4043 An Act relating to prisons and reformatories;
4144 amending 57 O.S. 2011, Section 332.18, as last
4245 amended by Section 1, Chapter 42, O.S.L. 2015 (57

4447 requests for medical parole review; updating
4548 language; modifying circumstances that authorize
4649 medical parole reviews; adding definitions; and

5255 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5356 SECTION 1. AMENDATORY 57 O.S. 2011, Section 332.18, as
5457 last amended by Section 1, Chapter 42, O.S.L. 2015 (57 O.S. Supp.
5558 2020, Section 332.18), is amended to read as follows:
5659 Section 332.18 A. The Director of the Department of
5760 Corrections shall have the authority to request the Executive
5861 Director of the Pardon and Parole Board to place an inmate on the
5962 Pardon and Parole Board docket for a medical reason , out of the
6063 normal processing procedures. Documentation of the medical
6164 condition of such inmate shall be certified by the medical director
6265 of the Department of Corrections. The Pardon and Parole Board shall

8993 have the authority to bring any such inmate befo re the Board at any
9094 time, except as otherwise provided in subsection B of this section.
9195 B. When a request is made for a medical parole review of an
9296 inmate who is dying or is, near death, medically frail or medically
9397 vulnerable as certified by the medical director of the Department of
9498 Corrections or whose medical condition has rendered the inmate no
9599 longer an unreasonable threat to public safety, the Executive
96100 Director shall place such inmate on the first available parole
97101 review docket for a compassionate p arole consideration. Inmates who
98102 meet the criteria set out in this section are not subject to the
99103 two-stage hearing process in subsection C D of Section 332.7 of this
100104 title.
101105 C. No person shall be eligible for consideration for medical
102106 parole without the concurrence of at least three members of the
103107 Pardon and Parole Board. The vote on whether or not to consider
104108 such person for parole and the names of the concurring Board members
105109 shall be set forth in the written minutes of the meeting of the
106110 Board at which the issue is considered.
107111 D. In the event that due to changes in the medical condition of
108112 the parolee granted medical parole or for other reasons, it is
109113 determined that the continuation of the medical parole presents an
110114 increased risk to the public, the parolee shall be subject to parole
111115 revocation. In such case, the Department of Corrections shall

138143 follow the revocation procedure for violators of parole set forth in
139144 Section 516 of this title.
140145 E. The provisions of this section shall not apply to inmates
141146 serving a sentence of life without the possibility of parole.
142147 F. As used in this section:
143148 1. "Activities of daily living" means basic personal care and
144149 everyday activities that a person cannot perform on his or her own,
145150 including tasks such as :
146151 a. eating,
147152 b. toileting,
148153 c. grooming,
149154 d. dressing,
150155 e. bathing, and
151156 f. transferring from one physical position to another,
152157 including moving from a reclining position to a
153158 sitting or standing position ;
154159 2. "Dying" or "near death" means an individual with a medical
155160 condition and who has an estimated life expectancy of six (6) months
156161 or less;
157162 3. "Medical condition" includes, but is not limited to, the
158163 following:
159164 a. disabling mental disorders including dementia,
160165 Alzheimer's disease or similar degenerative brain

188194 b. human immunodeficiency virus (HIV) or acquired immune
189195 deficiency syndrome (AIDS),
190196 c. cancer,
191197 d. cardiovascular disease ,
192198 e. chronic lung disease or asthma ,
193199 f. diabetes,
194200 g. hepatitis C,
195201 h. seizure disorders,
196202 i. complications during pregnancy that th reaten the
197203 health of the pregnant person or fetus including , but
198204 not limited to, preeclampsia, fetal abnormalities or
199205 fetal distress,
200206 j. inmates receiving life -sustaining care such as feeding
201207 tubes or colostomy bags,
202208 k. disabling neurological disorders su ch as multiple
203209 sclerosis (MS) or amyo trophic lateral sclerosis (ALS),
204210 and
205211 l. any other condition related to a weakened immune
206212 system or that requires or is expected to require
207213 specialty care or recurrent hospitalization;
208214 4. "Medically frail" means an indi vidual with a medical
209215 condition who cannot perform two or more activities of daily living
210216 on his or her own; and

237244 5. "Medically vulnerable" means an individual with one or more
238245 medical conditions who is likely to contract an illness or disease
239246 in prison that can lead to death or cause an individual to become
240247 medically frail. The term shall only apply during a catastrophic
241248 health emergency that has been declared by the Governor pursuant to
242249 the provisions of Sections 6401 through 6403 of Title 63 of the
243250 Oklahoma Statutes.
244251 SECTION 2. This act shall become effective November 1, 2021.
