51	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	59		SECTION 1. AMENDATORY 59 O.S. 2011, Section 1850.8, is
53	60		amended to read as follows:
54	61		Section 1850.8. A. The Construction Indus tries Board shall
55	62		issue a license as a mechanical journeyman or mechanical contractor
56	63		to any person who:
57	64		1. Has been certified by the Committee of Mechanical Examiners
58	65		as having successfully passed the appropriate examination; and
59		-	2. Has paid the license fee and has otherwise complied with the
60		-	provisions of the Mechanical Licensing Act. The license fees shall
61		-	be established by rule by the Board pursuant to Section 1000.5 of
62		-	this title.

	92	+	2. Has paid the license fee and has otherwise complied with the
	93	+	provisions of the Mechanical Licensing Act. The license fees shall
	94	+	be established by rule by the Board pursuant to Section 1000.5 of
	95	+	this title.
90	96		B. A registered apprentice working under the supervision of a n
91	97		active mechanical contractor may sit for the examination for a
92	98		limited mechanical HVAC license , limited residential journeyman
93	99		license, limited residential installer license or any subspecialty
94	100		to the limited mechanical HVAC license without satisfying the
95	101		training or experience requirements in the Mechanical Licensing Act ,
96	102		provided the overseeing mechanical contractor certifies to the
97	103		Construction Industries Board that t he registered apprentice :
98	104		1. Has at least eighteen (18) months' substantially similar
99	105		experience;
100		-	2. Has at least six (6) months ' as a registered apprentice
101		-	under the certifying mechanical contractor ; and
102		-	3. Has the skills necessary to sit for the relevant
103		-	examination.

104	109		A journeyman licensed pursuant to this subsection shall be required
105	110		to work under the supervision of an active mechanical contractor who
106	111		shall be required to maintain adequate insurance coverage for any
107	112		journeyman working under their purview. A registered apprentice may
108	113		not receive an unlim ited journeyman license through the provisions
109	114		of this subsection.
110		-	C. All licenses shall be no ntransferable. No license shall be
111		-	issued for longer than one (1) year and all licenses shall expire on
112		-	the last day in the birth month of the licensee. Licenses renewed
113		-	more than thirty (30) days fo llowing the date of expiration may only

	141	+	C. All licenses shall be nontransferable. No license shall be
	142	+	issued for longer than one (1) year and all licenses shall expire on
	143	+	the last day in the birth month of the licensee. Licenses renewed
	144	+	more than thirty (30) days fo llowing the date of expiration may only
141	145		be renewed upon application and payment of the required fees and
142	146		payment of any penalty for late renewal, as shall be established by
143	147		the Board. No journeyman or contractor license shall be renewed
144	148		unless the licensee has completed the required hours of continuing
145	149		education as determined by the Committee. Persons who are licensed
146	150		as contractors under the Mechanical Licensing Act may have their
147	151		license placed on inactive status by paying the annual renewal fee
148	152		and eliminating the bonding and insurance requirements. No late fee
149	153		shall be charged to renew a license which expired while the
150	154		applicant was in military service, if application is made within one
151	155		(1) year of discharge from the military service.
152	156		C. D. The Board is authorized to establish and issue, subject
153	157		to the provisions of the Mechanical Licensing Act, limited licenses
154	158		in each area of mechanical work based on the experience, ability,
155	159		examination scores and the education of the applicant. The limited
156	160		licenses shall authorize the licensee to engage in only those
157	161		activities and within the limits specified in the license.
158	162		SECTION 2. This act shall become effective November 1, 2021.
