20	50		sign a death certificate; and providing an effective

27	56		BE IT ENACTED BY THE PEOPL E OF THE STATE OF OKLAHOMA:

29	57		SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -317, as
30	58		last amended by Section 2, Chapter 305, O.S.L. 2019 (63 O.S. Supp.
31	59		2020, Section 1-317), is amended to read as follows:

33	60		Section 1-317. A. A death certificate for each death which
34	61		occurs in this state shall be filed with the State Department of
35	62		Health, within three (3) days after such death.

37	63		B. The funeral director shall personally sign the death
38	64		certificate and shall be responsible for filing the d eath

40	93		acting as such who first assumes custody of a dead body in
41	94		accordance with Section 1158 of Title 21 of the Oklahoma Statutes
42	95		shall personally sign and file the death certificate. The personal
43	96		data shall be obtained from the next of kin or the best qualifie d
44	97		person or source available. The certificate shall be completed as
45	98		to personal data and delivered to the attending physician or the

	99	+	medical examiner responsible for completing the m edical
47	100		certification portion of the certificate of death within twenty -four
48	101		(24) hours after the death. No later than July 1, 2012, the
49	102		personal data, and no later than July 1, 2017, the medical
50	103		certificate portion, shall be entered into the prescribed el ectronic
51	104		system provided by the State Registrar of Vital Statistics and t he
52	105		information submitted to the State Registrar of Vital Statistics.
53	106		The resultant certificate produced by the electronic system shall be
54	107		provided to the physician or medical examine r for medical
55	108		certification within twenty -four (24) hours after the death .

57	109		C. The medical certification shall be completed and signed
58	110		within forty-eight (48) hours after death by the physician or
59	111		advanced practice registered nurse in charge of the patient 's care
60	112		for the illness or condition which resulted in death, except when
61	113		inquiry as to the cause of death is required by Section 938 of this
62	114		title. No later than July 1, 2017, the medical certification
63	115		portion of certificate data shall be entered into th e prescribed
64	116		electronic system provided by the State Registrar of Vital

68	146		D. In the event that the physician or advanced practice
69	147		registered nurse in charge of the patient' s care for the illness or
70	148		condition which resulted in death is not in att endance at the time
71	149		of death, the medical certification shall be completed and signed
72	150		within forty-eight (48) hours after death by the physician or
73	151		advanced practice registered nurse in attendance at the time of
74	152		death, except:

76	153		1. When the patient is under hospice care at the time of death,
77	154		the medical certification may be signed by the hospice's medical
78	155		director; and

80	156		2. When inquiry as to the cause of death is required by Section
81	157		938 of this title.

83	158		Provided, that such certification, if signed by other tha n the
84	159		attending physician or advanced practice registered nurse , shall
85	160		note on the face the name of the attending physician or advanced
86	161		practice registered nurse and that the informat ion shown is only as
87	162		reported.

89	163		E. A certifier completing cause of death on a certificate of
90	164		death who knows that a lethal drug, overdose or other means of
91		-	assisting suicide within the meaning of Sections 3141.2 through ~~ENR. H. B. NO. 2009 Page 3~~

92	166		3141.4 of this title caused or contr ibuted to the death shall list
93	167		that means among the chain of events under cause of death or list it
