1747 Chapter 305, O.S.L. 2019 (63 O.S. Supp. 2020, Section
1848 1-317), which relates to death certificates;
1949 authorizing an advanced practice registered nurse to
2050 sign a death certificate; and providing an effective

2756 BE IT ENACTED BY THE PEOPL E OF THE STATE OF OKLAHOMA:

2957 SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -317, as
3058 last amended by Section 2, Chapter 305, O.S.L. 2019 (63 O.S. Supp.
3159 2020, Section 1-317), is amended to read as follows:

3360 Section 1-317. A. A death certificate for each death which
3461 occurs in this state shall be filed with the State Department of
3562 Health, within three (3) days after such death.

3763 B. The funeral director shall personally sign the death
3864 certificate and shall be responsible for filing the d eath
3965 certificate. If the funeral director is not available, the person

4093 acting as such who first assumes custody of a dead body in
4194 accordance with Section 1158 of Title 21 of the Oklahoma Statutes
4295 shall personally sign and file the death certificate. The personal
4396 data shall be obtained from the next of kin or the best qualifie d
4497 person or source available. The certificate shall be completed as
4598 to personal data and delivered to the attending physician or the

99+medical examiner responsible for completing the m edical
47100 certification portion of the certificate of death within twenty -four
48101 (24) hours after the death. No later than July 1, 2012, the
49102 personal data, and no later than July 1, 2017, the medical
50103 certificate portion, shall be entered into the prescribed el ectronic
51104 system provided by the State Registrar of Vital Statistics and t he
52105 information submitted to the State Registrar of Vital Statistics.
53106 The resultant certificate produced by the electronic system shall be
54107 provided to the physician or medical examine r for medical
55108 certification within twenty -four (24) hours after the death .

57109 C. The medical certification shall be completed and signed
58110 within forty-eight (48) hours after death by the physician or
59111 advanced practice registered nurse in charge of the patient 's care
60112 for the illness or condition which resulted in death, except when
61113 inquiry as to the cause of death is required by Section 938 of this
62114 title. No later than July 1, 2017, the medical certification
63115 portion of certificate data shall be entered into th e prescribed
64116 electronic system provided by the State Registrar of Vital

68146 D. In the event that the physician or advanced practice
69147 registered nurse in charge of the patient' s care for the illness or
70148 condition which resulted in death is not in att endance at the time
71149 of death, the medical certification shall be completed and signed
72150 within forty-eight (48) hours after death by the physician or
73151 advanced practice registered nurse in attendance at the time of
74152 death, except:

76153 1. When the patient is under hospice care at the time of death,
77154 the medical certification may be signed by the hospice's medical
78155 director; and
79-
80156 2. When inquiry as to the cause of death is required by Section
81157 938 of this title.

83158 Provided, that such certification, if signed by other tha n the
84159 attending physician or advanced practice registered nurse , shall
85160 note on the face the name of the attending physician or advanced
86161 practice registered nurse and that the informat ion shown is only as
87162 reported.

89163 E. A certifier completing cause of death on a certificate of
90164 death who knows that a lethal drug, overdose or other means of
91-assisting suicide within the meaning of Sections 3141.2 through ENR. H. B. NO. 2009 Page 3
165+assisting suicide within the meaning of Sections 3141.2 through
92166 3141.4 of this title caused or contr ibuted to the death shall list
93167 that means among the chain of events under cause of death or list it

95196 in the chain of events under cause of death or in the box that
96197 describes how the injury occurred, the certifier shall indicate
97198 "suicide" as the manner of death.
