29	112		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

31	113		SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, is
32	114		amended to read as follows:

34	115		Section 3247. A. A student shall be eligible for in -state
35	116		status regardless of the residency of the student if the student is
36	117		a:

38	118		1. Dependent child or spouse of a person currently servin g as a
39	119		member of the active uniformed services of the United States on
40	120		full-time active duty status of more than thirty (30) days and for
41	121		whom Oklahoma is the home of record;
42		-
43	122		2. Dependent child or spouse of a person currently serving as a
44	123		member of the military reserve on active duty orders of more th an
45	124		thirty (30) days and for whom Okl ahoma is the home of record;

48	152		serving as a member of the uniformed services of the United States

50	154		(30) days and is stationed or t emporarily present in Oklahoma

53	156		4. Person, or spouse or dependent child of a person, who was
54	157		discharged or released from a period of not fewer than ninety (90)
55	158		days of active uniformed service, l ess than five (5) ten (10) years
56	159		before the date of enrollment in the course (s) concerned and for
57	160		whom Oklahoma is the home of record; or

59	161		5. Person who is participating in or has received a partial or
60	162		full scholarship from the Air Force Reserve Officers ' Training
61	163		Corps, Army Reserve Officer s' Training Corps or the Navy/Marines
62	164		Reserve Officers' Training Corps.

64	165		B. To be eligible for in-state status as provided for in
65	166		subsection A of this section and to maintai n eligibility, the
66	167		student shall:

68	168		1. Satisfy admission and retention standards as determined by
69	169		the Oklahoma State R egents for Higher Education for an institution
70	170		within The Oklahoma State System of Higher Education; and
71		-
72	171		2. Have secured admission to and enrolls full-time or part-time
73	172		in a program of study at an institution within The O klahoma State
74	173		System of Higher Education .

76	200		C. A student who files with the institution within The Oklahoma
77	201		State System of Higher Education at which the student intends to
78	202		register a letter of intent to establish residen ce in the state and
79	203		who resides in the state while enrolled in the instituti on shall be
80	204		eligible for in-state status, regardless of the residency of the
81	205		student or home of record, if the student:

83	206		1. Is a person who:
84		-
85	207		a. was discharged or released from a pe riod of not fewer
86	208		than ninety (90) days of active duty uniformed
87	209		service, less than five (5) years before the date of
88	210		enrollment in the course(s) concerned, and

90	211		b. is pursuing a course of education with educat ional
91	212		assistance under Chapter 30 or 33 of Titl e 38 of the
92	213		United States Code while living in this state; or

94	214		2. Is a person who:

96	215		a. is entitled to assistance under Section 3311(b)(9) or
97	216		3319 of Title 38 of the United States Code by virtue
98	217		of a relationship to a person who was discharged or
99	218		released from a period of not fewer than ninety (90)
100	219		days of active duty uniformed serv ices, and
101		-
102	220		b. enrolls in the course(s) concerned within five (5)
103	221		years of the date the related person was discharged or
104	222		released from a period of not fewer than ninety (90)
105	223		days of active duty uniformed services.

107	250		D. To be eligible for in -state status as provided for in
108	251		subsection C of this section and to maintain eligibility, the
109	252		student shall:

112	254		the Oklahoma State Regents for Higher Education for an institu tion
113	255		within The Oklahoma State System of Higher Education; and

117	258		System of Higher Education .

119	259		E. A student who meets the eligib ility requirements for in -
120	260		state status shall maintain in-state status if the student remains
121	261		continuously enrolled at an institution within The Oklahoma State
122	262		System of Higher Education after the student:

124	263		1. As described in paragraphs 1, 2 or 3 of subsect ion A of this
125	264		section is discharged or r eleased from active duty service;

127	265		2. As described in paragraph 4 of subsection A of this section
128	266		or paragraph 1 and 2 of subsection C of this section exceeds the
129	267		five-year period after being discharged or released f rom active duty
130	268		uniformed service;

132	269		3. As described in paragraph 1 of subsection C of this section
133	270		has exhausted education assistance provided under Chapter 30 or 33

140	301		F. For purposes of this section, "home of record" means the
141	302		place where one was living when the person enlisted or was
142	303		commissioned into the military or reenlisted in the military.

144	304		G. The State Regents for Higher Education shall develop
145	305		policies and procedures necessary to implement the provisi ons of
146	306		this section.

148	307		SECTION 2. NEW LAW A new section of la w to be codified
149	308		in the Oklahoma Statute s as Section 3249 of Title 70, unless there
150	309		is created a duplication in numbering, reads as follows:

152	310		If a member of the Armed Forces has been stationed for more than
153	311		one (1) year in Oklahoma any time in the previous ten (10) years
154	312		before the date of enrollment in the course(s) concerned, then the
155	313		member, or the spouse or dependent child of the member , shall be
156	314		eligible for in-state tuition at a public institution of higher
157	315		education.
