fewer than ninety (90)
55158 days of active uniformed service, l ess than five (5) ten (10) years
56159 before the date of enrollment in the course (s) concerned and for
57160 whom Oklahoma is the home of record; or

59161 5. Person who is participating in or has received a partial or
60162 full scholarship from the Air Force Reserve Officers ' Training
61163 Corps, Army Reserve Officer s' Training Corps or the Navy/Marines
62164 Reserve Officers' Training Corps.

64165 B. To be eligible for in-state status as provided for in
65166 subsection A of this section and to maintai n eligibility, the
66167 student shall:

68168 1. Satisfy admission and retention standards as determined by
69169 the Oklahoma State R egents for Higher Education for an institution
70170 within The Oklahoma State System of Higher Education; and
71-
72171 2. Have secured admission to and enrolls full-time or part-time
73172 in a program of study at an institution within The O klahoma State
74173 System of Higher Education .

76200 C. A student who files with the institution within The Oklahoma
77201 State System of Higher Education at which the student intends to
78202 register a letter of intent to establish residen ce in the state and
79203 who resides in the state while enrolled in the instituti on shall be
80204 eligible for in-state status, regardless of the residency of the
81205 student or home of record, if the student:

83206 1. Is a person who:
84-
85207 a. was discharged or released from a pe riod of not fewer
86208 than ninety (90) days of active duty uniformed
87209 service, less than five (5) years before the date of
88210 enrollment in the course(s) concerned, and

90211 b. is pursuing a course of education with educat ional
91212 assistance under Chapter 30 or 33 of Titl e 38 of the
92213 United States Code while living in this state; or

94214 2. Is a person who:

96215 a. is entitled to assistance under Section 3311(b)(9) or
97216 3319 of Title 38 of the United States Code by virtue
98217 of a relationship to a person who was discharged or
99218 released from a period of not fewer than ninety (90)
100219 days of active duty uniformed serv ices, and

102220 b. enrolls in the course(s) concerned within five (5)
103221 years of the date the related person was discharged or
104222 released from a period of not fewer than ninety (90)
105223 days of active duty uniformed services.

107250 D. To be eligible for in -state status as provided for in
108251 subsection C of this section and to maintain eligibility, the
109252 student shall:

113255 within The Oklahoma State System of Higher Education; and

119259 E. A student who meets the eligib ility requirements for in -
120260 state status shall maintain in-state status if the student remains
121261 continuously enrolled at an institution within The Oklahoma State
122262 System of Higher Education after the student:

124263 1. As described in paragraphs 1, 2 or 3 of subsect ion A of this
125264 section is discharged or r eleased from active duty service;

127265 2. As described in paragraph 4 of subsection A of this section
128266 or paragraph 1 and 2 of subsection C of this section exceeds the
129267 five-year period after being discharged or released f rom active duty
130268 uniformed service;

132269 3. As described in paragraph 1 of subsection C of this section
133270 has exhausted education assistance provided under Chapter 30 or 33

137299 has exhausted education assistance provided under Section 3311(b)(9)

140301 F. For purposes of this section, "home of record" means the
141302 place where one was living when the person enlisted or was
142303 commissioned into the military or reenlisted in the military.

144304 G. The State Regents for Higher Education shall develop
145305 policies and procedures necessary to implement the provisi ons of
146306 this section.

148307 SECTION 2. NEW LAW A new section of la w to be codified
149308 in the Oklahoma Statute s as Section 3249 of Title 70, unless there
150309 is created a duplication in numbering, reads as follows:

152310 If a member of the Armed Forces has been stationed for more than
153311 one (1) year in Oklahoma any time in the previous ten (10) years
154312 before the date of enrollment in the course(s) concerned, then the
155313 member, or the spouse or dependent child of the member , shall be
156314 eligible for in-state tuition at a public institution of higher
157315 education.
